Section 1', That permission and authority are hereby granted to the
Theodore Ha�n Brewing Company to grsclQ, pave aAd construct incidental items
thereto ia thc+ relocated alignment of Walsh Street fro� Reaney Avenne to Bush
Avenue described as follaws:
Either:
Lot� 10 and 11 and the westerly 20 feet
of �,ots 9 and 12, all in block 55,
Arlington Hills Addition to St. Paul.
Or:
' The easterly 30 feet of Lots 10 and 11
and the we�terly 30 feet of Lots 9 and
12, all in Bluck 55, Arlington Hills
Addition to St. Paul.
Section 2. That the Co�issioner of Public �lorks is hereby authorized
to iss�e a permit to Theodore Hamon Brewing Campany for the coastruction of
Walsh Street between Reaney Avenue and Bush Avenue subject to cc�mpliance of the
following conditions:
a. Thati said perm3.ttee shall conatract said Walsh Street entirely
at its own expense, under the supervisio� and to Che satisifaction of the Coim�iseioner
of Public Works and in accordance with the plans and specifications prepared aad
approved by and on file in the Department of Pa.blic Works. Construction must be
performed bq a contractor approved by the Department of Public Worke.
b. lhat said permittee shall pay for the publication of this ordinance
and publication ot all resolutions related thereto.
c. That said perffiiCtee ahall pay the cost of administration,
engineering and inspecticm of said work, and said costs to be accoeinted for under
Department of Public Works Pro,ject Nu�ber G-1961.
d. That said permittee shall properlq protect all excavations made
in the streets, sidewalks and boulevards both day a�d night so as to avoid
all damage or injury to persons or propertq.

e. Said permittee, after the inception of said wvrk, shall prosecute
said work continuously, with diligence and fnlly co�aplete said work to the
satisfaction and apprAVal of the Cc�issioner of Pnblic Works as directed
in the special provisions of the prepared plans.
f. That said permittee shall notify the Traffie Buresu of the Public
Works Depart�nt wh�n the exieting vacated Walsh Street is to be closed and
sl�all provide and paq for all aecessary temporary construction and incidentals
thereto to the satisfactiun of the Department of Yablic Works to allow for a
tmaporary by pass of vacated Walsh Street on the new dedicated alig�nment for
pedestrian and vehieular traffic, if so directed by the Departaneat of Yeiblic
Works.
g. That said permittee shall give advance notification to the Coz�struction
$ngineer of the Department of Public Works as to the pro�osed start of �constrnetioa
and proper achednl� of operations and shall also aotify said Construction Ec�gineer
�ie� projecC has been co�pleted to allow for a final inspection.
h. 7t�at said permittee shall furnish a band to tl�e City of Saint Paul
in the sum of Tea Thousaad Dollars ($10,000) conditioned to eomply w1.th all
terms of this ordinance and to indemnify and save harmless said City frrna all
liability, loss, ,judgo�ents, suits, costs, charges and expenses that �sy accrae
to persons or prc�perty occasioned by the making of the improvement or arising
out of the aame.
i. That said permittee shall, daring the t�rm of this p�rmit, restore
and repair all property, whether plilblic or private, damaged or �ich may be
damaged due to the construction.
j. T�iat said permittee expressly agrees and undertakes ta fully
ixde�nifq, hold harmless and defend the City of Saint Paul, its agents,
officers and emploqees frrna any and �11 damages, clai�s, losses, judgments,
saits or expenses arising out of or occasfoned by the performanee of the
work contemplated by this per�aission and at�thority.
k. That said permittee shall not proceed with conatruction unless
and u�til said peraii.ttee shall have fully cc�mplied wiCh the prvvisions regard-
ing insurance an.d indemnificatian contained in the City of Saint Pau�,
Department of Public Worka Specifications for Street and Sewer Construction,
dated April 1, 1959, Section numbered 1.44 of said specifications, as amended,
applicable to coatractors. For the purpose of this ordinance, the aforesaid
section of said specifications, ne�mber 1.44, as amended, shall be read as though
the word "parmittee" was substituted for the word "contractor", wherever the
same appears in tbe aforesaid Section i.44, as amended. Said Section 1.44,

as amended, of the Specifications for Street and Sewer Co�struction in the City
of Saint Paul is hereb� incorporated herein by reference as fully and as
completely as if set forth herein verbatim. Pro�af cf campliance with provisions
of the aforesaid aection sha11 be in such form as the Corporation Coansel
of the City of Saint Paul may direct and the docu�ents required by the aforesaid
Section 1.44 shall, after submis�ion to the Corporation Counsel, be filed in
the office of the Co�nptroller of the City of Saint Paul.
1. 1�at said permittee shall submit bond and insurance documents to
the Office Engi�eer of the Depart�nt of Public Works.
m. That said permittee shall within thirty E30) days after the passage
of this ordinance, file a written acceptance thereof with the City Clerk.
Sectio� 3. This ordinance shall take effect and be in force thirty (30) daqs
fro� and after its passage, approval and publication.
