2 WHEREAS, a parcel of land idenrified as the Lowex Phalen Creek properiy was acquired by the City of Saint Paul from the
3 Burlington \orthern Santa Fe (BNSF) Railroad accordin� to the terms authorized under CF 02-1059; and

5 ��JI-IEREAS. per the terms of the purchase a,�'eement the BNSF Railroad has provided to the City a payment m the amount of
6 $25Q000: and

8 WHEREAS, this payment is required to used towazds the remediarion of said parcel; and

10 WHERLAS, the City of Saint Paul, Pazks and Recrearion desues to establish a pro�ect in the 2003 Capitai Impiovement
11 Budget to receive and expend said payment; and

13 NOW THEREFORE BE IT RESOLVED, by the Council of the City of Saint Paul, upon the iecommendation of the
14 Mayor, and the positive advice of the Long Range Capital Improvement Budget Committee, that �250,000 is ava�lable for
15 appropriation in the 2003 Capital Improvement Budget, and said 2003 budget, as l�eretofore adopted and amended by
16 CouncIl, is hereby further amended as follows:
