1 WfIEREAS, a Notice of Violation was sent on May 15, 2003 to the owner of Maryland Amoco,
2 Inc. d/b/a Maryland Amoco, located at 1200 White Bear Avenue North in Saint Paul (License ID#
3 20020000794) alleging that the business failed to repair and maintain the screening fence on the property
4 in violation of the zoning code; and
WHEREAS, the licensee failed to contact the City Attomey's O�ce in response to the Notice of
7 Violarion; and
9 WHEREAS, the recommendation of the Office of License, Inspections and Environmental
10 Protection, which was contained in the Notice of Violation sent to the licensee, is for a fine of $1,000.00,
11 with $500.00 of the fine being stayed for a period of eighteen months on the condition that there be no

RESOLVED, that Maryland Amoco, Inc. d/b/a Maryland Amoco, located at 1200 White Bear
Avenue North in Saint Paul (License ID# 20020000794) is hereby ordered to pay a fine of $1,000.00 for
the failure to repair or maintain the fence on its property in compliance with the requirements of the
zoning code. Five hundred dollars of the fine shall be stayed for a period of eighteen months on the
following conditions: 1) that the remainder of the $500.00 fine be paid within thirty days of the passage
of this xesolution to the Office of License, Inspections and Environmental Protection; 2) that the fence be
repaired or replaced within thirry days following the passage of the resolution; and 3) that there be no
further violations in the eighteen month period of the stay.

Please take notice that this matter has been set on the Consent Agenda for the Council
meeting scheduled for 3:30 p.m., Wednesday, July 2, 2003 in the City Council Chambers, Third
Floor, Saint Paut City HaIl and Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents which will be
presented to the City Council for their consideration. This is an uncontested matter, in that the
faets concerning the failure to repair and maintain the screening fence have not been denied. As
indicated, this matter has been placed on the consent agenda portion of the City Council meeting,
during which no public discussion is allowed. The recommendation of the license office is for a
$1,000.00 fine with $500.00 of the fine suspended for a period of 18 months on the condition
that: 1) you pay a$500.00 fine within 30 days; 2) that the fence is repaired or replaced within the
30 days; and 3) that there be no further violations in the 18 month period.

Dear Sir/Madam:
The Office of License, Inspections and Environmental Protection (LIEP) has
recommended adverse action against the license referenced above. The basis for the
recommendation is as follows:
On December 24, 2002 a letter was sent to you by the Office of
LIEP advising you that a complaint had been received
regarding the condition of the screening fence on your
property at 1200 White Bear Avenue. You were given until
January 30, 2003 to repair or replace the damaged sections of
the fence. On March 4, 2003 you were sent a second letter
advising you that the fence had not yet been repaired and that
you needed to respond by March 10, 2003. As of today's date,
the fence is still in need of repairs and you have not advised the
Office of LIEP of any plans to make such repairs. Saint Paul
Legislative Code § 62.107(b)(7) requires that you keep your
fence in good repair. Saint Paul Legislative Code §310.06(b)(4)
permits adverse action against a license when the licensed
premises are not in compliance with the applicable health, fire,
building or zoning codes.

If you do not dispute the above facts please send me a letter with a statement to that effect.
The matter will then be scheduled for a hearin� before the St. Paul City Council to determine
what penalty, if any, to impose. You will have an opportunity to appeaz and speak on your own
behalf, or to have someone appear there for you. The recommendation of the licensing office is
for a$1,000.00 fine with $500.00 of the fine suspended for a period of 18 months on the
condition that: 1) you pay a$500.00 fine within 30 days; 2) that the fence is repaired or replaced
within the 30 days; and 3) that there be no further violations in the 18 month period.
On the other hand, if you wish to dispute the above facts, I will schedule an evidentiary
hearing before an Administrative Law Judge (ALJ). If you wish to have such a hearing, please
send me a letter stating that you are contesting the facts. You will then be sent a"Notice of
Hearing," so you will know when and where to appear, and what the basis for the hearing will be.
In either case, please let me know in writing no later than Monday, May 26, 2003,
how you would like to proceed. If we have not heard from you by Monday, May 26, 2003,
we will assume that you do not contest the facts and wili schedule this matter for the St.
Paul City Council and have it placed on the Consent Agenda during which no public
discussion is allowed and the recommended penalty will be imposed.

Dear Mr. Hersh :
Upon reinspection of the property at the above referenced address, I spoke to you
about the dilapidated condition of the screening fence surrounding this property. I
gave you a copy of orders this office sent to you to repair and maintain this fence.
You stated that you did not receive the orders sent in December. You further
stated that AMOCO owned this property and would be responsibie for the upkeep
of the fence. You said you would send a letter to this office stating this fact and
also that you would repair the fence at the earliest possible time you could contract
a fence company to do the work. At this time, this office has received no written
correspondence as to who the contractor is or when they can finish the project.
We have not received any acknowledgment by you or AMOCO as to responsibility
of the fence maintenance.
Upon further research it appears that all your licenses are currently delinquent for
this operation also. I am enclosing a invoice from the Licensing Division. Please
send your explanation letter, contractor information and schedule, and licensing
fees to this office by March 10"', 2003. I am copying AMOCO on all orders.
Failure to comply with this order or repeat violations will result in further legal
action by this office, including criminal citations and possible adverse action against
your license.

This office has received a complaint about the condition of the screening fence
around you property at 1200 White Bear Avenue. The Zoning Code Section
62.107(b)17) clearly states that "Visual screens shali be maintained in a good state
of repair". There are several sections of the fence on the east and south sides of
your property that require repair or replacement. You must repair or replace the
