WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of
noise in the City of Saint Paul; and

5 WHEREAS, §29311 provides for the granting of variances from the sound level limitations contained in
6 §293.09, upon a fmding by the City Council that full compliance with Chapter 293 would constitute an
7 unreasonable hardship on an applicant, other persons or on the community; and
9 WHEREAS, Andersen Corporation, represented by Stacy Einck, Manager of "Andersen Centennial", who
10 has been designated as the responsibie person on the application, has applied for a variance to allow amplified
11 music at Harriet Island, on July 19, 2003.

13 WHEREAS, applicant is seeking a variance for the hours of 7:00 p.m. to 1030 p.m. on each of those dates;

WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music for its
Andersen Centennial event; and
WHEREAS, the Office of License, Inspections, and Environmental Protecrion has reviewed the application
and has made recommendations regarding conditions for the variance; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Andersen Corporation,
subject to the following conditions:

The variance shall be for the hours of 7:00 p.m. to i�6�-July 19, 2003.
All electronically powered equipment used in conjunction with the event shall not
exceed 100 dBA as measured from the closer of 100 feet or the sound mix.

3) The applicant shall provide personnel and equipment who shall provide continuous
sound level monitoring between 7:00 p.m. and �9r38�:x�, on the date to ensure

4) Ail electronicaliy powered equipment, PA systems, loudspeakers or similar devices
