Dear Mr. Marshall:
This is written in response to the appeal of Tuminelly, Inc. to
relax the density requirements of the Zoning Code as they apply to
property located on the south side of Marshall Avenue between H.owell
Street and North Prior Avenue. This property is further described as:
Lots 3 and 4, Block 3, Merriam Park, Second Addition.
This matter was considered at the February 5, 1970, Board of Zoning
meeting. The staff reported that a 13-car administrative parking lot
was approved for this site in April, 1969, and the development is nearing
completion. The appellant now requests that the density requirements be
relaxed to allow him to use a "party room" as a fourteenth unit because
during the course of construction, his costs have skyrocketed to a point
where he needs the added income which an additional unit would provide.
The currently-approved use of 13 units requires 15,900 square feet of
the 16,640-square foot site. The fourteenth unit would bring the total
required land area to 16,800 square feet, leaving a shortage of 160
square feet or a variance of one percent. Staff conclusions noted that
although the variance at one percent is small, no hardship is indicated
or claimed, and that adequate parking for 14 cars cannot be provided
without a buffer relaxation. One letter was noted which indicated no
opposition.
The Board discussed the requested variance with the appellant.
It was questioned whether the party room was intended as a future
fourteenth unit at the time the structure was planned, and if so, the
Zoning Board should have been told there was going to be an appeal.
It was indicated that the party room included all plumbing but could not
be used as a dwelling unit without changes.
Subsequently, it was the finding of the Board of Zoning that the
appeal should be granted because the requested variance is small. The
Board, therefore, recommends approval by a 5-0 vote.

Gentlemen:
We have recently completed a 13 unit apartment building at 1920
Marshall Avenue in St. Paul. Its legal description is: Lot 3 & 4,
Block 3, Merriam Park, Second Addition, �t. Paul, Ramsey County, Minn.
Our original intention for this apartment building was to have
13 occupied apartments and 1 additional apartment that was to be used
for a party room, game room, etc. However, during the course of
construction, our costs skyrocketed to a point where we need the added
income whi,ch a 14th unit would provide us.
Therefore, we are asking for relaxation of the density requirements,
64.03-I. We have carefully exann��ed our overall sit�.ation involving this
apartment building with the Building Department of the City of St. Paul,
and have been informed that we are short the necessary square footage to
comply with a 14 unit apartment building by 160 square feet.

during the course of construction, his costs have sky-rocketed to a point where he
needs the added income which the additional unit wou].d provide. The site has an
area of 16,640 square feet which ia l60 square feet short of the requirement fox
14 apartment units, or a var�tance of 1% from established standards.
Mr. Sorensoa nated that Che area �ko the south of the site is zoaed "A" Resideace
aad areas to the easC and west of the site are zoned "C" Residence. The area to
ehe north is zoned "B" Reaidence and "C" Residence. The siEe is occupied by the
nearly campleted apartment builc3ing. The land slopes down slightly to the rear
from a grade sl�ghtly above �hat of Mershall Avenue. The surrouading area is
occup�ed by mixed-densi¢y residentisl uses in generally good conditioa. The
permit was approved for 13 cax psrkir�g and to get adequate parking for 14 cars
on the site would require a buffer relax$tion on ttae west side. There is a 2-car
parking garage under the buildfng. A11 the access to the parrking area is from the
alley and the parking comes right up to the al�.ey with two apenings of 20 feet and
32 fee� which opens up the whole back end of the property to the alley which is
undesirable.

Gentlemen:
As directed by the Merriam Park Community Council I wish to
communicate the Council ' s opposition to your granting the
appeal for a density relaxation requested by Tuminelly, Inc. , for
its property at 1920 Marshall Avenue. Unfortunately, because
of a communication confusion, we were not represented at the
Zoning Board hearing.
First of all , no relaxation of density requirements should
even be considered by the City Council until the Zoning
Board has forwarded an official recommendation for approval
of a parking lot plan which will accommodate all dwelling units
without a further appeal to relax buffer zone requirements .
At this time it' s questionable whether a 14 car parking lot
can be provided.
The maximum amount of land coverage by the structure (35�) is
being utilized at this location. In the days when this code
provision was enacted, auto parking was a small problem and
most of the remaining area went into "green space" . Today , most
of it typically goes into unattractive parking lots .
The comprehensive plan calls for occupancy in the subject area
at the rate of 15 dwelling units per acre . Including the
requested density relaxation, the density at this site will be
over 43 dwelling units per acre . It is most regrettable that
the code ' s density requirement has become the norm rather than
the maximum.
The developer is breaking faith with occupants who contracted
to live in this building with the understanding that party
room facilities were to be provided. Based on discussion at
the Zoning Board meeting, it is suspected that the so-called
party room facilities were , from the beginning, planned for
conversion to residential occupancy.

Finally, the appellant has never supported his request on
the basis of "hardship" as defined by statutes and the courts .
