WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of
noise in the City of Saint Paul; and

5 WHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in
6 §293,09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
9 WHEREAS, Macalester College, represented by Taza Stormoen, Assistant Director of Campus
10 Programs/Advisor to Program Boazd, who has been designated as the responsible person on the applicarion, has
11 applied for a variance to allow amplified music at 1600 Grand Avenue, on September 19, 2003; and

13 WHEREAS, applicant is seeking a variance for the hours of 430 p.m. to 8:30 p.m. on September 19, 2003;
14 and
15
16 WHEREAS, if applicant is not granted a variance it will not be able to present amplified sound for their
17 annual "FallfesY'; and

WHEREAS, the Office of License, Inspections, and Environmental Protection has reviewed the application
and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Macalester College,
subject to the following conditions:

The variance shall be for the hours of 4:30 p.m. to 8:30 p.m. on September 19, 2003.
All electronically powered equipment used in conjunction with the event shall not
exceed 95 dBA as measured from the closer of 50 feet or the sound mix.

3) The applicant shall provide personnel and equipment who shall provide continuous
sound level monitoring between 4:30 pm. and 8:30 pm. on the date to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA systems, loudspeakers or similar devices
shail be turned off no later than 8:30 p.m. on the date.

Amplified Outdoor Music, Macalester College Quad
Attached is a sound level variance application from Tara Stortnoen, representing
Macalester College Program Boazd, 1600 Grand Ave., St. Paul, NIN 55105, to allow
amplified outdoor music, on the Old Main/Campus Center/Chapel Quad (SW comer of
Grand & Snelling). A variance is requested from 4:30 pm to 8:30 pm on September 19,
2003 during their annual Fall Fest.
Enclosed is the copy of the Public Hearing Notice sent to property owners within 200 feet
of 1600 Grand Avenue.
Please have this item placed on the Council agenda for August 27, 2003. If you have any
