12 WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on April 3, 2003, for
13 the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative Code,
14 submitted its recommendation to the Planning Commission that the petition be granted; and

16 WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on April 11,2003,
17 and recommended that the City Council approve the petition; and

WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly published in
the official newspaper of the City on May 15, 2003, and notices were duly mailed to each owner of affected
property and property situated wholly ar partty within 350 feet or the property sought to be rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on May 28, 2003, at which all
interested parties were given an opportunity to be heard, the Council having considered all the facts and
recommendations concerning the petition; now, therefore
THE COUNCIL OF THE CITY OF SA1NT PAUL DOES ORDAIN:

- - WHEREAS, the Zoning Committee of the Planning Commission, on 3 April, 2003, held a public

- WHEREAS, the Sainf Paul Planning Commission, based on tMe evidence presented to its.
Zoning Committee at the public hearing as substantially reflecfed in the minutes, made the

1. Rice Street Prope�ties and Xcel Energy have leased parcels from each other on
adjacent land for years. In order to Garify ownership, the companies are trading land
� and clarifying ownership bouridaries. There will be no changes in the actual use of the
properties. The properry in question is being split off and transferred .to Xcel. This
requires thaf the land be down-zoned consistent with the larger parcel to which it witl be
attached. A_ lot split application is under review.

Gynthia Baumann, representative of the applicant, explained that the rezoning is intended to
conform the property to the existing use by the two parties.
No one spoke in support or opposition. The pubiic hearing was closed.
Commissioner Morton moved approval of the rezoning. Commissioner Gordon seconded the
motion.
The motion passed by a vote of 7-0.
