Preliminary and Final Plat Approval for Mendota Homes
WFIEREAS, Mendota Homes, Zoning File # 03-280-Q93 has submitted for City Council approval the attached
preliminary and final plat for subdivision of proparty at 1537 Fisk to create 10 Iots to provide fQr new single family
homes; and
WIIEREAS, the appropriate City departments have reviewed the p]at and found, subject to the recommended
conditions, that it meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public hearing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of the
subject properry; and
WI�REAS, the City Council held a public heazing on the proposed plat on June 25, 2003, where all interested parties
were given the opportunity to be heard and the Council considered all the facts and recommendations concerning the
plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary and
final plat for Montana Woods at 1537 Fisk subject to the following conditions:

Office.
The applicant shall complete the site plan review process tlirough LIEP and receive site plan approval from the
City.
The applicant shall receive all necessary permits from Pubfic Works for the construction of the street and utility

Per your request after the public heating on 25 June 2003, City staffhaue met with Mendota
Homes (developer of proposed Montana Woods at 1537 Pisk), staff from the Capitol Region
Watershed District (CRWD), and District 10. The following information was coll�ted.
Lnpact of water run off:
There are two critical issues as pertains to water nm-off triggered by the development —
volume/rate and quality. The volumelrate pertains to how much water leaves the site, posmg a
potential flood risk to adjacent properties. The quality issue pertains primarily to the n�act of
the run-off on Como Lake.
Water Run-off Volume/Rate
The CRWD presented on 27 June 2003 a site plan that would have captured most of the run-off
from the development, mcluding most of the water that fell on the new street. However, Saint
Paul Public Works does not allow water to be taken from public streets onto private property due
to liability issues. As such a zero net gain of all run-off is not possible and a net increase m
phosphorus and sediment run-off is likely. Mendota Homes did agree to explore expanding their
proposed ram-gardens, and revising the grading plan m order to capture as much ram &ll as
possible from private property m the rain gazdens as opposed to shedding the water onto the
street. A technical analysis of the total vohune of water leaving the site is being conducted and
reviewed by Mendota Homes and CRWD as quickly as possble. In light of City regulations and
the agreed upon modifications by Mendota Homes, CRWD staff stated that the revised plan is "as
close as possble" to meetmg their guidelines. From the perspective of City Sta� the plat meets
all regulations ensaring no negative impact on adjacent properties.
Neighbors have raised concems about the ongoing flooding problem at Victoria after heavy rain
stomis due to what is perceived to be an iusufficient sewer system. Tbis problem is reported to be
long-standing. However, Public Works does not haue any records of complaints of flooding in
this area, particularly at the intersection of Victoria and Hoyt. The e�sting storm sewer system
was built in 1956 and designed to accommodate additional development in the area consistent
with standards of that tizne. The design standard was to size the pipe to handle a 5-year storm
The Montana Woods proposal is consistent with this plaimiug and the additional run-off from the
proposed development would haue a negligible effect on area drainage. The City Council may

wish to have Public Works review the storm water system for the entire azea.
Water Oualitv
The Watershed District seeks to ensure trigh quality run-off in order to ]imit the pollution and
sedim�.mt that reaches Como Lake. The qnality of run-off can improved through cycling run-off
through rain gardens. As stated above, as much of the water possble ss being captured and
cycled tl�rough the ram gardens, and thus the quality requirements are also "as close as possible"
to the goals set by the CRWD. The quality of the water can be improved through use of certain
plantmg types im the rain gardens. CRWD provided Mendota Homes specific planting material
recommendations which Mendota Homes agreed to incorporate.
Maintenance of Rain Gardens
Mendota Homes will be placing a drainage easement on the properties to preserve the land for the
rain gardens and flow azea. In addition, Mendota Homes agreed to partner with the CRWD to
have the new home owners learn about mamtenancelcaze of the rain gardens. Both parties felt
tUis was an appropriate solution.
Desi n
Mendota Homes provided the Council with e�mples of the types of homes anticipated on the
development. Because each home is customized by the buyer, an e�ct model is not possble.
However, the }ugh quality finishes are expected due to the high value of the homes.

