City Clerk Room 386 City Hall Dear Sir: This is written in response to the petition of Melvin and Marie Yatckoske to rezone from "B" to "C'� Residence to continue using the structure as a 3-unit apartment house, property located on the southwest corner of Burr Street and Jenks Avenue. This property is further described as: Lot 7, Block 13, Fairview Addition. This matter was heard at the November 5, 1970, Board of Zoning meeting. The staff report was not requested; it was noted that no one representing the petition was present. In moving for denial of the petition it was stated that the lot is too small for a 3-unit building, or even for a duplex. The motion was seconded and carried by a 4-0 vote. SUFFICIENCY: In a letter dated 9/23/70, the Commiesioner of Finance declared the petition aufficient wlth 12 of a possible 24 (85.7%) owners within 100 feet having aigned the petition. B. HISTORY: The building was conetructed in 1889 as a duplex. Building permits do not indicate authorized conversion to a three-plex. C. PROPOSED USE: Continue the existing uae as a three-plex. D. FRONTAGE AND AREA: The property has a frontage of 122 feet along Jenks Avenue and 30.29 feet along Burr Street, with an area of 3,695.38 square feet. E. AREA ZONING: The surrounding ar4a ie zoned "B" Residence. The closest "C" Reaidence is one lot one block south of the subject site. F. COMPREHENSIVL PLAN: Calls for r�sidential use including single-family, duplex, town and row housea at a maximum density of 15 dwellinga per acre. G. SITE CONDITIONS: The site is occupied by an old two-story houae which appears to have been constructed as a duplex. The exterior of the structure is finished with asphalt shingles. Side yards ere virtually non-existent--at most, one foot. The property is approximately at street grede and a two-cer garage fronts on the alley. H. AREA CONDITIONS: The streets in the area have been surfaced and new curbs and gutters _ installed. The area i� developed with older residences in fair to good condition.
