2 WHEREAS, on November 27, 2002, in Council File No. 02-1116, the Council of the
3 City of Saint Paul duly adopted a resolution approving a moratorium of limited duration for the
4 purpose of studying land uses in the Sunray area; and
6 WHEREAS, on December 26, 2002, in Council File No. 02-1ll5, the Council of the City
7 of Saint Paul, in compliance with the City Charter, also duly adopted a finalized interim
8 ordinance establishing the proposed study of land uses in the Sunray area:

WF�REAS, the Council desires to amend Council File No. 02-1ll5 to the extent
necessary to enable the Scot I,ewis Scool of Cosmetology to undertake a development at 1905
Suburban Avenue, St. Paul, MN 55ll9, and to move forward with their various zoning and
building applications that would otherwise be prohibited under the terms and conditions set forth
in Council File No. 02-1 ll5; NOW, THEREFORE,

BE TT RESOLVF_D, that pending the amendment of the interim ordinance in Council File
No. 02-1115 its provisions shall not prevent Scot L.ewis School of Cosmetology from appiying
for and, if approved, receiving any zoning or building pernuts necessary to undertake the
construction of their proposed development at 1405 Suburban Avenue; AND
BB 1T FINAI.LY RESOLVED, that in the event Councii Fi1e No. 02-1115 is not
amended to provide Scot I.ewis Schoo] of Cosmetology with the means necessary to obtain the
appropriate approvals and permits, that Scot L.ewis School of Cosmetology acknowledges that
the School proceeds with its affairs at its own risk.
