Preliminary and Final Plat Approval for Emerald Gazdens
WHEREAS, Hunt Associates, Zoning File # 03-255-251 has submitted for City Council approval the attached
preIiminary and final plat for subdivision of property at the azea bound by Eilis, Emerald, Berry and Franklin to create
four lots to provide for new development of Emerald Gardens -- a mixed housing development with apartments and
townhomes; and
WIIEREAS, the appropriate City departments have reviewed the plat and found, subject to the recommended
conditions, that it meets the requirements of Chapter 67 of the Zoning Code; and
WHEREAS, notice of a public hearing before the CiTy Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all property situated within 350 feet of the
subject property;and
WHEREAS, the City Council held a public hearing on the proposed plat on June� 2003, where all interested parties
were given the opportunity to be heard and the Council considered all the facts and recommendations concerning the
plat;
NOW, THEREFORE, BE IT RESOLVED, that the CiTy Council accepts and approves the attached preliminary and
fmal plat for Emerald Gardens at the area bound by Ellis, Emerald, Berry, and Franklin subject to the condition that the
applicant shall file a copy of the Council Resolution approving the plat with the Ramsey County Recorder's Office.

PURPOSE: To consider a preliminary and final plat proposed by Hunt Associates to create four pazcels
with one building on each.
Deaz Ms. Anderson:
Hunt Associates has submitted an application for preliminary and final plat approval for subdivision of
property bound by Ellis, Emerald, Berry, and Franklin to create four parcels. These pazcels will be
redeveloped with housing. Attached aze the staff report and the preliminary and fmal plat for City
Council consideration. This applicarion meets all subdivision requirements and staff recommends
approval of the preliminary and final plat.

E. ZONING CODE CITATION: §67.301 states that platting is required when a subdivision (1)

paved streets, alleys and other public improvements, or (3) is previousiy unpiatted land.
§67.406 provides criteria for review of subdivision applications. These criteria are covered
below under "Required Findings.°

HISTORY/DISCUSSION: Hunt Associates received approval of their site plan and are under
construction.
DISTRICT COUNCIL RECOMMENDATION: The developmenf received strong support
from the district councii.
REQUIRED FINDINGS: § 67.406 of the Zoning Code requires that ali of the following
findings shall be made prior to approval of a subdivision:
1. All the applicable provisions of the Legislative Code are complied with. C'ity staff
have reviewed the proposed plat and have determined that all applicabie provisions of
city codes are met.
2. The proposed subdivision will not be detrimental to the present and potential
surrounding land uses. The proposed plat is consistent with the surraunding land

uses, and will not be detrimental to present and future use of surrounding land.
3. The area surrounding the subdivision can be pianned and developed in
coordination and compatibility with the proposed subdivision. The area
surrounding the proposed plat is already developed and is compatible with the proposed
plat.
4. The subdivision is in conformance with the comprehensive plan. The subdivision
is in substantial conformance with the Land Use Chapter of the Saint Paul
Comprehensive Plan.
5. The subdivision preserves and incorporates the site's

There are no important natural features.
6. All land intended for buiiding sites can be used safely without endangering
residents 6y perif from floods, erosion, continuously high water table, severe soil
conditions or other menace. The site is has no flood, erosion, confinuously high water
table, or severe soii conditions. No development is proposed on steep sfopes.
7. The subdivision can be economically served with public facilities and services.

STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends
approval of the preliminary and final plat for HUNT ASSOCIATES for the area bound by
Ellis, Emeraid, Berry, and Franklin, subject to the condition that the applicant shall file a
copy of the Council Resolution approving the plat with the Ramsey County Recorder's
Office.
