WHEREAS, First Fed r,al Savings and Loan Association of Saint
Paul , 360 Cedar, has ind cated to the Department of Public Works
of the City of Saint Paul that they are desirous of installing or
having installed a new electrically heated sidewalk in connection
with the building of their new building at the above address; now,
therefore, be it
RESOLVED, That pursuant to the provisions of �gapter 207 and
208 of the Saint Paul Legislative Code, the Commissioner of Public
Works is authorized to issue to said First Federal Savings and
Loan Association of Saint Paul or to a licensed and bonded side-
walk contractor acting as agent for First Federal Savings and Loan
Association of Saint Paul a permit to install a sidewalk along the
property 1e ally described as Lots 3 and 4, Block 19, City of
Saint Paul �Saint Paul proper) and the Northerly 125 feet of Lots
5 and 6, Block 19, City of St. Paul (St. Paul Proper) and to in-
corporate in said sidewalk electrical heating units for snow
removal purposes; and, be it

FURTHER RESOLVED, That such permit and the permission hereby
granted for such installation shall be subject to the followin.g
conditions, provisions, and terms :
l . That said permittee, First Federal Savi�gs and
Loan Association of Saint Paul shall forthwith furnish
and deliver to the City of Saint Paul a surety bond in
the penal sum of �1 ,000.00, made and executed by said
permittee as principal and a corporate surety company
duly authorized to transact business in the State of
Minnesota, as surety to and in favor of the City of
Saint Paul as obligee , conditioned that said permittee
shall indemnify and hold harmless said City of Saint
Paul against all expense and liability on account of
all claims, suits and judgments arising out of or con-
nected with the construction, erection, maintenance and�
or operation by said permittee and�or any successor in
interest of the aforementioned sidewalk electrical units,

which surety bond shall be in such form as shall be
approved by the Corporation Counsel .
2 . That said permittee shall , at its own cost
and expense and in accordance with all applicable
ordinances of the City of Saint Paul and statutes of
the State of Minnesota construct , erect , maintain and
operate said sidewalk installation.
3. That said permittee shall notify the Construc-
tion Engineer of the Department of Public Works when
the construction starts and notify the same said
Construction Engineer when project has been completed
to allow for a final inspection.
4. That said permittee shall furnish the Department
of Public Works all documents of record that are a part
�� of the Contract or incidental to its execution including
but not limited to addendums , award of contract , sum of
contract , "as built" plans and tracings .
5 . That said sidewalk construction and installation
shall be in conformance with plans heretofore submitted
by said permittee to the Department of Public Works and
shall be subject to approval of the Chief Engineer of the
City of Saint Paul .
6. That said permittee and its successors and
assigns shall �ully indemnify the City of Saint Paul
against all liability on account of all claims , causes
of action, suits and judgments on account of injury to
person and�or property arising from or connected with
the construction, erection, maintenance , operation and�
or removal of said sidewalk and said electrical heating
units installation.
7. That supplemental to all other obligations on
its part , said permittee and its successors and assigns
shall furnish and maintain and pay all premiums and
other expenses for public liability insurance coverage
by an insurance company duly licensed by the Commissioner
of Insurance of the State of Minnesota in an amount of
�250 ,000 against liability for injury to any one person
and �500 ,000 for personal injuries in any one accident ,
and against liability for injury to property in an amount
of �50 ,000 for any one accident , and in the said amounts
and for the said purposes respectively indemnifying said

permittee, its successors and assigns, and the City of
Saint Paul against liability on account of all claims
of third persons for injury to person and�or property
arising from or connected with the construction, erec-
tion, operation, maintenance and�or removal of said
sidewalk and underlying electrical heating units, and
shall furnish competent evidence of said coverage from
time to time to the Comptroller of the City of Saint
Paul.
8. That said permittee shall within the period of
15 days next after the effective date of this resolution,
file with the City Clerk its written acceptance of the
terms, provisions and conditions of this resolution and
its agreement to be bound by said terms, provisions and
�� conditions thereof, without limitation, which written
instrument of acceptance and agreement shall be in form
approved by the Corporation Counsel .
9. The Council reserves the right �o order by
resolution, the removal of the electrical heating units
from the public way and in the event the Council exercises
such right, the permittee shall at his own expense remove
the said heating units and restore the public way to its
_ original condition.
10. That said permittee shall pay the cost of
administration, engineering and inspection of said work,
and for the publication of this resolution, said costs
to be accounted for under Department of Public Works
project number M-0520.
