PAUL �°N�� NO. , OFFICE OF THE CITY CLERK y OUNCIL RESOLUT N-GENERAL FORM PRESENTED BY COMMISSIONE pTE WHEREAS, on October 8, 1968, Glenn Crosby, a Police Sergeant in the employ of the Department of Public Safety of the City of Saint Paul , suffered severe and painful injuries from an explosion of smokeless powder at the Public Safety garage, and thereafter did pursue his legal remedies against the manufacturer, packer, distributor, and carrier of the smokeless powder through the Law Firm of Murnane, Murnane, Battis, deLambert, and Conlin; and WHEREAS, by Resolution, Council File No. 245099, approved August 1, lg6g, a copy of which is attached, the City of Saint Paul did engage the firm of Murnane, Murnane, Battis, deLambert and Conlin to represent its subrogation interest in Worl�nen' s Compensation and wage benefi�s connected with thesuit; and WHEREAS, a settlement was negotiated between Glenn Crosby and the manufacturer, packer, distributor, and carrier of the smokeless powder whereby said Glenn Crosby would accept a total of �30,000.00 in payment for the injuries and damages he sufYered from the explosion on coridition that the City of Saint Paul would waive a portion of its subrogation interest, and it was agreeable to the City of Saint Paul to do so, thus furtherirg the settlement and disposal of the action; now, therefore, be it RESOLVED, that the City of Saint Paul releases and relinquishes its interest, claim, or share in the total amount of Workmen' s Compensation and wage benefits to the extent of �3,735'. 35, leaving a gross balance due it in the amount of �5,000.00; and be it FUR,THER RESOLVED, that from the gross amount of �5,000.00 be deducted the City' s share of the costs of the recovery in the amount of �147.74 and the attorneys' fees prescribed by Minnesota Statutes, Section 176.061, Subd. 6 and agreed to under Resolution, Council File No. 245099, approved August 1, 1g69, in the amount of �1,250.00, leaving a net balance of �3,602. 26 as payment in complete satisfaction of any interest, claim, or share the City of Saint Paul has in the cause of action; and be it COUNCILMEN Adopted by the Council 19_ Yeas Naya Butler Carlson Approved 19— Levine _�n Favor Meredith Sprafka Mayor Tedesco A 8'ainst Mr. President, McCarty �� OR16t#(AL TO CITY CLCRK q r , CITY OF ST.
