Dear Mr. Marshall:
This is written in response to the application of James L. Rutzick for a permit
to install a 124-car parking lot to be used in conjunction with apartment buildings
on property located on the north side of East Arlington Avenue between Westminster
and Arkwright Streets . This property is further described as:
Lots 8-31, and vacated alley accruing
thereto, Block 8, Morton's Addition.
This matter was considered at the February 5, 1970, Board of Zoning meeting.
The staff report noted that the property was rezoned to "C" Residence in April,
1969. Submitted plans propose parking for 124 cars accessory to two 41-unit
apartment buildings. The applicant, however, indicates that he plans a third
42-unit structure on the site in the future. Submitted plans, it was noted, can
meet minimum standards with minor changes. The Traffic Engineer has approved the
plans subject to driveway changes. The site, consisting of 129,000 square feet,
is vacant and generally below the grade of surrounding streets. The surrounding
area is largely vacant with an elevated railway right-of-way to the northwest and
new low-density residential development to the north and east.
Staff conclusions noted that although the applicant's plans can meet minimum
design standards with minor changes, the site is of sufficient size and adequate
shape to lend itself to a number of different, more desirable layouts. The setbacks
are very minimal and meet the setback requirement only because of multiple frontages.
The staff feels this site should be developed with more than 1-1 parking and with
adequate green space. Alternate layouts with these features have been suggested
to the applicant.
The staff also noted that this area has been under study by the Planning Board
and the area community organization. The Board has received the staff study calling
for Commercial use of this site with portions of the property being used for street
and parkway right-of-way.
Mr. John Daubney, attorney for the applicant, showed revised plans for the site.
He noted that the Traffic Engineer's recommendations have been incorporated into the
new plans but that staff recommendations on such things as aesthetics, parking,
landscaping, and barriers should not be considered.

Mr. Robert Ferderer, president of the Phalen Area Community Council and resident �
of the area, asked the Board to recognize the residen�ial character of the community
and the community's concern about the criteria being �sed in the development of their
area.

After some discussion, it was the finding of the Board of Zoning that the
special-use permit should be granted because the requirements are met, the land
needs development, and it would remove cars from the street and into a parking
lot. The Board, therefore, recommends approval of this application by a 5-0 vote.

A. HISTORY: This property was rezoned from "A" to "C" Residence on April 3, 1969.
B. AREA ZONING: All adjacent lands are zoned "A" Residence. To the west and northwest
across Westminster St. property is zoned "C-1" and "C" Residence, and Light Industry.
C. DESIGN STANDARDS: Corrected plans dated Received February 23, 1970, indicate parking
for 128 cars and two 41-unit buildings. The applicant, however, has indicated that he plans
an additional apartment building on the site. The parking area meets minimum design standards .
Revised layouts have been suggested to the applicant which would improve traffic movements,
aesthetic considerations, and parking ratio.
D. AREA AND FRONTAGE: The site has frontages of 269.24 feet along Arkwright Street and
479.2 feet along Arlington Avenue. The area is 129,052 square feet.
E. TRAFFIC ENGINEER: The plans have been reviewed by the Traffic Engineer who recocmnends
approval if driveways are made 26 feet wide. He also notes that fewer driveways to Arlington
Ave. would be preferable. These features are noted on the corrected plans.
F. SITE CONDITIONS: The site is vacant. A ridge runs from the northwest of the site to
the southeast. The ridge is slightly higher than the grades of the adjoining streets . The
northeast and southwest portions of the site are slightly lower than the street grades � ridge.
G. AREA CONDITIONS: To the west exists an elevated railway right-of-way and depressed
freeway. To the north and south vacant land and to the east vacant land and newer single-family
residences. Several new duplexes are about a block away to the east on Arlington Avenue.

There will be 84 living units. The applicant hopes to put up another building.