E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1)
creates five or more lots or parcels each of which is 2%= acres or less in size, or (2) requires
paved st�eets, alleys and other public improvemeots, or (3) is previousfy unpfatted tand.
§67.406 provides criteria for review of subdivision applications. These criteria are covered
below under "Required FiRdings °
F. HISTORY/DISCUSSION: There is no previous zoning history. This 1.92 acre °estate" was
recently sold to the applicant.
G. DISTRICT COUNCIL RECOMMENDATION: Although there is neighborhood opposition to the
redevelopment of this parcel, PED staff have nof received any cflrrespondence from the Como
Community Council as of the date of this staff report.
H. REQUIRED FINDINGS: §67.406 of the Zoning Code requires that all of the foilowing findings
shall be made prior to approval of a subdivision:

residential sfreet standards. The Ramsey County Soil and Water Conservation District
wants an erosion and sediment control plan before construction of the subdivision begins.
2. The proposed subdivision will not be detrimentai to the present and potential
surrounding land uses. The new subdivision will not be detrimental to present and future
surrounding land uses. The proposed piat is for 10 single-family lots that meet R-3
standards. The surrounding blocks are afl zoned R-3 and are developed accordingiy.
Neighbors have raised a concem about additional traffic. An earlier subdivision design
showed a cu(-cie-sac with eight lots connecfing to Montana Ave. and four more lots on Hoyt
Ave. The applicant changed the plan to put Montana through to Hoyt Ave. so that traffic
could come and go in bofh directions. This reduced the total number of fots from twelve to
ten. Except for traffic on the immediate block, a net increase of six new homes wili have no
noticeable effect on neighborhood fraffic patfems.
3. The area surrounding the subdivision can be ptanned and developed in coordination
and compatibility with the proposed subdivision. The area surrounding the proposed
piat is aiready devetoped. The new piaf is compafibfe wifh the surrounding development.
4. The su6division is in conformance with t6e comprehensive plan. The subdivision is in
conformance with the Land Use Chapter of the comprehensive plan and the District 10 Plan,
both of which identify this area far singie famity homes.
5. The subdivision preserves and incorporates the site's importanf euisting naturai
features whenever possible. The property has some steep and wooded areas, Putting
the street through requires grading and elevation changes that witl remove mosf of the trees.
Existing trees will be retained along the east and west edges of the site. In the more
detailed site plartning for the devetopment, four rain gardens are proposed to increase
infiitration to ground water and to ciean stortn water before it reaches the storm sewers.
6. All land intended for building sites pn be used safely without endangering residents
by peril from floods, erosion, contirtuousiy high water tabte, severe soil conditions or
other mer►ace. The land can be developed safely without endangering residents. A private
storm sewer is proposed through the westeriy rear yards to carry storm water north to the
public storm sewer in Hoyt Ave. M erosion and sedimentation control plan must be
submitted before grading begins.
7. The subdivision can be ecanomically served with pubtic facitities and services. The
subdivision can be economically served with new public faciiities. Water and sanitary sewer
lines will be constructed in the new section of Montana Ave. and the subdivision will be
connected to the storm sewer in Hoyt Ave.
STAFF RECOMMENDATION; Based on required findings 1 through 7, staff recommends
approvai of the preliminary and final plat to creats ten singie family lots, as attached, at the
southwest comer of Fisk Street and HoytAve., as legaliy described above, subject to the
following conditions:

I reviewed your petition in opposition to development of 12 homes proposed by Mendota Homes
on land along the south side of Hoyt Avenue at Fisk Sfreet. This proposed development wilI
require replattmg the property and a street dedication. Both require a public hearing before the
City Council. Properiy owners within 350 feet will be notified of the public heariags by mail.
Atl persons interested wi22 be given an oppornuuty to testify at the public hearings, and all
written comments will also be considered.
On your behalf, I have forwazded your neighborhood petition to the Plaaning AdministraYor in
the Deparhnent of Planning and Economic Developmeat so it can be considered by city sfaff and
the City Council when they review flze proposed plat for tbis development.
Property plats must comply with the required seven (7) criteria listed in altached Saint Paul
Legislative Code Section 67.406(a). Note that neighbozhood concems about erosioa and
sediment during constntction are among the issues that must be addressed as part of the Cily
Council's review of the plat

Chapter 67. Zoning - Subdivision Regulations
Sec. 67.406. Review of divisions of land.
(a) Subdivision review crdteria. The planning commission and city council, in the review of
subdivision requests and in the application of this chapter shall take into consideration the
requirements of the city and the best use of the land being subdivided. Particular attention
shali be given to the width and location of streets, sidewalks, suitable sanitary utilities,
surface drainage, lot sizes and artangements, as well as requirements such as parks and
ptaygrounds, schools and recreation sites and other public uses. All of the following
findings shall be made prior to the approval of a subdivision or a lot split:
(1} All the applicable provisions of the Legislarive Code aze compiied with;
(2) T'he proposed subdivision will not be detrimental to the present and potential
surrounding land uses;
{3) The area surrounding the subdivision can be planned and developed in coordination
and compatibitity with the proposed subdivision;

(4) The subdivision is in conformance with the comprehensive plan;
(5) The subdivision preserves and incorporates the site's important e�cisting natural
features, whenever possibie;
(6) All land intended for buiiding sites can be used safely without endangering the

