RESOLVED, that pursuant to the Award of the Minnesota
Industrial Commission dated August 3, 1970, George Dwyer be
paid the sum of $5,508.51 in one lump sum out of the
Workmen's Compensation Account of �he Water Department Fund,
said sum representing compensation for 63.25 weeks of
permanent partial disability of the right leg; 25.3 weeks
of perma.nent partial disability to the left leg; 96 weeks
for compensation during the healing period at the rate of
$12.16 per weeki said compensation due by reason of injuries
sustained by George Dwyer on November 30, 1967, while
employed by the Board of Water Commissioners;
FURTHER RESOLVED, that out of the aforementioned
compensation, employer, City of St. Paul, sha.11 deduct and
pay directly to Thomas J. Lyons, employee's attorney, the
sum of $1,377.12 as and for attorney's fees in this ma.tter

Re : Resolution on George Dwyer
Date: August 18 , 1970
George Uwyer, an employee of the St. Paul Water Department,
was injured on November 30, 1967, when he was buried in a ditch
cave-in. Both legs were injured as a result of the cave-in.
Mr. Dwyer was also demoted from a Water Serviceman II to a
Water Serviceman I, an approxima.te amount of $79.07 per month.
When the matter came on for hearing before the Industrial
Commission, I was advised by the compensation judge, informally,
that Mr. Dwyer would be entitled to the difference between the
Water Servicema.n II and Water Serviceman I wage for the rema.inder
of his work career with the City. This would involve a sub-
stantial amount of money. When Mr. Dwyer's attorney offered to
settle for a percentage disability to both Mr. Dwyer's legs and
for the loss of wages between the date of the injury and the
date of the hearing, the offer was accepted. The amount of the
settlement is $5,508 .51.
