Dear Sir:
This is written in response to the appeal of R. William Reilly to relax the
density requirements to allow construction of 96 apartment units and to relax the
setback requirement on property located on the north side of Wilson Avenue between
Hazel and Luella Streets, and noted in detail by the 1ega1 description on file.
This matter was considered at the May 21, 1970, Board of Zoning meeting. The
report noted that a portion of the property was rezoned to "C-1" Residence in May,
1969, with the remainder of the rezoning being approved by the City Council May 7,
1970. This property, with an area of 141,305 square feet, is limited to 82 dwelling
units in a "C-1" Residence district. The appeal requests that this density require-
ment be relaxed to permit a 96-unit apartment development. The staff explained that
96 units in this district would require 161,000 square feet. The resulting variance
requested is 19,794 square feet or 12.3%. The Zoning Code, it was noted, also
requires a building setback of 20% of the lot depth for this property since "A"
Residence land abuts to the north. The setback in this case is measured from
unimproved Luella Street and amounts to 59 feet. The appellant also requests that
this requirement be relaxed to permit a building setback from Luella Street of
25 feet.
The staff described the site as being vacant of structures and having severe
topography differences. The area south of Wilson Avenue is mixed single-family,
"C" Residence density multiple-family, and vacant lands. The area to the west has
been the subject of several recent rezonings to "C-1" Residence, and an apartment
building is nearing completion on the northeast corner of Hazel Street and Wilson
Avenue. Staff conclusions noted in regard to the density appeal that the variance
is excessive and that the standards are reasonable and were known by the appellant
at the time of the rezoning. Regarding the setback relaxation, the staff con-
clusions noted that the unusually large platted lot depth and the adjoining "A"
Residence require an excessive 59-foot setback for an undeveloped street on what
will actually be the side of the development.
Mr. Rei11y appeared in behalf of his appeal, and noted that the site is an
enormous hole and that there is a tremendous build-up of water. He noted that some
underground parking would be provided and that only 25% of the land would be covered
by building. He felt that the variances requested are reasonable in light of the
development proposed.
Subsequently, the Board, by a 4-1 vote on each matter, recommend,�d proval of
the requested density variance and the setback relaxation.

4. PRESENT USE OF PROPERTY: Property is presently vacant land.
Lots 3, 4 and 5 are presently zoned for a C-1 zoning classification
and Lot 2 is presently in the process of being rezoned, the latter
already having received a unanimous recommendation of approval
from the Zoning Board of and for the City of St. Paul.
5. PURPOSE OF APPEAL: The purpose of this Appeal for a variance
is in order to allow the construction of 96 apartment units on the
afore legally described property. The zoning code as it presently
exists allows the construction of 82 units on said property. It is
the intention of the applicant to provide underground and interior
parking for 89 automobiles and an additional 68 exterior and outside
parking spaces on the above property. The St. Paul Zoning Code
presently requires one parking space for each apartment unit and
the undersigned proposes to provide approximately 1 2/3's for each
apartment unit proposed for construction thereby providing parking
far in excess of that required under the zoning code.
6. NEED OF APPEAL: As mentioned above, the existing zoning code
allows only the construction of 82 units on the above legally described
property and the proposed construction is for 96 units thereon. The

' � proposed construction of said latter units involves the construction
of 89 underground parking spaces which results in a considerably
higher cost per apartment unit. Under normal circumstances, and
with normal land conditions, simple grading and blacktop surfacing
is all that would be required. Because of the greatly increased cost
and resulting financial hardship, the undersigned is requesting the
variance to allow the construction of 14 more apartment units then
would normally be allowed under the Code on the subject property, but
at the same time, the undersigned proposes construction which will
provide 61 more parking spaces than is normally required under the
zoning code. The provision by the undersigned of said additional
parking spaces is done inan effort to compensate for the requested
variance.
In addition to the increased cost resulting under the proposed construction
from the underground parking, the building site, because of its topography
�I will also cost considerably more than is normally expected. The site
itself varies from 30 to 40 feet below street level, and must therefore,
be filled with a considerable amount of rough fill and compaction fill
in order to properly develop said property. �

A. ZONING ADMINISTRATOR: No Action.
B. HISTORY: Lots 3-5 were rezoned "C-1" Residence on 5/24/69. The City Council approved
the rezoning of Lot 2 to "C-1" Residence on 5/7/70.
C. PROPOSED USE: It is proposed to develop the site with two 48-unit apartment buildings
with a total of 169 parking spaces . 88 of these spaces will be located in the normal
basement area of the buildings. The proposed parking ratio is 1.76 per unit. The
appellant is also requesting that a building line of 25 feet be established .
D. NEED FOR APPEAL: The proposed development exceeds the densities aliowed under the
"C-1" classification and the building line requested is less than that set by the
Zoning Code.
E. PRESENT S'I'ANDARDS : The area requiremt�nt for a 96-unit development is 161 ,000 square
feet. With part of the block still classified "A" Residence, the setback is 20% of
the lot depth or 59 feet from Luella Street.
F. VARIANCE: The property has a frontage of 475.34 feet along Luella Street with a
depth of 297.'3 feet and an area of 141 ,305 square feet , 19,794 square £eet or 12 .3L,
siiort of the requirecl area. The setback appeal requests a variance c,f 34 Teet or 57.6%.
G. AKEA 7.ONTNG: North anci east are zoned "A" Residence, south is zoned "C" tZesidence,
and west is zoned "C-1" and "A" Residence.
II. STTE CONDITIONS : This property is located along the west side of Luella Street between
Conway Street and Wilson Avenue. '1'he elevation of Conway Street at Luella Street is
apProximately 50 feet above Wilson Avenue. The site is lower than the grade of Wilson
Avenue and slopes down to the north.