Site plan for Montana Woods subdivision (10 single family houses)
On July 2" the City Council approved a plat for a new subdivision with 10 new lots for single-
family homes and a new public street connecting Montana and Hoyt. Concerns were raised at the
heazing about the impact of the development on water quality and other issues. The City Council
asked staff to give them an update when the final site plan was ready.
The developer, Mendota Homes, has submitted a final site plan. The site plan provides more
detail than what was available on the plat about measures to improve water quality, preserving
existing trees aroimd the edge of the site, and erosion control measures. The site plan also shows
the setback lines to indicate where houses can be located on each lot but it does not show the
exact layout of individual houses since they will be custom built and will not be designed until
buyers purchase the lots.
Water quality
The site is located about a half mile from Como Lake and storm water from the site drains to the
lake via the City's storm sewer system. MPCA regulations do not require a project of this size
to treat storm water. However, neighbors and the Capitol Region Watershed District asked that
steps be taken to reduce phosphorus and pollutants going to the lake. In response five rain
gardens have been designed and the site will be graded so that most of the yards drain to a rain
garden. (Rain gardens are shallow depressed azeas that are planted with native plant material
designed so that storm water flowing to them is absorbed into the ground instead of flowing into
the street and the storm sewer.)
Trees
Existing trees in the middle of the site will have to be removed because of the grading needed to
construct the new street. New trees will be planted as part of the development: trees in the
boulevard and at least two other trees per lot. It is possibie to save existing trees around the edge
of the site if precautions are taken during conshuction. Staff has worked with the developer on
the details of grading along the east and west property lines to save existing evergreen trees and
on the design of a retaining wall along the south property line near a stand of trees.
Erosion and sediment control
The site has a slope and there haue been concerns about sediment washing off the site during
construction when the site is disturbed.. The site plan indicates that the developer will take use
all of the standard practices to control sediment, such as installing a siit fence and a rock
construction entrance. In addition, a temporary sedimentation pond will be required at the north
end of the site to trap sediment before it can wash off the site and into the street.

Dear Mr. Spoonheim,
I am writing to express my concerns regarding the proposed development by
Mendota Homes at 1537 Fisk Avenue in St. Paul.
I am a Ramsey County Master Gardener, neighbor of the proposed
development, and concerned resident of St. Paul regarding the water quality of
Como Lake. I am not opposed to the development of the property and
understand the project is compliant with current density requirements,
how�ver, I agree with the Capitol Region Watershed District and Ramsey
County Soil and Water Conservation Board that the project as proposed
inadequately addresses excess water runoff.
Installation of water gardens, an additional storm sewer, and direct water
spouts onto grassy, rather than impervious surfaces do reflect some effort on
the part of the builder to compromise. My concern is that excess water runoff,
even though it might make its way to the added storm sewer, will flow
directly to Como Lake and will contribute to the water quality problems Como
Lake now experiences. Another problem I see is the management/maintenance
of the proposed water gardens. Presumably since these would be installed
on/near the new homeowners' property, what would prevent homeowners
from eliminating the gardens if they choose to do so? Without the proposed

rain gardens, the runoffwould make its way to neighboring properties and/or
eventually Como Lake. A major part of the proposed water management p1an
would be rendered useless with elimination of the water gardens by the
homeowners.
I feel a better solution would be the creation of a pond, proposed at the June 2
community meeting by Pat Conrad, consultant with Emmons & Olivier
Resources. Granted this would reduce the number of developed lots, but
Mendota Homes would have fewer lot development costs and could
potentially seek higher prices for the larger remaining lots. A well-designed
pond would be a collection site for the excess water runoff, and would address
concerns regarding the runoff making its way to Como Lake and contributing
to the water quality problems. A pond could also allay some fears of
neighbors on Victoria and Hoyt Avenues regarding the runoff's effect to their
properties.

Unfortunately I will not be able to attend the June 25 public meeting of the St.
Paul city Council when the "Montana Woods" redevelopment plan will be
considered, so I would like to voice the continued concern that I and many other
residents have regarding this development.
The density af this development is of greaf concern to me and my neighbors on
Hoyt, Montana, Nebraska Avenues and Victoria Street.
The density of this 90 lot development, as it is currently proposed, wi(( most
certainly cause huge run-off problems.
With such high density of impervious surfaces, such as roofs, driveways and a
roadway winding downhill to Hoyt Avenue, will without a doubt cause great
problems for the longtime residents to the west of this property.
It is foolhardy to think that enough rainwater will soak into the yards of these
small lots. This added rate of discharge from the development into the present
storm water system will cause further f►ooding into the homes to the south of the
1537 Fisk property. During and after heavy rainfall, fihis area has flooded back
into the many homes and yards causing much damage and alarm.
The density that this development proposes will create huge surface water
problems.
In addition the grade from the middle of the 800 block on West Montana Avenue
slopes to the West, and that run-off also most certainly will go to the 1537 Fisk
property.
The proper answer to this development is less density, less roofs and less
drivewavs!
This concern has been identified at each of the three neighborhood meetings,
