Dear Sir:
This is written in response to the appeal of W. J. Ebertz
to relax the 1ot area for a duplex in an "A" Residence District
on property located on the north side of Ross Avenue between
Hazelwood and Germain Streets, and noted in detail by the legal
description on file.
This matter was considered at the May 7, 1970, Board of
Zoning meeting. The staff reported that the site consists of
three platted lots which the appellant wishes to develop with
two duplexes. The Zoning Code requires for a duplex in an "A"
Residence District a frontage of 60 feet and an area of 7,500
square feet. The three lots, when divided as proposed, meet
the frontage requirement but have only 7,320 square feet�his
area represents a deficiency of 180 square feet for each site
or a variance of 2.4 percent. The staff noted that the site
is presently vacant and located in an area occupied primarily
with single-family residences although two new duplexes are
located across Ross Avenue to the south. Staff conclusions
noted that although the requested variance is small, no hard-
ship has been claimed or is in evidence which would preclude
compliance with the Code. The Code would allow development of
this site with three single-family residences. The staff also
noted that two duplexes would be permitted without appeal with
the acquisition of an additional 1.5 feet of frontage per duplex.
� It was noted by a Board member that the site topography is
uneven and that the lots would be difficult to build homes on.
Subsequently, it was the finding of the Board of Zoning,
by a 4-1 vote, to recommend approval of this appeal to relax
the lot area requirements. r-^--�

I have three fbrty-foot lots on the north side of Ross St. between
Hazelwood and Germain. t,he legal description is:
Lots 18, 19, and 20, Block 5 in Denslows Rearrangement of lots

I wish to use these three 40 fbot lots for two duplexes. 1n surveying
this property we have discoverd a txiree foot shortage in depth� or
60'x122�� wich is 180 feat short of the 7500 f'oot Minimum size.
We plan to build a tuck-under garage to leave as much yard area as
possible.
Considering there are new duplexes across the street f'rom these lots�
and the frontage is correct� I respectt'ully request a variance as to
lot size.

A. ZONING ADMINISTRATOR: No Action.
B. HISTORY: None.
C. PROPOSED USE: Divide three platted lots into two sites and construct a
duplex on each.
D. NEED FOR APPEAL: Dividing the lots as proposed each site would have
insufficient area to construct a duplex.
E. PRESENT STANDARD: The required lot size for a duplex in an "A" Residence
District is a 60-foot frontage and 7,500 square feet in area.
F. VARIANCE: The three lots have a frontage of 40 feet with a depth of 122
feet each. When divided as proposed, each site will have a 60-foot
frontage and an area of 7,320 square feet. Each site will have the
required frontage but will be short 180 square feet or 2.4% in area.
G. AREA ZONING: The frontage along East Seventh Street is zoned Commercial
and the rest of the area is zoned "A" Residence.
H. SITE CONDITIONS: The site is vacant and slightly above street grade along
Ross Avenue. It slopes up to the rea� rising approximately 5 feet.
I. AREA CONDITIONS: Ross Avenue is graded and paved and has bituminous curbs.
T'he lot to the west is occupied by a single-family residence which is
approximately 10 feet above the grade of Ross Avenue. Most of the develop-
ment in the area is single-family residences including the East Seventh
Street Commercial-zoned properties. Ttao new duplexes are located on the
south side of Ross Avenue opposite thia site.
