Division File Number 05-2003, public properties hereinafter described aze hereby vacated and

'/z', city datum, and lying northeasterly of the northwesterly extension of a line 12' southwesterly
of and pazallel to the southwest line of Lot 12, Williams Addition No. 2, and southwesterly of the
northwesterly extension of the northeast line of the said Lot 12.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
Corporation, Xcel Energy, d.b.a.. Northern States Power Company, District Energy St. Paul, Inc., MCI,
Inc., Comcast, Inc., Saint Paul Regional Water Services, and the Department of Public Works, made a
part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for itself and
on behalf of these corporations and departments, waives the right to the utility easements in the vacated
area described above.

20 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the
21 Saint Paul Legislative Code as amended, and to the following conditions:

23 1. That the petitioner's, their successors and assigns shall pay $$1200 as an administrative fee for
24 this vacation which is due and payable within 60 days of the effective date of this resolution.

26 2. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
27 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
28 brought as a result of injuries or damages received or sustained by any person, persons ar
29 property on account of this vacation or petitioners' use of this property, including but not limited
30 to, a claun brought because of any act of omission, neglect, or misconduct of said petitioners or
31 because of any claims or liability arising from any violation of any law or regulafion made in
32 accordance with the law, whether by the petitioners or any of their agents or employees.

2 3. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
3 resolution, file with the City Clerk an acceptauce in writing of the conditions of this resolution
4 and shall, withiu the period(s) specified in the terms and conditions of this resolution, comply in

The City Clerk has refened to this office for recommendation the petition of Metropolitan State
University for the vacation of:
air rights over that part of East Seventh Street above elevation 834' 11 1/8", cit7 datum,
below elevation 862' 3'/z', city datum, and lying northeasterly ofthe northwesterly extension
of a line 12' southwesterly of and parallel to the southwest line of Lot 12, Williams Addition
No. 2, and southwesterly of the northwesterly extension of the northeast line of the said Lot
12.
The purpose of this vacation is to construct a skyway across East Seventh Street. The skyway will
leave approxunately 18 feet of cleazance above street level.
Will you please advise me of any concems you may have regazding this proposed vacation. I would
like to receive your comments before April 18, 2003 so I can prepaze a report to the City Council on
this matter. For your convenience, you will find a fas transmittal memo containing a reply form on
the reverse side of this notice. If you would rather respond on your letterhead, please refer to the
