Marshall City Clerk Room 386 City Hall �'; ,°"�;� C�g'_ti.i�i Dear Sir: This is written in response to the appeal and application of Lampert Yards, Inc. to 1) relax the 8-foot buffer requirement and Zoning Code requirements to allow commercial parking lot around existing residential structure, and 2) to install a 54-car parking lot to be used in conjunction with the banking and lumber business on property located on the south side of Dayton Avenue between North Snelling Avenue and North Saratoga Street. This property is further described as: Lots 6-10, Block "E", Boulevard Addition. This matter was first heard as a parking permit only on September 17, 1970, at which time the staff presented the history of this site. In 1949, off-street parking was approved by the City Council in the rear of the Commercial uses fronting on Selby Avenue. In 1957, installation and operation of the present drive-in banking facility was approved by Council. At this meeting the staff reported that the plans submitted ' for the proposed parking lot did not meet design standards. This plan proposed using for parking lots currently occupied by residential structures. The staff said a determination from the City Architect indicated this could not be done without placing those residential uses in violation of the density standards of the Zoning Code. The staff also reported that the Traffic Engineer had reviewed but had not approved the plan, and that Public Works does not have the land programmed for acquisition. Mr. Fesler appeared for the applicant, and a neighbor of the property appeared in opposition. Subsequently, the Board laid over the matter until October 1, 1970, so that proper plans could be submitted following the recommendations of the Traffic Engineer. At the October 1, 1970, meeting the staff reported that an appeal to relax the buffer requirements for the parking lot and the standards of the Zoning Code to a11ow the use of the residential property for commercial parking had recently been filed with the City Clerk and was not on the agenda. Therefore, the permit application was laid over to the October 15, 1970, meeting. At the October 15, 1970, meeting, the Zoning Board heard the application for a parking lot permit, and an appeal for a variance to relax the 8-foo� buffer requirement and to allow driveways and parking on residential property. At this meeting, the staff reviewed the site plan with the Board. Mr. G1enn North appeared for the applicant and said that the 5-plex in question was owned by the applicant who intends to demolish the structure in 5-10 years. He also said that the occupants of the 5-plex have not indicated opposition to the proposal and that no children live there. In considering the matter, the Board noted that another house on the site is a single-family residence occupied by the maintenance man for Lampert Yards who has children living there. It was suggested that the 5-plex be torn down now to facilitate the proposed parking 1ot. -1- � '�`b--� �., O � �� Mr. Harry E. Marshall (continued) November 10, 1970 Several persons appeared in opposition. One of these was Mr. Michael Murphy, who noted the traffic problem in the area and claimed that the proposed parking lot would add to the problem rather than detract from it. Subsequently, a motion to recommend denial of the appeal was made and seconded. The motion carried by a vote of 5-0. A motion was then made to recommend approval of the parking lot application subject to its meeting design standards consistent with a denial of the appeal. The motion was seconded and carried by a 5-0 vote. Revised plans meeting the Traffic Engineer's and Zoning Board's recommendations have not been received. Very truly yours, PETER J. 'I'his portion of the property is not being used for any purpose at this time. We need additional off-street parking for tenants in the buildings owned by Lamperts on Selby Avenue including the Liberty Bank Building and Annex and for customers and invitees of said tenants. ZONING ADMINISTRATOR: The Zoning Administrator, on 9/11/70, determined that the 5-unit use on Lot 9 is a legal use and that the use of a portion of. this parcel for commercial parking purposes reduces the area remaining for residential use, resulting in an infraction of the density requirements of the Zoning Code. A similar situation exists on Lot 6. The Zoning Administrator has been requested to determine if the use of this property, as proposed, for commercial parking purposes may be granted by means of this appeal. B. HISTORY: In 1949 off-street parking was approved by City Council in the rear of ttie Gnmmercial uses fronting on Selby Avenue. In 1957 an application ta install and operate the present drive-in bank facility was approved by Council. A related application for a permit to install an off-atreet parking facility is also pending before the City. C. PROPOSAL: The appellant proposes to install a 103-car parking lot on these properties and on those adjoining on the south. The parking lot proposal, as amended, would use the rear and side yards of the residential uses on Lots 6 and 9, and would not provide the required 8-foot buffer adjoining these residential properties. D. PRESENT STANDARD: The Zoning Code requires an 8-foot buffer wherever a parking lot adjoins property used or zoned residentially. See also action of the Zoning Administrator above. E. AREA ZONING: Most properties fronting on Selby Avenue in this area are zoned Coc�►ercial. Snelling Avenue frontages are zoned "C" Residence, Commercial, and Light Industry. The remainder of the surrounding area includes "A", "B", and "C" Resicicnce, and I.i�ht Industry 2oning. F. SITE CONDITIONS: Tlie lots fronting on Dayton Avenue are occupied by tt►e drive-in bank facility and a 5-plex in fair condition. In 1957 an application to install and operate the present drive-in bank facility was approved by Council. B. AREA ZONING: Most properties fronting on Selby Avenue in this area are zoned Commercial. Snelling Avenue frontages are zoned "C" Residence, Commercial, and Light Industry. The remainder nf the surrounding area includes "A", "B", and "C" Residence, and Light Industry zoning. C. DESIGN STANDARDS: Submitted plans do not meet required design standards. They also indicate use of part of lots currently occupied by residential structures. A determination from the City Architect indicates this cannot be done without placing those residential uses in violation of the density standards of the Zoning Code. Revised plans are being requested which will meet required design standards, the recommendations of the staff and Traffic Engineer, and shall be in conformance with the City Architect's zoning interpretation. D. FRONTAGE AND AREA: The property covered by the legal description submitted with this application has a frontage of 200 feet on Dayton Avenue resulting in an area of 23,832 square feet. The area encompassed by this entire proposed parking lot and indicated on submitted plans, however, has total frontages of 280 feet on Dayton Avenue and 340 feet on Selby Avenue. The resulting area likewise is increased. E. TRAFFIC ENGINEER: The Traffic Engineer has not approved the submitted plan. He suggests a new layout and indicated that the applicant should close one curb cut onto Selby Avenue. F. SITE CONDITIONS: The lots fronting on Dayton Avenue are occupied by the drive-in bank facility and a 5-plex in fair condition. Structures have been removed from the remaining lots and have been rough graded. Lots fronting on Selby Avenue are occupied by structures containing Commercial uses with some reside.ntial uses on the second floora. Parking currently exists in the rear of these buildings. G.
