COMMISSIONE ATF
RESOLVED, that the Council hereby ratifies and approves the
action of the Saint Paul Board of Appeals and Review for the Hous-
ing Building and Fire Prevention Codes at its meeting of March 11,
1970, pertaining to the pxperty located at 444 West Lynnhurst Ave.
owned by Mary F. Noltimier and described as :
Lots E-F-D, Hinkei's 2nd Amendment to Union Park;
waiving the requirement of Section 34.01, Section_ 54 .07 and Section
54.13 of the Saint Paul Legislative Code that no space in any cellar
shall be used for occupancy or for sleeping purposes, on condition
that either the boiler room be enclosed with a one-hour fire rated
material or that two sprinklers be installed above the boiler and
one each above the incinerator and water heater; that a one-hour
fire rated door be installed separating the first floor from the
basement and that adequate ventilation be provided for the basement
and first floor bathrooms; and be it
FURTHER RESOLVED, that such wai�ver be granted for as long as
the property, located at 444 West Lynnhurst Ave. be sold or any other
right, title or interest be transferred at which time said waiver
be nullified; and be it
FINALLY RESOLVED, that the City Clerk is hereby authorized and
directed to transmit a copy of this resolution to the Ramsey County
Register of Deeds.
