Dear Sir:
This is written in response to the appeal of John J. Walsh
to relax the parking requirements for a self-service car wash
on property located on the southwest corner of Cleveland and
St. Clair Avenues, and noted in detail by the legal description
on fi1e.
This matter was considered at the June 4, 1970, Board of
Zoning meeting. The staff explained that this site with
frontages of about 90 feet on Cleveland Avenue and 137 feet
along St. Clair Avenue has previously been used for a filling
station and dry-cleaning pick-up station. The structure remains
from these uses and the property is currently used for parking
by customers of the neighboring commercial uses at this inter-
section. The property is somewhat unkept and is several feet
above the alley abutting on the west. The staff noted that the
appellant proposes to remodel the now vacant structure for use
as a three-bay self-service car wash with space on the property
for 29 cars. The Zoning Code, however, requires space sufficient
to handle 40 cars. Staff conclusions noted that a large site
would be desirable for this operation, both to allow for more
reservoir stacking spaces and to a11ow for adequate landscaped
buffering areas.
Mr. John Wa1sh, the appellant, noted that the proposed
building will require low maintenance and that he would be willing
to accept a suggested closing time.
Several area residents were present on this matter and
expressed concern about the present condition of the property
and how it might be improved. They noted the surrounding
commercial uses and the resulting traffic congestion, and the
existence of the playground to the northwest across the inter-
section. Concern was expressed that any new development be
maintained and have an attendant present.

The Board discussed this matter and subsequently it was moved
to recommend denial. Problems of unattended facilities, excessive
variance, no control over the number of waiting cars, and a
possible detrimental effect were mentioned as reasons for the
motion, and its second. The motion to recommend denial carried
by a 5-0 vote.

We are abie to get 29 cars on this site in lieu of the quantity requested
by the planning code. We feel this is a more than adequate amount based
on our experience in this type of business.
The property is presently not in use and has previously been used as a
drive-in dry clean�ng pickup station and prior to that a filling station.

A. HISTORY: In 1959 a permit was granted to operate a dry-cleaning pick-up station
on this property. Prior to that time the property was uaed for a filling station.
B. PROPOSED USE: Install and operate a self-aervice car wash.
C. PRESENT STANDARD: The Zoning Code requires that car washes provide sufficient
off-street area to accom�nodate the parking of at least 40 cars.
D. NEED FOR APPEAL: The appellant proposea space to accommodate 29 cars and states
his feeling that this is more than an adequate amount based on his experience in
the business.
E. VARIANCE: The variance requested is the 11-car difference between the 40 required
and 29 proposed, and repreaente a relaxation of 27'�'/,.
F. FRONTAGE AND AREA: Thia site hae a frontage of 89.57 feet along Cleveland Avenue
end 137.24 feet fronting on St. Clair Avenue, resulting in a total area of
approximately 12,292.5868 square feet. Thia operation will be conducted on the
east 75 feet of the above-described property.
G. AREA ZONING: Commercial zoning exists from this property east along both sides
of St. Clair. To the west on both sides of St. Clair is "B" Residence zoning.
The remainder of the area is zoned "A" Residence.
H. SITE CONDITIONS: The site is occupied by s vacant co�nercial building which
apparently was originally a filling station. The site is at the grade of
Cleveland Avenue and slopes down to the west. The property is currently used
for parking for the neighborhood commercial uses at this intersection and is
somewhat unkept.
I. AREA CONDITIONS: North across St. Clair Avenue is a filling atation on the north-

hearing. He ssid the appel�ant hss � plan for a nice-looking building and
this would be bett�r than the ugly building Cha� is there aow. He auggested
that there should be snpervision of the c�r wash if it is approved, aad that
there should 'b� only on� exit; thus, the neig�bors would be more inclined to
be in f�vor a£ th2 �scility. He noted t�at neigtibors are concerned about
hsving cars come in off the coxner, ��e �all �r the property line would be
from 4-7 feet tall; he fears this wi11 matce a blind comer for cara }.eaving
the car wash. There is � fair amaunt of tra�fi_c there due tv the grocery

hopes that the wall could be moved �lassr �o Cleveland Avenue �o keep same

Mr, Richard �o Wil_hoit, 265 Snuth Cleveland Avenue, stated that most of the
neighbors agre� with Mr, Healy. There sacrul.d basfcaZly be the same type of
traf£ic as naw. On the north�ast corn�r is the Grovel�nd Playground and
School. There is a good deel of pedestria�i ��affic in thxs srea; that is
one reason they woald prefer only one drivew�y for a car wash. Feople
congregat� on corners ��ra�ting for buses. :�f shrubbery ia placed on the
subject site, it would prove some aetisfaction to the residents.
Mr. Mensur asked the oppox�enta if the groposed use would ta� preferabLe to
the ol� building that pre�ently �exists ��Z�re. *Zr. Wflhoit said per�onally
he would not want it there because it wi�.l be an unattended lot. fle would
prefer to see a facili�y therE that iE attended �aily. Iie noted Chat teen-
agers have a tendency ta "h�ng around" a pLace such as that.
Regard�r�g the car wash, Mr, Ru�z�.ak asl�ecl ii a car s��ould have tcs back out
onto the street. The ap;sellent said th�re �aould b� a turn-a�round at the
back of the buiiding.
�Ir, McPa�tlin moved for den.iai o� 9:h€ appeal, noting th�t trouble arises
from unattend�d facilit�es. He feels the wartance is too ��cce�sive for
the prapos�d operation, and there ie no c�r�troZ over the number of cars
that �oald be w�a�t3ng. The motion was �eco�d�d by Mr., ►�la3.etta, w=ho said

