Hilstad SUBJECT: Letter dated March 24 , 1970 to Emil H. Nelson, Inc. Realtors , from the Bureau of Health rega�ding Housing Code defi- ciencies on the property located at 1528 Grantham St. APPEARANCES : Paul A. Hilstad, � PROCEEDINGS : Mr. Hilstad said he thought the property at 1528 Grantham St. �eas paid for. Present rent is $175 per month . Mr. Bernsten 's income is $3 ,984 Per year. His expenses and upkeep total $3 ,600 per year. Johnson SUBJECT: Letter dated May 12, 1970 to Hilda Johnson, 1071 Desoto from the Phalen Area Improvement Program indicating items that do not meet Codes of the City at the property located at 973 Payne Ave . APPEARANCES : Mrs . Eugene Borndale. PROCEEDINGS : Mrs . Borndale said she was happy to live at 973 Payne Ave . and has lived there for 17 years . Presently her father, Frank Sobkowiak lives there with her on the second floor. Mr. McCausland reviewed the items that were not in compliance with the St. Paul Legislative Code. ACTION: Moved by Cohen that a variance be granted to items 1-7 in the subject of appeal dated May 12 , 1970 . Such waiver is to be granted on condition that the property at 973 Payne Ave. be properly fused and that illegal extension cords be removed. Further moved that such waiver be granted for as lona as Mrs . Eugene Borndale and/or her father, Frank Sobkowiak , reside at 973 Payne Ave . or until such time as the property, owned by Mrs . Hilda B. Johnson, is sold or the ownership transferred at which such time said waiver be nullified. Seconded by Tieso. s THE VOTE : Ayes : Cohen, Grove , Rehnberg, Sommerdorf, Tieso, Voigt. Pattie Jordan, 1836 Marshall Ave . from Robert L. Ames , City Architect concerning a Certificate of Occupancy for 1915 Marshall Ave. APPEARANCES : Mrs . Patricia Jordan. PROCEEDINGS : Mrs . Jordan 's appeal dated May 7 , 1970 was read. She said that she needed the income from the third floor occu- pancy for an additional 36 months in order to help defray the expense of repairing and remod'eling the property at 1915 Marshall Ave . Presently two adults occupy the third floor dwelling unit. - 2 - � ' 6/l0/�0 • • Meeting No. 33 ACTION: Moved by Cohen to waive 5ection 54 . 15 (�3) of the Saint Paul Legislative Code that no wood frame multiple dwelling be occupied above the second floor to allow continued occupancy of the third floor dwelling unit at 1915 bZarshall Ave. for a period of no more than thirty-six (36) months . Such waiver is granted on condition that said third floor be occupied by no more than two (2) adults and that all other code violations be corrected during said period of time. Martinson SUBJECT: Letter dated July l, 1970 to Thomas Anderson, Board of ; Appeals , from Glenn A. Erickson, Assistant City Architect. APPEARANCES : Mrs . Robert Martinson. PROCEEDINGS : Mrs . Martinson said that it was being considered to build a detached garage enclosing the rear house door and kitchen window on the property at 1365 Clarence St. but that this could not be done without encroaching upon two feet of the present four foot property line limitation. She submitted a statement from the owner of the adjacent property affected which indicated that he would have no objections to such construction. ACTIODl: Moved by Cohen to waive Section 40 .00-1i of the Saint Paul Legislative Code dealing with side yard lot line limitations in order to permit construction of a detached garage within two feet of the side yard property line as indicated. Seconded by Voigt. THE VOTE : Ayes : Cohen, Grove, Rehnberg, Sommerdorf, Tieso, Voigt. Nayes : none. Abstentions : none. Guy Chase, ` PROCEEDINGS : Mr. Chase explained that due to the heavy traffic on Cretin Ave . he wished to be able to build a garage on his lot in order to be able to turn around in the rear yard to avoid backing into the street. The only way he could do this would be to build . one foot from the rear and side lot lines . He said he felt that . he could get letters from the adjacent property owners indicating that they would have no objections to placing the garage in such / a way. ACTION: Moved by Cohen to waive Section 40 .00-1i of the St. Paul Bldg. Code pertaining to side and rear yard lot requirements to allow construction of a qarage one (1) foot from the side and rear property lines at 548 South Cretin Ave . Such waiver is granted on condition that letters be received by the Board of Appeals from adjacent property owners affected