The public hearing on the above numbered file, which is an
assessment hearing for grading and surfacin� with bituminous material
on North Park Drive has been noticed for October 28, 1970.
I represent Mr. James A. Morin, 1823 Upper Afton Road, who I
believe has a substantial objection to the reasonableness of the
proposed assessment against his property. While there are other prop-
erties affected, it would be unreasonable to request� a continuance of
the hearing simply because of my not being available on that date.
I would request that the Council not take action at the time of the
hearing on October 28th, but continue the matter so as to give me an
opportunity to make a presentation on behalf of Mr. Morin before
final disposition is made. I am the chairman of a three man arbitration
panel involving the taking of a privately owned sewer and water system
in Eagan Township, Dakota County, which is meeting on October 28th and
October 29th, and request permission to be heard on October 30th relative
to the particular application of the assessment to Mr. Morin's property.
Briefly, to establish the fact that there is an equity in
Mr. Morin's position, I would point out that his property extends from
Upper Afton Road to North Park Drive, and that he has already paid an
assessment of $2500.00 on Upper Afton Road, as well as some $3800.00
to hook up to the city sewer and water from Upper Afton Road, and that
the improvements on North Park Drive have no benefit or improvement
to his property.
Please advise as to whether or not I may be permitted to make
� a presentation on Mr. Morin's behalf on October 30th� as otherwise I
must recommend to him that he retain other counsel to appear for him
on October 28th.
