03-623Council File # �� {�`c`c��v�.�, e.�, — ��.�.r�e_ �S 3a o 3 Resolution # Green Sheet # 3VV � OF Presented By Referred To Committee: Date 2 WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in 3 the City of Saint Paul; and 4 5 �VHEREAS, §293.11 provides for the granting of variances from the sound level limitations contained in 6 §293.09, upon a finding by the City Council that full compliance with Chapter 293 would constitute an 7 unreasonable hazdship on an applicant, other persons or on the community; and 8 9 WHEREAS, Taste of Minnesota, represented by Ron Maddox, Owner, who has been designated as the 10 responsible person on the application, has applied for a variance to allow amplified music at the four main stages at 11 Harriet Island and at the intersection of Wabasha and Water Street, from July 2-6 2003; and 12 13 WHEREAS, applicant is seeking a variance for the hours of 12:00 pm. to 11:00 p.m. on each of those dates; 14 and WHEREAS, if applicant is not granted a variance it will not be able to present the amplified music for its Taste ofMinnesota; and WHEREAS, the Office of License, Inspections, and Environmental ProYection has reviewed Yhe applicaTion and has made recommendations regarding conditions for the variance; now, therefore, be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Taste of Minnesota, subject to the following conditions: 1) The variance shall be for the hours of 12:00 p.m. to 11:00 p.m. July 2-6, 2003.