indicating that they would have no objection to such construction. , Seconded by Grove . Levin SUBJECT: Letter dated April 7, 1970 to Saunders Apartments , Inc. , 1110 St. Dennis Court from Robert L. Ames , City Architect con- cerning a Certificate of Occupancy for 2040 Saunders Avenue. APPEARANCE5 : Albert D. Levin. PROCEEDINGS : Mr. Erickson read the recommendation of the building inspector who indicated that for practical purposes the front stairway was enclosed but according to the current interpretation of the Building Code it was not� therefore he recommended that the matter be brought before the Board as a formality in order to clear the air. ACTION: Moved by Voigt to grant a variance to Section 13<02-2a & 6a of the Saint Paul Legislative Code concerning enclosure of stair- ways to allow issuance of a Certificate of Occupancy for the property at 2040 Saunders under existing conditions . • Seconded by Tieso. Meeting No. 33 48-70-B 1711 Highland Parkway Stephen L. Pistner SUBJ�CT: Letter dated May 8 , 1970 to Mr. Harvey Bream, 1386 W. Seventh St. from Glenn A, Erickson, Assistant City Architect indicating that a building permit to attach the existing garage to the main residence at 1711 Highland Parkway was denied as it would not then meet the Building Code requirement for rear yard clearance. APPEARANCES : Stephen L. Pistner. Estyr Peake arrived. PROCEEDING5 : Mr. Pistner' s appeal dated May 25 , 1970 was read. It was noted that this appeal was quite similar to the appeal for 1958 Bayard Ave . which was granted at the last meeting of the Board. Mr. Erickson stated that the Building Department had no real strong objections to the proposed addition. ACTION: Moved by Tieso to waive Section 33.04-2 of the Saint Paul Legislative Code concerning minimum rear yard clearance of 25 ' to permit construction of the proposed addition on the property at 1711 Highland Parkway. Seconded by Grove. THE VOTE: Ayes : Cohen, Grove , Peake , Rehnberg, Sommerdorf , Tieso, Voigt. Nayes : none. Abstentions : none. Janssen SUBJECT: Letter dated July l, 1970 to Thomas Anderson, Board of A�pealsF �rom Glenn A.. Eri.ckson, Asst. City Architect. APPEARANCES : Thomas R. Janssen PROCEEDINGS : Mr. Erickson explained the origin of that part of the Building Code which requires that an increase in store size necessitates installation of a sprinkling system. He said he felt that in this case adding coolers to the inside of the store would create no additional threat of fire to warrant installation of costly fire extinguishers . - 5 - , 6/10/70 " � � Meeting No. 33 ACTIGN: Moved by Tieso to waive Section 14 .02-(�of the Saint Paul Legislative Code to permit construction of indoor coolers on the property located at 1218 Thomas Ave . , Janssen' s Super Fair without necessitating installation of an automatic sprinkling system also. Motion carried seven (7) to zero (0) . 49-70-B 141 E. 9th St. Tord L. Bjork SUBJECT: Letter dated April 2 , 1970 to Fernville Apartments , T. L. Bjork , 1330 Edgcumbe Road from Robert L. Ames , City Architect concerning a Certificate of Occupancy for 141 E. Ninth St. APPEARANCES : Tord L. Bjork . PROCEEDINGS : Mr. Erickson explained that the 26 unit apartment � at 141 E. 9th St. contained the following facilities : Basement (one apartment) - one water closet. First floor (12 apartments) - one complete bathroom and two shared toilet rooms , one of which has a water closet and tub and the other which has a water closet and two lavatories . Second floor (13 apartments) - two sleeping rooms , one•toilet room which has two water closets , one lavatory and one shower, an.d two kitchen sinks . A shower and a toilet would be needed to meet rooming house re- quirements . Mr. Bjork said he intended to install another stool , bathtub and shower on the first floor . . . The apartments will remain as single dwelling units with rent ranging from $35-$60 per unit . . . His yearly operating expenses are $4 , 764 . . . Mr. Erickson said it resembled a lodging house more than an apartment house. Mr. Bjork submitted a list of improvements which had been made on the property since he bought it. ACTION: Moved by Tieso to waive Section 54 .11 (1-4) of the Saint Paul Legislative Code pertaininq to basic facilities in dwelling units for the 26 unit apartment building at 141 E. 9th St. on condition that additional facilities be added on the first floor to total six to�let facilities .