A. HISTORY: In 1959 a permit was granted to operate a dry-cleaning pick-up station
on this property. Prior to that time the property was used for a filling station.
B. PROPOSED USE: Install and operate a self-service car wash.
C. PRESENT STANDARD: The Zoning Code requirea that car washes provide sufficient
off-fltreet area to accommodate the perking of at leaet 40 cara.
D. NEED FOR APPEAL: The eppellant propoaes apace to eccommodete 29 cara and states
hia feeling that thie ie more than an adequate amount based on his experience in
the buainesa.
E. VARIANCE: The variance requeeted is the 11-car dlfference bstween the 40 required
and 29 propoaed, and representa a relaxation of 27�'7',.
F. FRONTAGE AND AREA: This site has a frontage of 89.57 feet along Cleveland Avenue
and 137.24 feet fronting on St. Clair Avenue, resulting in a total area of
approximately 12,292.5868 square feet. This operation will be conducted on the
east 75 feet of the above-described property.
G. AREA ZONING: Commercial zoning exists from this property east along both sides
of St. Clair. To the west on both sides of St. Clair is "B" Residence zoning.
The remainder of the area is zoned "A" Residence.
H. SI�E CONDITIONS: The eite is occupied by a vacant commercial building which
apparently wae originally a filling atation. The eite is at the grade of
Cleveland Avenue and slopes down to the west. The property is currently used
for parking for the neighborhood commercisl usea at thia intersection and is
somewhat unkept.
I. AREA CONDITIONS: North across St. Clair Avenue is a filling station on the north-
west corner of the intersection of Cleveland and St. Clair; also, a small food
market fronting on St. Clair; south and adjacent is a Northern States Power sub-
station fronting on Cleveland; east across Cleveland are various commercial uses
fronting on Cleveland; west and across an alley are duplexes which front on
St. Clair. A public school and playground ia to the northeast across the
intersection.

Mr. Sorenson noted that �he Zon�n� Code rpquires a 40-csr capacity for
atacking space. He explainec� tha� t�ae Council dixected that this require-
ment be reviewed since sel€-servi.ce car w�ashes may not need a 4�-car
capacity. The staff haa been wo�=king on this and r�questing that applicants
wait until the study fs completed, ii they c�nnnt meet ±th� required 4d
stacking spaces. This appeal, tsowevei, would �.ike a deterfnfaation made
at this time.

The appellant, John 61a1sh, sta�ed that some nei.ghbors are for the car was�:,
while others oppose �t. Th� archi�cect n�te� the be�ilding w�ll r�equire low-

Mr. Walsh further noted thet the closing time of Che car wash operation is
of concern to neighborhood residen�s. He suggested iC be a condition of
the Zoning Board to acco�no�ate th�s time element.
Mr. Soren�on �oted that the s�at� and �raffic Engineer would prefer one
driveway, yet it could be approved either way.
Mr. John Hesly, who 2ives on St. Cla�r Avenue about 3 properties away fram
the subject site, wanted to note the people in opposi�ion et this public
hearing. He said the appeliant h�s a plan €or a nice-lUOking building and
this would be better than the ugly building th�t is there now. He suggested
that there should be supervision of the car wash if it i8 approved, and that
there should be anly one exit; thus, the neighhors would be more inclined to
be in favar o£ the facility. He noCed that neighboxa are concerned abaut
having car� come in o£f �he corner. The wall on the property line would be
from 4-7 feet tall; he feara this will make a blind corner for care leaving
the car �ash. There is a fair nmount of traffic there due to the gracery
store, etc. The property is at street grade and then drops aff 5 feet. He
hopes th�t the wall cau�d be moved closer ta Clevel�n� �venue tQ keep some
of the natural gra�e ehere. Mr, Walsh wo�iid have so�e barrier in th�re to
shield headligh�s, etc.
Mro Richard Ao Wilhoit, ?_65 Sou�h Cleveland Avenue, s�ated t�at most of the
neighbors agree with Mr, Healy. There would �a�ically be the same type of
traffic ae now. On the northeast �orner is the Gioveland Playground and
5choo2. There is a good deal of pedestrian traffic in this erea; that is
one reason they would prefer only one driveway for e car wash. People
congregate on corners waiCing for busea. If shruUbery is p�aced on the
aub3ect site, it would prove some setisfacCion �o the residents.
Mr< Mansur asked the opnonents if the proposed us� would be preferable to �
th� old building that pre�ently exisfis there. �ir. Wilhoit said pereonally
he would noC want it there bec�use it will he an uta�ttended lot. He wauld
prefer to see a facility there that is sttended �aily. He noted th�t teen-
agers have a tende�cy to "hang around" � place such as tnat.
Regarding the cer wash, Mr� Rutzick asked if a csx would have to �ack out
onto the street. The spP�Ilsn� said there would be a turn-around at the
back of the huiiding.

the propos�d oper�tion, �nd there is no control over th� number o£ c�rs
