1 RESOLUTION REQUESTING ESTABLISHMENT OF RAILROAD GRADE CROSSING ON FILLMORE
2 AVENUE 425 FEET EAST OF WABASHA STREET

4 WHEREAS, Opus Northwest, L.L.C. is developing the US Bank property on the West Side Flats
5 development site; and
6
7 WHEREAS, the Environmental Assessment Worksheet for the Opus development requires that a
8 railroad grade crossing be established on Fillmore Avenue where Fiilmore Avenue crosses the
9 Union Pacific Railroad track 425' east of Wabasha.Street to mitigate traffic impacts resulting from the
10 US Bank development and future develapment of the West Side Fiats; and
11 - .
12 WHEREAS, the Development Agreeme�t between the St. Paul Housing and Redevelopment
13 Authority (NRA) and Opus Northwest, L.L.C. requires that the HRA complete the establishment of the
14 Fillmore Avenue railroad grade crossing by the end of 2003; and
15
16 WHEREAS, the HRA has offered to fund 3he construction necessary to complete the establishment of
17 the crossing including warning signals, gate arms, circuitry and crossing surface materials; and
18
19 WHEREAS, the Union Pacific Railroad has not agreed to the establishment of the crossing; and
20
21 WHEREAS, under Minnesota Rule 8830.2700, the City can file a petition with the Commissioner of
22 Transportation for a determination on establishment of the proposed Fillmore Avenue railroad grade
23 crossing; now, therefore be it

25 RESOLVED, that St. Paul City Council hereby authorizes the Director of Public Works to file a petition
26 for establishment of a railroad grade crossing on Fillmore Avenue.
