RESOLVED, That the Council of the City of Saint Paul does
hereby concur in the recommendation of the Model Neighborhood
Planning Committee, and the proper City officers are hereby
authorized and directed to execute on behalf of the City a
Lease Agreement between the City, on behalf of Saint Paul Model
Cities, and Dr. Maurice L. Weisberg Trust, Landlord, the Lease
being for the premises at 165 North Dale Street and on a year–
to–year Lease basis commencing February 1, 1970.

LEASE AGREEMENT
This lease agreement , entered into the first day of February, 1970 ,
by and between the Dr. Maurice L. Weisberg Trust , landlord, and
the City of Saint Paul on behalf of the Saint Paul Model Cities,
tenant;
1. This lease pertains to the rental of the premises located at
165 North Dale 5treet , Saint Paul , Minnesota,.
2. Rent for the months of February, March, April , May and June of
the year 1g70 , sh�ll be based upon the formula of one-fifth of the
contract price and remodeling costs incurred by landlord at the
request of tenant , which remodeling cost is estimated as the total
sum of �7 ,000.00, and thereby causing the projected rent for the
first five months of this lease to be the sum of �1 ,�400 .00 per month.
In no event shall the monthly rental sum exceed the sum of �1 , 400 .00 .
There shall be no monthly rental charge for the remaining term of this
lease , subsequent to the month of June , 1970 , for the use and occupancy
of the above described preuiises . However, the following payments will
be made Uy tenant in accordance with the terms and provisions hereof:

- 1 , 1970.
b . Tenant shall pay all utility charges and assessments on the leased
property from and after February l , 1970, as more particularly here-
inafter set forth.
c. Tenant shall pay all premiums for insurance coverage on the leased
property as more particularly hereinafter set forth.
3. Term: The occupancy of the tenant under the terms of this lease
shall commence on February l , 19�0, and shall continue thereafter
on a year to year basis . The landlord may terminate the lease by the
giving of 90 day written notice to tenant , it being agreed that such
notice must be given at the end of a lease year. Tenant shall have
the right to terminate the lease at any time upon 90 day written notice
tp pwmer, such notice to terminate not being limited to being provided
only at the end � of the lease year. This lease shall terminate in
the event the leased property, or any part i�hereof, is taken by eminen�t
domain, upon the institutinn of condemnation proceedings , or by the direct
purchase by any governmental authority. In the event of termination
any amounts required to be paid as set forth above shall be prorated
between the parties as of the date of said termination. No part of
the proceeds payable as a result of taking by eminent domain,
condeu2nation or direct purchase by any governmental authority shall be
long to the teBant herein.

4. Real Estate Taxes and Assessments . Tenant shall pay all real
estate taxes and assessments upon the leased property, and upon �the
buildings and improvements thereon, which are assessed during the
lease term and which become due and payable �rom and after January 1 ,
i97a. The undersigned agrees to pay the balance of the real estate
taxes due and payable during the year 196g . All taxes assessed during
the term of the lease payable in whole or in part after the termination
of the lease ,. shall be adjusted and prorated between the paities so that
the landlord shall pay its prorated share for the period subsequent
to the termination of the leaseand tenant shall pay its prorated share
during any lease term.
5 . Utilities . In addition to the Payment of taxes and asses�ments the
tenant shall pay all charges for gas , electricity, light , heat, power,
and telephone or other communication service used, rendered or supplied
upon or in connection with the leased property, and any and all other
utilities and paymen�;s thereof required and used in connection with
the leased property, and shall indemnify the landlord against any
liability or daruages on such account , including, but not limited to ,
any and a11 fees or charges required for the use and maintanance of the
air conditioning system used on the leased premises.
6. Repairs, Replacement and Maintenance of Leased Property. Tenant

the leased property. Leased property, fixtures, and all equipment used
in connection with the leased property, and the sidewalks and curbs
adjoining the leased property. The tenant shall , at all times during
the term of the lease , at its own expense , put� and maintain in proper
repair and in good and safe condition the leased property. In addition,
tenant at its own expense shall comply with all laws , orders and
regulations of all governmental authorities and comply with all building
eode requirements and regulations which might be imposed with respect to
the leased property. At the expiration of the lease tenant shall
surrender:. the leased property in as good condition at it was in at the
beginning of the term, reasonable use and wear excepted. No alteration,
addition or improvement to the leased premises shall be made by tenant
without the written consent of the landlord, which consent shall not be
unreasonably withheld. Any alteration, addition or improvement made by
tenant after such consent shall have been giye , and any fixtures
installed as part thereof , shall at the landlord ' s option become the
property af the landlord up�,n the expiration of the lease . Tenant shall
indemnify the landlord against any mechanic ' s lien or other lien arising
out of the making of any alteration, repair, addition or improvement
by tenant.
7. Insurance . Throughout the term of this . lease , tenant shall pay all
premiums for insurance coverage on the leased property, �ncluding fire
and extended coverage , and for �ersonal injury or property damage under
a policy of general public liability insurance , in such amounts and with
such corvpanies as now maii�tained by landlord. The undersigned shall
not be liab.le for injury or damage to person or property occuring within
the leased premises.

8. The landlord or its representatives may enter the leased property
at any reasonable time for the purpose of inspectuzg the leased property,
performing any work which the landlord elects to undertalce , or in order
to exhibit the leased property for sale , lease or other disposition.
9. The tenant shall not assign or sublet the leased property without the
consent of the landlord.
10 . Default. In the event tenant shall def ault .in the performance of
any condition, provision or obligation as set forth in this letter of
agreement , the landlord is hereby authorized and empowered to cancel
and annul this Iease ag�eement at once , and to ?"P..0I1tL�' and take possessioz
of said premises immediately without any previous notice of intention
to reenter, and remove all persons and their property therefrom, in order
to recover at once full and exclusive possession of all premises;
provided, however, that tenant shall be entitled to receive 30 days
written notice of landlord' s intentions to reenter and retake possession
of the property, the purpose of the written notice being to give tenant
opportunity to correct such def ault .
11 . That this agreement shall inure to the benefit of the combined
successors and assigns of the• parties hereto .
