Dear Mr. Marshall:
This is written in response to the appeal of Everette Daigle to establish a
building setback line of 7 feet from East Hoyt Avenue to allow construction of a
garage on property located on the southwest corner of East Hoyt Avenue and
Winthrop Street. This property is further described as:
�East 70 feet of the north 110 feet of Lot 1, Block 8,
Furness'Garden Lots.

The Board of Zoning considered this matter at its meeting on December 4, 1969.
The staff reported that the appellant's request was for a change of plat to establish
his frontage along Winthrop Street instead of East Hoyt Avenue because his house was
oriented to Winthrop Street. Lot frontage is established by the platting of the lot
and the building setback line for this property has been established at 40 feet from
East Hoyt Avenue. In effect, the appeal is to establish a building setback line of
7 feet from East Hoyt Avenue for this property. The staff reported that an appeal
to establish a 35-foot setback on this property in 1961 was withdrawn on the ruling
of the City Architect that the setback for the property was 40 feet. The 40-foot
setback was confirmed by the City Architect in 1964. An appeal to establish a 20-
foot setback from East Hoyt Avenue was denied by the Council in 1966 as there were
no practical difficulties in constructing the building at a setback of 40 feet and
allowing room for the construction of a garage. A duplex was constructed at the
40-foot setback but not located on the site to permit the construction of a garage
within the setback limits. The variance requested is 82.5 percent of the required
setback. The report concluded that granting of the appeal may be detrimental to
the adjoining property, the established setback was reasonable, and the existence
of a hardship was not indicated.
The Board of Zoning discussed the need for the appeal noting the need for a
garage in this climate and the exposure to the wind in the area. As none of the
notified property owners appeared in opposition and since a permit for the garage
slab had already been issued, it was moved that the Board of Zoning recommend
approval of the appeal. This motion to recommend approval of the appeal passed by
a split vote of 3-2.

A. ZONING ADMINISTRATOR: Application for a building permit for a garage was denied
as proposed structure would exceed the established building line.
B. HISTORY: An appeal was filed to establiah a 35-foot setback from E. Hoyt Avenue
in Dec. , 1961. This appeal covered the east 70 feet of the north 110 feet of
Lot 1, Block 8, Furness Gardena. The City Architect ruled that if the appellant
would accept a 40-foot building line, an appeal would not be necessary. The
appeal was withdrawn. A ruled in Sept. , 1964, by the City Architect confirmed
the 40-foot setback from E. Hoyt Avenue and ruled a 7-foot setback from Winthrop
Street would be reasonable. An appeal to eatablish a 20-foot building line from
E. Hoyt Avenue was denied by the City Council 8/4/66.
C. PROPOSED USE: Construct a garage with a setback of 7 feet from E. Hoyt Avenue.
D. PRESENT STANDARD: The City Architect has ruled that the building for this
property is 40 feet from E. Hoyt Avenue and 7 feet from Winthrop Street.
E. VARIANCE: The requeated variance is 17.5% of the establiahed building line.
F. AREA ZONING: The entire area is zoned "A" Residence.
G. SITE CONDITIONS: The site is developed with a duplex constructed with a setback
of 40 feet from E. Hoyt Avenue, established building line, and setback 22 feet
from Winthrop Street. A 7-foot setback would be reasonable. A concrete slab
has been poured adjacent to E. Hoyt Avenue.
H. AREA CONDITIONS: North is an underground water reservoir of the Water Dept. ; east
is the Hillcrest Golf Course; south is a duplex fronting on Winthrop St. ; and
adjoining to the west is a single-family rea. setback at 120' .
