the Auaust 6, 2003, at the hour of Five thirtv o'clock P.M., in the Council
Chamber of the Court House and City Hal1 Suilding, in the City of St. Paul;

WI�REAS, Chapter 293 of the Saint Paul Legislarive Code was enacted to regulate the subject of
noise in the City of Saint Paul; and

5 Wf�REAS, §293.11 provides for the granting of variances from the sound levellimitarions contained in
6 §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hazdship on an appiicant, other persons or on the community; and

9 WHEREAS, The Dubliner Pub, represented by Tom Scanlon, President and Owner, who has been
10 designated as the responsible person on the application, has applied for a variance to allow amplified music at 2162
11 University Avenue West, on August 19, 2003; and

13 WHEREAS, applicant is seeking a variance far the hours of 6:00 p.m. to 12:00 p.m. on 3�-19, 2003; and

WIIEREAS, if applicant is not granted a variance it will not be able to present the amplified music of
"Gailic Storm" an Irish band in the pazking lot of the Dubliner; and
WHEREAS, the Office of License, Inspections, and Environmental Protecrion has reviewed the application
and has made recommendations regazding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby �ants a variance to The Aubliner, subject to
the following conditions:

The variance shall be for the hours of 6:00 p.m. to 12:00 p.m. on August 19, 2003.
All electronically powered equipment used in conjunction with the event shall not
exceed 95 dBA as measured from the closer of 50 feet or the sound mix.

3) The applicant shall provide personnel and equipment who shall provide continuous
sound level monitoring between 6:00 p.m. and 12:00 p.m. on the date to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA systems, loudspeakers or similaz devices
shall be turned of£no later than 12:00 p.m. on the date.
