WHEREAS, the City of Saint Paul, by Resolution of its Council,
Council File No. 249471, has authorized the acceptance of �3,600.00
in full compromise settlement of Registered Bill No. 3-6161; and
WHEREAS, payment in the amount above stated has been received;
now, therefore, be it
RESOLVED, that the proper City officials are hereby authorized
to deposit in the Traffic Signal Outlay Fund of the Department of
Public Works, No. 0204-803, the sum of �2,400.00; and be it
FUR,THER RESOLVED, that James R. Tschida be paid the sum of
�1,200.00 as attorney' s fees, said fees being authorized by Council
File No. 24'7'757.

RE: Dennis Hughes
On June 20, 1969, Dennis Hughes was injured while employed
by the City of Saint Paul . Subsequent workmen' s compensation
benefits and medical payment made by the City amounted to �2,973.00.
City property was damaged in the amount of �4,198. 10.
Mr. Hughes has retained the services of James R. Tschida,
attorney at law, to pursue his remedies against third parties.
Since the City has an interest in recovery of monies for both the
personal injuries sustained by Mr. Hughes and the property damage,
the Council by resolution authorized Mr. Tschida to represent its
interests.
Questions have been raised concerning the basis for this
procedure. At the request of Commissioner Butler this office re-
viewed the files for the years 1965 through 19�0 involving payment
of outside attorneys ' fees. Out of approximately three thousand
five hundred files involving either workmen' s compensation benefits
or a combination of workmen' s compensation benefits and property
damage, we found 17 cases that involved third party accidents, and
a subsequent recovery of fees by outside counsel (see attached list) .
It should be noted that the City' s recovery is not necessarily the
total recovery obtained and the statutory fees (Minn. Stat. 176.061 ,
Subd. 6) in each instance are based on total recovery.
