PAUL, MINNESOTA 55101 • PHONE: 223-4151 March 11, 1970 Mr. Harry E. Marshall City Clerk Room 386 City Hall Dear Mr. Marshall: This is written in response to the application of James L. Rutzick for a permit to install a 124-car parking lot to be used in conjunction with apartment buildings on property located on the north side of East Arlington Avenue between Westminster and Arkwright Streets . This property is further described as: Lots 8-31, and vacated alley accruing thereto, Block 8, Morton's Addition. This matter was considered at the February 5, 1970, Board of Zoning meeting. The staff report noted that the property was rezoned to "C" Residence in April, 1969. Submitted plans propose parking for 124 cars accessory to two 41-unit apartment buildings. The applicant, however, indicates that he plans a third 42-unit structure on the site in the future. Submitted plans, it was noted, can meet minimum standards with minor changes. The Traffic Engineer has approved the plans subject to driveway changes. The site, consisting of 129,000 square feet, is vacant and generally below the grade of surrounding streets. The surrounding area is largely vacant with an elevated railway right-of-way to the northwest and new low-density residential development to the north and east. Staff conclusions noted that although the applicant's plans can meet minimum design standards with minor changes, the site is of sufficient size and adequate shape to lend itself to a number of different, more desirable layouts. The setbacks are very minimal and meet the setback requirement only because of multiple frontages. The staff feels this site should be developed with more than 1-1 parking and with adequate green space. Alternate layouts with these features have been suggested to the applicant. The staff also noted that this area has been under study by the Planning Board and the area community organization. The Board has received the staff study calling for Commercial use of this site with portions of the property being used for street and parkway right-of-way. Mr. John Daubney, attorney for the applicant, showed revised plans for the site. He noted that the Traffic Engineer's recommendations have been incorporated into the new plans but that staff recommendations on such things as aesthetics, parking, landscaping, and barriers should not be considered. -1- " 3; 1' ' ti 'r. ' Mr. Harry E. Marshall March 11, 1970 Mr. Robert Ferderer, president of the Phalen Area Community Council and resident of the area, asked the Board to recognize the residenial character of the community and the community's concern about the criteria being sed in the development of their area. I After some discussion, it was the finding of the Board of Zoning that the special-use permit should be granted because the requirements are met, the land needs development, and it would remove cars from the street and into a parking lot. The Board, therefore, recommends approval of this application by a 5-0 vote. Very ly yours, "i`' _ - ` , G;t,7 PTERJ. JAMES L, RL'TZICK: An application for a germit to install a 124-car parking lot to be used in conunction with apartment buildings on property located on the north side of Eas Arlington Avenue between Westminster and Arkwright Streets. Mre Sorenson gave he staff repor statfng, that oa Apri 3, 1969, this property was rezoned from "A°' to "C" Residence. AI1 adacent lands are zoned "A" Residence. To the west and northwst across Westminster Street the proprty is zoned "C•1" and "C" Residence, and Light Industry. The plsns submitted indicaCe parking for 124 cars and two 41-unit buildfage. The applicant, however, has indicated that he plane an additionsl apartment building on the site, bringiag the total unita to 126. The parkiag area itself can meet minimum design standmrds with chaages. The curb cub specifications, wheelstaps, and land- scapiag need to be indicated. Revised Zayouts have been suggested to the applicaat which would improve tra€fic movementa, aesthetic considerations, and parking ratio. The aite has frontages of 269.24 feet along Arlcwright Street and 479.2 feet aong Arlington Avenue. The area is I29,052 squere feeC. The prans have been reviewed by the Traffic Engineer who recomends approval if driveways are made 26 feeC wide. He also noted that fewer driveways to Arlington Aveaue would be preferable, To the west existe an elevated railway right-of-way and depressed reeway. To the north and south vacant land ard to the east vacant land and newer siagle-family residences. Severa2 new duglexes are about a block away to the east on Arlington Avenue. Mro Sorenson stated that this site is of sufficient size and adequate shape to lend itself to a number of different, more deairable layouts. The setbacicg are very mini.mal and meet the setback requirement, ontyibecause to multiple fronCages. The site can be developed with a much better layout which has beea auggested to the applicant. The staff feels this should be developed with more tihan 1-to-1 parking Snd the staff feels adequae green space caa be provided. Mr. Sorenson noted that this rea has been un,der study by the Planaing Bosrd and the area Caamnunity organization. The Bosrd received the staff study celliag for Commercial use of this site with portious of the property being used for street and parkway rght-of-way. Mro Daubney shawed revised plsna for the site. The traffic people did not like four entrances on Arlington Avenue so this had been reduced to two. 128 parking spaces are naw desired--the original request was for 124 but this has been increased. There will be 84 living units. The applicant hopes to put up another building. He noted that the staff suggested since peat would have to be removed fc+ern the site, it would be desirable to have some undergrouad parking. Mxe Sarenson read from the oniag Code the paragraph that gives he City the powex to make such couditions.a part of a specisl use permit.
