2 in Real Estate Division File Number 03-C-02, and, subject to the herein stated exceptions and with the
3 accompanying Utility Easement Certificates of Intended Non-Use, filed voluntarily on behalf of Qwest
4 Corporation, Northern States Power Company d.b.a. Xcel Energy, District Energy St. Paul, Incorporated,
5 MCI, Comcast, Saint Paul Regional Water Services, and the Department of Public Works, made a part
6 hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for itself and on
7 behalf of these corporations and departments, waives the right to the easements in the foilowing

12 This release of easements shall be subject to the following conditions:
13 1. That the petitioners, their successors and assigns shall pay, as an administrative fee for this
14 release of easements, the sum of $300.00, which shall be due and payable upon receipt of a
15 certified copy of this resolution.
16 2. That the petitoners shall file the plat of the West Side Community Health Addition, conveying
17 and describing therein new easements, as required, including but not limited to a utility easement
18 for sewer purposes on, over, under and across the north 30.00 feet of Lot 1, Block 1, said West
19 Side Community Health Addition, and easements adequate to accommodate Xcel Energy
20 distribution facilities, and that the said release of easements shall not become effective prior to
21 said filing.
