You will find we have executed the statement as pmposed. Thaz�k you for your prompt assistance in this matter. Schnitker Bob Bierscheid b3 - 799 Whereas, the Hamm's Club, Inc. has proposed to have built and installed in Como Pazk a Hamm's Bear Monument; and Whereas, the City wishes to accept the monument but also wishes to insure that there aze no liabilities associated with its construction and installation; now, therefore, Hamm's Club agrees as follows: To the fullest extent pernutted by law, Hamm's Club, Inc. shall, and hereby does, indemnify, save, hold harmless, and defend the City (and its officials, employees, representatives and agents) from and against all claims, costs, (including reasonable attomeys' fees) liabilities, losses or damages actually suffered or incurred by the City (and its officials, employees, representatives and agents) arising from or as a result of any claims relating to the use of the trademazk(s) associated with the Hamm's Bear Monument. Additionally, Humn's Club, Inc. , ab ees to defend, indemnify and hold the City hazmless from any and all damages it may be required to pay as a result of suits, claims, demands, costs and expenses asserted by any person or persons by reason of personal injury or property damage which arise out of the construction or installation of the monument, except to the extent any such injury or damage is caused by any negligent act or omission of the City, its officers, or employees. To that end, Hamm's Club, Inc. will insure that the contractors perfornung any work in connection with the construction and installation have the appropriate liability insurance coverage to give effect to this indemnification. Hamm's Brewery Show on September 14`" at the Brewery grounds. Also as we discussed we have worked to have a monument erected in a City Park commemorating the Hamm's Bears 50 Birthday. While our fundraising efforts have hit a snag and been delayed we have no doubt that the monument will become a reality. As per my August 6 letter we need to ascertain the Park where the monument wil! be erected. We plan to at the show on the 14 (which is in conjunction with the St. Paul Eastside Harvest Festival) unveil the artists rendering of the monument and to do so in the Park where the monument will be erected. From my prior discussions with your office it was our understanding that the selection of a site wouid not be a problem. Because the 14 of September is fast approaching and because we need to get out appropriate invitations and notices we need to determine the selected site as soon as possible. In this regard we appreciate the assistance your office has provided. We intend to follow through on our end with a monument commemorating the Hamm's Bear and Hamm's, a company that has its roots deep in St. Paul. We are doing so at no cost to the City and only ask for an appropriate site ta erect this monument.
