WHEREAS, the licensee contacted the City Attorney's Office in response to the Notice of
Violation and both the licensee and his son indicated that they wished to resolve the matter and bring the
property into compiiance; and
WHEREA5, the City Attorney's Office agreed to amend the recommendation of the Office of
License, Inspections and Environmental Protection, which was contained in the Notice of Violation sent
to the licensee, and instead recommend a fine of $1,000.00, with $500.00 of the fine being stayed for a
period of eighteen months on the condition that there be no further violations, that the remainder of the
fine be paid within thirty days, and that the property be cleaned up and brought into compliance with all
of the conditions on the license within the thirty days; now, therefore be it
RESOLVED, that Vanntech Auto Sales, located at 1115 Rice Street in Saint Paul (License ID#
20000003083) is hereby ordered to pay a fine of $1,000.00 for the failure to comply with a condition on
the license prohibiting storage of inoperable motor vehicles on its property. Five hundred dollars of the
fine shall be stayed for a period of eighteen months on the following conditions: 1) that the remaining
$500.00 of the fine be paid within thirty days of the passage of this resolution to the Office of License,
Inspections and Environmental Protection; 2) that the property be cieaned up and brought into
compliance with all of the conditions on the license within thirty days following the passage of the
resolution; and 3) that there be no further violations in the eighteen month period of the stay.

Please take notice that this matter has been set on the Consent Agenda for the Council
meeting scheduled for 3:30 p.m., Wednesday, Aagust 6, 2003 in the City Council Chambers,
Third Floor, Saint Pau1 City Hall and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents which will be
presented to the City Council for their consideration. This is an uncontested matter, in that ti�e

Dear SirlMadam:
The Office of License Inspections and Environmental Protection has recommended
adverse action against the above-referenced license. The basis for the recommendation is as
follows:
On Apri121, 2003, an inspector visited the premises and
observed that there fvere inoperable vehicles parked on the lot
as well as vehicle parts being sfored. This is a violation of
condition # 4 of yo�r Special Condirion Use Permit and of
condition number four of the conditions p3aced on your license.
You were previously notified that you had inoperable motor
vehicles on your lot that needed renaoval in October of last
year.
If you do not dispute the above facts please s�nd me a letter with a statement to that
effect. The matter will then be scheduled for a heari�g before the St. Paul City Council to
determine what genalty, if any, to impose. You will`have an opportunity to appear and speak on
your own behalf, or to have someone appear there for you. The recommendation from the
licensing office is for a$1,000.00 fine and a deadline of ten calendar days to clean up the
property and bring it back into compliance �vith the license conditions, or the license +,vill be
suspended until the property is brought back into compliance and an inspection is perfomied and
approved by the licensing office.

On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearing before an Administrative Law 7ud�e (A LJ). If you �vish to have such a hearing, please

Hearing," so you will Imow when and where to appear, and what the basis for the hearing will be.
, In either case, please let me know in writing no later than Monday, May 19, 2003, how
you would like to proceed. If you have aot conEacted me by Monday, May 19, 2003, I wiil
assume that you are not contesting the Facts. I wili then schedule this matfer for tke St.
Paul City Council and have it piace on the Consent Agenda during which no pubtic
