1 WHEREAS, Minn. Stat. § 462353, Subd.4 provides authority for the city to set various
2 fees to defray costs incurred in administering official controls established pursuant to Minn. Stat.
3 §§ 462351-364: and

5 WHEREAS, such fees were previously set in Council File No. 94-1609; and
7 WHEREAS, depending on the type of official control application and whether action on
8 the official control application is reviewed by the Board of Zoning Appeals, the Planning
9 Commission, the Zoning Administrator, the Planning Administrator or the City Council,
10 application fees are paid to either the Office of License, Inspections and Environmental
11 Protection or the Department of Planning and Economic Development, and

WHEREAS, it is estimated that only twenty-five percent of the various costs associated
with reviewing, investigating and administering an official controls application are recovered
through the various fees charged for such applications; and
WHEREAS, the office of the Mayor has approved a 2003 budget for the office of
License, Inspections and Environmental Protecrion and Planning and Economic Development
which provides for an increase in such fees in an amount not to exceed twenty-five percent of the
sum established in Council File No. 94-16�9; and
WHEREAS, pursuant to I,egislative Code Chapter 68 pertaining to the regulation of
wetlands within the city pursuant to 1991 Minn. Laws Chap. 354, which was adopted as an
official control under Minn. Stat. § 462352, Subd. 15, staff of the Office of License, Inspections
and Environmentai Protection presently undertake field evaluafions and render technical written
determinations relative to the provisions of Chapter 68 without costs; and
WHEREAS, the expense incurred in reviewing and investigating compliance with the
regulations under Legislative Code Chapter 68 should also be recovered through fees; Now
THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul does
hereby amend the various fees set forth in C.F. #94-1609 by deleting each of them in their
entirety and establishing in the following schedule of fees which shall be paid upon application
for action and which shall become effective immediately as of the adoption and approval of the
amending resolution:

There is an additional fee of $195 to the appropriate rezoning fee set forth in section 6 of
this resolution for any pernut or variance application to the Planning Commission for
land which also requires rezoning when submitted for consideration by the Plaiming
Commission at the same time as the rezoning.
16. LATE FEE
For any applicarion made for any development commenced without first obtaining all
required permits and approvals, the appropriate fees established in this resolution shall be
doubled, to a masimuxn additional sum of $275, to offset costs associated with
investigating, processing and reviewing applications for such development undertaken
without first having obtained all required permits and approvals.
17. REFUNDS
For a zoning case withdrawn before final approval, the Zoning or Planning Administrator
may refund part of the fee based upon the proportion of the work completed at the time of
withdrawal.
18. LARGE SITES
For large sites where only a portion of the site is affected by the zoning action, the Zoning
or Planning Administrator may set the fee based on the size of the affected portion of the
site.
