commencing at the southeast corner of Lot 6 of said Greve's Rearrangement, being the point of
beginning; thence South 89 degrees 41 minutes 29 seconds West along the south line of said Lot 6 a
distance of 93.26 feet; thence northeasterly along a non-tangential curve concave to the southeast, chord
beazing North 16 degrees 44 minutes 00 seconds east chord distance 91.19 feet, radius 797.00 feet, delta
angle 06 degrees 33 minutes 32 seconds for an azc distance of 91.24 feet thence north 89 degrees 42
minutes 37 seconds East 57.63 feet to a point on the East line of said Lot 4, Greve's Rearrangement;
thence South 00 degrees 39 minutes 11 seconds East along the east line of said Greve's Rearrangement a
distance of 109.45 feet to the point of beginning.
BE IT FURTAER RESOLVED, that, subject to the herein stated exceprions and with the accompanying Utility
Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest Communications, Incorporated,
Northern States Power Company, District Energy St. Paul, Incorporated, MCI Worldcom, A.T. & T. Broadband,
Saint Paul Regional Water Seroices, and The Deparhnent of Public Works, made a part hereof by this reference
and filed in the o�ce of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations and
departments, waives the right to the utility easements in the vacated area described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the Saint
Paul Legislative Code as amended, and to the following conditions:
34 1. That the petitioner's, their successors and assigns shall pay $2,000.00 as an administrative fee for this
35 vacation which is due and payable within 60 days of the effective date of this resolution.

37 2. That a permanent utility easement shall be retained within the westerly 10 feet of that part of Petit Street
38 lying easterly of Payne Avenue to protect the interest of Northern States Power Company, d.b.a. Xcel
39 Energy.

1 3. That the developer shall be responsible for all costs associated with the removal of the existing street
2 lighting system and tr�c signs within the streets hereby vacated.

4 4. That the developer shall be responsible, to the satisfaction of the Department of Public Works Sewer
5 Engineering Division, for the proper abandonment of the existing sewer in Kenny Road and the
6 relocation of the service to 520 Payne Avenue.

That the developer shall be responsible for the reconstruction, as required to eliminate the appearance of
public thoroughfare, of the east side of Payne Avenue across Kenny Road, Hopkins and Petit Sh�eeu,
including but not limited to costs for new curbs, sidewalks, boulevazds and storm drains, all to the
satisfaction of the Department of Public Works.
6. That the developer shall plat or dedicate new utility easements as required to service the planned
development, as well as any other properties currently served by existing facilities within the streets
hereby vacated.
7. That the release of easements within the streets hereby vacated shall not take effect until new easements
have been created.
8. That the developer shall assume all costs of relocating existing facilities to the new easements.
9. That the developer shall not remove any trees from park or trail property or from Regional Rail Property.
10. Thatthe developer shall provide drainage from the area to be developed sufficientto prevent drainage
onto park or trail property.
11. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless the City
of Saint Paul, its officers and employees from all suits, actions or claims of any character brought as a
result of injuries or damages received or sustained by any person, persons or property on account of this
vacation or petitioners' use of this properry, including but not limited to, a claim brought because of any
act of omission, neglect, or misconduct of said petitioners or because of any claims or liability azising
from any violation of any law or regulation made in accordance with the law, whether by the petitioners
or any of their agents or employees.
12. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution and shall,
within the period(s) specified in the terxns and conditions of this resolution, comply in all respects with
these terms and conditions.

The Department of Public Works has completed a review of the above-referenced vacation
proposal. There is currently street lighting on all the streets to be vacated. There is sewer in
Kenny Rd which serves 520 Payne Ave. (Standazd Spring & Alignment). Both Petit and
Hopkins have a sewer main (stub) to the east property line of Payne which may be useful to the
development. Therefore we have no objections to the vacation subject to the following
conditions:
1. There are changes to the legal description which I have attached.
2. The petitioner shall be responsible for all costs associated with the removal of the existing
street lighting system and traffic signs within the vacated streets.
3. The petitioner shall be responsible for the proper abandonment of the existing sewer in Kenny
Road and the relocation of the service to 520 Payne Avenue, to the sarisfaction of the Deparhnent
of Public Works, Sewer Engineering Division.
4. The petitioner shall be responsible for the reconstruction of the east side of Payne Avenue
across Kenny Road, Hopkins and Petit Streets, which will be necessary to properly eliminate the
appearance of a public thoroughfaze, including but not limited to, costs for new curbs, sidewalks,
boulevazds, and storm drains, all to the satisfaction of the Department of Public Works.

The purpose of this vacation is to accommodate development for multi-family housing.
Will you please advise me of any concerns you may have regarding this proposed vacation. I would
like to receive your comments before May 23, 2003 so I can prepare a report to the City Council on
