PAUL 1010 COMMERCE BUILDING • ST. PAUL,MINNESOTA 55101 • PHONE: 223-4151 . July 1, 1970 Mr. Harry E. Marshall City Clerk Room 386 City Hall Dear Sir: This is written in response to the appeal of John J. Walsh to relax the parking requirements for a self-service car wash on property located on the southwest corner of Cleveland and St. Clair Avenues, and noted in detail by the legal description on fi1e. This matter was considered at the June 4, 1970, Board of Zoning meeting. The staff explained that this site with frontages of about 90 feet on Cleveland Avenue and 137 feet along St. Clair Avenue has previously been used for a filling station and dry-cleaning pick-up station. The structure remains from these uses and the property is currently used for parking by customers of the neighboring commercial uses at this inter- section. The property is somewhat unkept and is several feet above the alley abutting on the west. The staff noted that the appellant proposes to remodel the now vacant structure for use as a three-bay self-service car wash with space on the property for 29 cars. The Zoning Code, however, requires space sufficient to handle 40 cars. Staff conclusions noted that a large site would be desirable for this operation, both to allow for more reservoir stacking spaces and to a11ow for adequate landscaped buffering areas. Mr. John Wa1sh, the appellant, noted that the proposed building will require low maintenance and that he would be willing to accept a suggested closing time. Several area residents were present on this matter and expressed concern about the present condition of the property and how it might be improved. They noted the surrounding commercial uses and the resulting traffic congestion, and the existence of the playground to the northwest across the inter- section. Concern was expressed that any new development be maintained and have an attendant present. -1- O Mr. Harry E. Marshall (continued) July l, 1970 The Board discussed this matter and subsequently it was moved to recommend denial. Problems of unattended facilities, excessive variance, no control over the number of waiting cars, and a possible detrimental effect were mentioned as reasons for the motion, and its second. Ames, Geuger, McPatli1x, MaieCa, and Masur of the Bosrd, and Messrs. rown and Sorenson, Mxso Frantzen, and iiss Spexr af the saff. Mro Rutzick of the 8oard was prsent buC d.d not vote. JOHN J, WALSH: An appeal to relax ehe paxkfng requirements for a self- service car wash on property lacated an the southwest corn.er of Cleveland and St. Clair AvQnues. Mr. Sorenson noted that he Zonn Code rpquires a 40-csr capacity for atacking space. He explainec tha tae Council dixected that this require- ment be reviewed since sel€-servi.ce car washes may not need a 4-car capacity. The staff haa been wo=king on this and rquesting that applicants wait until the study fs completed, ii they cnnnt meet ±th required 4d stacking spaces. This appeal, tsowevei, would .ike a deterfnfaation made at this time. To susrize the staff repor., iro Sorensnn rotted that the appellant pro- poses space far 29 cars, which prses an fll-car di£erntisl from Che Code, and a relaxation of 27'}'0 This site has a fxontage of a9.S7 feet elng Cleveland Avenue and 137.2+ '+et fronting an St, Clair A•senue, zesulting in a Cotal area of approacimaely 12,29.5358 square feet. The car wash operation would be conducted n. th east 7 fet of the above-descrfbed property. Comaeercia zoning esista from tits propty east along both sides of St. Clair Avenue. To the west o. lai sfdes of St. Clsir ia "B" Resfdence zoning. The reminder of ttte aLe is zoned 'A" Residence. ThE site is ocnupfed by a vcant canercial bailding which spparently was originally a filling station. Th site is at the grade of Cleveland Avenue nd slopes down to the wes. The property is currently used for prking for the neighborhood cauanercial uses at his intraectiQr anci is somewiiat unkept. North acros St. CZair Avnue is a f.ling etation on the northwest corner of the intersection of Cleveland and Sto C.air; a1so, a amll faod market fronting on St„ CZair; suth and adjacent is a lorthern States Pawer sub-atatfon fronting an Cleveland; esst cross Cleveland are verious commerc.al uses froaceing on Cleveland; wen and acrass an alley are duplexea which front on S< lair AvEnue. In conclusion, t4r. Sorenson x►otad that the staff would prefer to see a Larger aXea to provide more stacking and nore green buffering space. A xevised plan submitted by the agpellant makes good uae of the land avsilable; it indiates prvisian £or stii.elding i-aeadlights, etc. The appellant, John 61a1sh, staed that some nei.ghbors are for the car was:, while others oppose t. Th archicect nte the beilding wll require low- mintensnce. He said two drzveways axe .roposed in the ptan. ..1.. JOHN J. WALSH _{ppeal) (6/4/70 (Continued): Mr. Walsh further noted thet the closing time of Che car wash operation is of concern to neighborhood residens. He suggested iC be a condition of the Zoning Board to acconoate ths time element. Mr. Sorenon oted that the sat and raffic Engineer would prefer one driveway, yet it could be approved either way. Mr. John Hesly, who 2ives on St. Clar Avenue about 3 properties away fram the subject site, wanted to note the people in opposiion et this public hearing. He said the appeliant hs a plan €or a nice-lUOking building and this would be better than the ugly building tht is there now. He suggested that there should be supervision of the car wash if it i8 approved, and that there should be anly one exit; thus, the neighhors would be more inclined to be in favar o£ the facility. He noCed that neighboxa are concerned abaut having car come in o£f he corner. The wall on the property line would be from 4-7 feet tall; he feara this will make a blind corner for care leaving the car ash. There is a fair nmount of traffic there due to the gracery store, etc. The property is at street grade and then drops aff 5 feet. He hopes tht the wall caud be moved closer ta Cleveln venue tQ keep some of the natural grae ehere. Mr, Walsh woiid have soe barrier in thre to shield headlighs, etc. Mro Richard Ao Wilhoit, ?_65 Souh Cleveland Avenue, sated tat most of the neighbors agree with Mr, Healy. There would aically be the same type of traffic ae now. On the northeast orner is the Gioveland Playground and 5choo2. There is a good deal of pedestrian traffic in this erea; that is one reason they would prefer only one driveway for e car wash. People congregate on corners waiCing for busea. If shruUbery is paced on the aub3ect site, it would prove some setisfacCion o the residents. Mr< Mansur asked the opnonents if the proposed us would be preferable to th old building that preently exisfis there. ir. Wilhoit said pereonally he would noC want it there becuse it will he an utattended lot. He wauld prefer to see a facility there that is sttended aily. He noted tht teen- agers have a tendecy to "hang around" place such as tnat. Regarding the cer wash, Mr Rutzick asked if a csx would have to ack out onto the street. The spPIlsn said there would be a turn-around at the back of the huiiding. Mr, McPart2in moved for deaia3. oi th apesl, ntfag that trouble arses from unattended facilites. e fee.l tne variance is toa xcassive for the proposd opertion, nd there is no control over th number o£ crs thaC conld be waiting. The motian w$s teonde by Mr, AIetta, who said a business of this type in a neighborhod wuuld be dEtrimen'1 to the character of the residences. 'he motiom crried unanimously.
