Marshall City Clerk Room 386, City Hall Saint Paul, Minnesota 55102 Dear Mr. Marshall: This is written in response to the appeal to relax density requirements and height requirements and to the application for a 506-car parking lot for an ap�rtment building by Bor-Son Construction, Inc. on the north side of St. Anthony Avenue between Griggs and Syndicate Streets. The property is described as: Lots 12, 13, and 14, Block 3; Lots 1 and 2, Block 5; Lots 5-10, Block 5; and Lot A, Block 5, Midway Industrial Division. (Also vacated Bigelow and Donohue Avenues to be determined by Council resolution.) �`f' Staff investigation disclosed that since the property is in a Height District II, no height variance is needed and so was not considered by the Board of Zoning. This matter was first considered at the January 8, 1970 Board of Zoning meeting but was laid over to enable notices to be mailed to property owners of the area. The matter was again considered at the January 22, 1970 Board meeting. The staff reported that the appellant wishes to construct a 506 unit, 24-story high-rise apartment building. The site area, depending upon street vacations and the dedication of a new cul-de-sac, will be approximately 260,000 square feet or six acres. The present Zoning Code requires 1,000 square feet of site area for each dwelling unit. The appellant is about 240,000 square feet short of the required site area or 48 percent. The site also fails to meet the area requirements of the high density district of the Proposed Zoning Code. The Proposed Code would require a site area of 345,000 square feet. The site would be about 82,000 square feet short or 24 per- cent. Put another way, the Proposed Code requires 600 square feet of site area for efficiency and one bedroom units and 900 square feet for two bedroom units. By contrast, the appellant offers only 452 square feet of site area for efficiency and one bedroom units and 678 square feet for two bedroom units. The Proposed Code allows density to increase by 68 percent; the appellant wants density to increase by 98 percent. The staff further noted that should the variance be ap- proved, it may set a precedent for future high density development. This variance �could set a pattern for all low income, medium income, and conventional housing in the future and dictate densities in the new Zoning Code. Mr. Joseph P. Summers and Mr. E. L. Lindberg spoke for Bor-Son Construction, Inc. They stated that most of the units would be efficiencies and one bedroom units. Marshall February 4, 1970 building. Rents will range from $78.50 to $157.50 including all utilities except telephone. Tenants whose incomes increase above the maximum will be allowed to stay and their rents increased upwards. They noted that freeway noise would tend to stay in the freeway ditch, that all trash would be hauled away, and that part of one floor will be used for community use. They stated that the government subsidy had the affect of reducing the mortgage interest rate to one percent and that the cost of the land was the reason for requesting a variance. A representative of the Association of Saint Paul Communities stated that they are opposed to the variance since such high densities could result in a slum in ten years. Mr. William Clapp also spoke in opposition saying that densities should be set in the new Code by public hearings. Mr. Peham of Peham Plastics stated that he was concerned that the entire area might be rezoned to residential. A telegram was read from the Central Medical Building requesting a layover of the matter so they could study the proposal. A copy of the telegram is attached. The Board discussed the matter and brought forth the following objections: because the apartment will front on a freeway, there will be noise and traffic problems; many trucks use the surrounding streets and will adversely affect the site; the federal government should subsidize such apartments so that they meet the City�s zoning laws; since so much land is used for parking, there is only 15 percent of the site available for playground area and useable yard area; the surrounding industrial and commercial uses will not provide a proper environment for such a dense residential use; since there are so many units and the building will not be centrally air-conditioned, odor will be a problem; the density proposed is extreme and excessive and will promote a slum; since the apartments will have children as residents, there is a greater need for lower density than for other types of high- rise apartments such as elderly housing or downtown apartments so that recreation facilities may be provided. In consequence of the above discussion, it was the unanimous findings of the Board of Zoning that the appeal should be denied. Therefore, the Board recommends denial of the appeal to relax the density standards by a vote of 5-0. Since the location of a proposed cul-de-sac was not known at that time, it was impossible to determine compliance with existing parking design standards. Experience with similar structures in Minneapolis indicates that many of the tenants attracted to the building will be elderly people. Rents will va.ry with the number of people occupying a unit but will work out to a minimum of $73.30 per manth for an efficiency, $95.02 for a one-bedroom, and a maximum of $147.73 far a two-bedroom unit for a family of four. Rents will include all utilities except telephone. Thus, the tenants will have predictable, low housing expenses without seasonal variation.
