' In the Matter of hazardous buildings being that
one and one-half stor,y frame single-family dwelling
and garage known and described as 171 East Winona in
the City of Satnt Paul and sjtuated upon those premises
legally described as Lot 8, Block 1, Belvidere Park
Sub. of Lot 3 Bidwell `s addition to Saint Paul , accord-
ing to the plat on file and of record in the office
of the Register of Deeds in and for the County of Ramsey,
State of Niinnesota.
WHEREAS, Pursuant to resolution, C. F. No. 250348, approved on
September 3, 1970, a public hearing was duly held on Tuesday, Septem-
ber 15, 1970, before the Councii of the City of Saint Paul, said hearing
pertaining to the condition of the structures located at 171 East
I�inona, Saint Paul , Minnesota; and
WHEREAS, Upon the facts presented at the said hearing consisting
of phatographs, inspection reports and the re�omnendations of the City
Architect, it is found and determined by th� City Council that according
to �he records and files in the offfce of the Register of Deeds, the
last record owner of the above-described property is J. Stuart Markoe
and that Bert J. Friedmann is the mortgaqee of the above-described
property; and that there are no other lien holders of record; and that
it is further determined that the above-described building and garage
constitute hazardous buildings within the definition of Minnesota Statutes
Section 463.15 for the followinq reasons:
a. The building and garage are standing vaca�t, abandoned and are
subject to being entered by unauthorized persons;
b. The exterior condition: of the building is as follows: the
: siding, porches and stairs are rotted and collansed; th�re are holes in
the roof; and the chimne,v mortar joints have corroded; � "-° -

c. The interior condition is as follows: the basement walls and
floor are cracked and heaved; all five (5) rooms on the first floor have
broken doors and windows, saqging floor joists and broken plaster walls;
on the second floor, the ceiling joists and rafters are sagging; all
nlumbing and electric fixtures have been disconnected and/or damaged;
d. The building in the above condition is beyond reasonable repair;
e. The building is unfit for human habitation in its present
condition.
f. The building constitutes a nuisance and a hazard to the public
health, safety, and welfare because of its phvsical damage, dilanidation
and inadequate maintenance;
g. There is a 12 x 18 foot garage; the windows are smashed; the doors
are smashed; the roof is in poor condition and the building is considered
structurally unsound;
now, therefare, be it
RESOLVED, That in accordance with Minnesota Statutes Sections 463.15
through 463.26, and based upon the foregoing findings of the City Council,
the Council of the City of Saint Paul does hereby make the following Order:
ORDER
1 . The owner of the above-described building and garaqe shall make
the same safe and not detrimental to the public peace, health, safety and
welfare by having the said building and garage razed: and the materials there-
from removed from the premises within thirty (30) days from the date of the
service �f this Order;
2. Unless such corrective action is taken to compl,y with this Order
or an answer served upon the City of Saint Paul and filed in the Office of
the Clerk of District Court of Ramsey County, Minnesota, within twenty (20)
days from the date of the service of this Order, a Motion for Sur�nary Enforce-
ment of this Order to raze and remove the said buildinq and garage will be
made to the Ramse,y County District Court;
3. In the event that the buildinq and garage are to be razed by the
City of Saint Paul pursuant to �udgment of the District Court, all personal
aronerty or fixtures which ma,y unreasonablv interfere with the razing and
removal of this building and garage shall be removed within ten (10) days
from the entry of judgment; and if not so removed, the City of Saint Paul
shall remove and dispose of such personal property and fixtures as provided
by law;

4. If the City of Saint Paul is compelled ta take any corrective
action herein, all necessary costs expended by the City wiT1 be assessed
against the above-described real estate and collected as other taxes;
and be it
FURTNER RESOLVED, That a certified copy of this resolution and
incorporated Order herein be served upon the tast record owner and
mortgagee of the above-described praperty in the manner provided by law.

Gentlemen:
The Building Department is herebX submitting its report
on the condition of the struct�res at the above location.
The owner of record is J. Stuart Marko, Dellwood, Minn.
and the legal description of the property is Lot 8,Block l,Belvidere
Park Sub of Lot 3 Biclwells ' Add.
A recent inspection indicates the following:
Buildin� Classificationt Single Family (Frame)dwelling.
Exterior: Siding, porches and stairs are rotted and
collapsed. There are�o es in the roof. Chimney mortar joints have
croded.
Basement: Walls and floor are cracked and heaved.
First Floor; All five (5) rooms have broken doors and
windows� sagging floor joists and broken plaster walls. The entire
structure has been extensivly vandalized.
Seco�� F'1'oor� Ceiling joa.sts and Rafters are sagging.
Plumbin � H'eatin and Electrical S stems: Al1 plumbing
and electric fixtures ave een disconnected and or damaged.
Accessory Buildings: A 12 ' x 18 ' garage is in a
delapidated condition.
The subject property has been �boarded up by the city
since August 20,1970.

This property has been vacant for over a year. It
has been vandalized and apparently ab�ndoned and has become an
attractive nuisance. It is a bliqhting influence to the immediate
environs.
Inasmuch as the conditions outlined above constitute
a public hazard and the owner has made no attempt to satisfactorily
repair the damaqe despite our warninqss it is the recommendation ot
this bureau that this matter be referred to the City Attorney' s
office for razing and removal through District Court proceedinc�s.
