BE IT RESOLVED, that, upon the petition of the Hiway Federai Credit Union, as documented in Real
Estate Division File Number 2002-28, public properties hereinafter described are hereby vacated and
discontinued as public property: The property to be vacated is described as:
See Attached Exhibit "A"
This vacaUon shall be subject to the terms and condition of Chapter 13Q codified March 1, 1981, of the
Saint Paul L.egislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $1,200.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shali be retained protect the interest of Xcel Energy Gas
Distribution for existing facilities in the vacated area.
That a permanent utility easement shall be retained to protect the interest of Qwest
Communications for existing facilities in the vacated uea.
That a permanent utility easement sha11 be retained to protect the interest of A.T.&T. Broadband
for existing facilities in the vacated area.
That a permanent utility easement shall be retained to protect the interest of MCIWOLRDCOM,
Incorporated for existing facilities in the vacated area.
6. At the direction of the City of Saint Paul, Department of Public Works, Traffic Division, that
access from Rice Street to the vacated area will be right-turn only and access to Rice Street from
the vacated azea will be right-tum only.
7. That a permanent utility easement shall be retained within the vacated area to protect the interest
of Saint Paul Regional Water Services for existing facilities in the vacated azea subject to the
conditions outlined in Exlvbit "B".

3 8. That the petifioners, their successors and assigns agree to indemnify, defend and save hannless
4 the Ciry of Saint Paul, its ofFcers and employees from all suits, actions or claims of any chazacter
5 brought as a result of injuries or damages received or sustained by any person, persons or
6 properry on account of this vacation or petitioners' use of this property, including but not limited
7 to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
8 because of any claims or liability arising from any violation of any law or regulation made in
9 accordance with the law, whether by the peUtioners or any of their agents or employees.

Standard Easement Provisions
Board of Water Commissioners
Revisio� date: February 8, 2002
That a permanent utiliry easement shall be retained on, over, under and across the vacated uea
on behalf of the Boazd of Water Commissioners of the City of Saint Paul to reserve the right of
the Board to maintain and operate any water facility in or upon said easement and to enter upon
said easement, or any portion thereof, at any time and from time to time, for the purposes of
future construction, reconshuction, inspection, maintenance or repair of the same, or any part
thereo£ Said utility easement shall be subject to the following requirements:
a. No buildings, structures, trees or any temporary structure, material storage, fixture,
or any other objects which may prohibit normal access to water facilities for
maintenance purposes will be pernutted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the Boazd
from exercising its reserved rights may be allowed by obtaining written permission
from Saint Paul Regional Water Services with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the Board exercises its reserved easement rights.
a Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Saint Paul Regional Water Services operations, all removal,
replacement or modification costs shall be borne solely by the petitioner.
d. No change from the existing grade within the easement area shall be pernutted
without written permission from Saint Paul Regional Water Services.
e. No change in surfacing within the easement area shall be pernutted without written
pernussion from Saint Paul Regional Water Services.
f. The petitioner, its successors and assigns shall fixlly indemnify, defend, and save
harmless the Board of Water Commissioners of the City of Saint Paul, its officers,
agents, employees, and servants from all suits, actions or claims which sha11 arise
from any injuries or damages received or sustained by any break in any service pipe,
water main, or connection in said reserved easement, azising out of or resulting from
any action or negligence of the petitioner, its employees, agents or, business invitees.

7he undersigned, Jackie Carlson, as Vice President of the Real Estate Department for

1. Le�al Description of Propertv to be Vacated. Petitioner requests that the
City vacate its interest in the following described property:
All that part of Arch Street which lies easterfy of the
southerly extension of the west line of Lot 1, Block 2,
Fletcher's Subdivision of Brewster's Addition to the City
of Saint Paul; which lies southerly of the south fine of
Lot 1, Biock 2, Fletcher's Subdivision of Brewster's

City of Saint Paul; and which lies northerly of the north

report for Petitioner's property is attached. Please note that Parcel "D" was
recently acquired by the Petitioner. As of the date of the preparation of the
ownership and encumbrance report, the title to Parcei "D" had not yet
transferred to the Petitioner. The purchase of Parcel "D" was completed and
recorded on or about July 30, 2002.
Reason for Vacation. Petitioner intends to use the vacated area for a parking
surface and for ingress and egress from Rice Street to existing parking areas.
Site Plans for Proposed Construction. There are no building construction
plans at this point in time.
