WHEREAS, on April 15, 2003, the applicant was notified by the Office of License,
Inspections and Environmental Protection 1) that the check the applicant submitted with the
application was returned for non-sufficient funds, and was given until April 16, 2003, to repay
the application fee; and 2) that the applicant needed to apply for additional licenses based upon
advertising which showed that the applicant was also doing catering, in order for the license
applicarion to be processed; and
WHEREAS, the applicant was sent a Notice Of Intent To Deny License Application by
the City Attomey's Office, dated May 8, 2003, for failing to pay the required license fee and
submit additional license applications; and
WIIEREAS, the license fee has still not been paid and the necessary applications have
still not been submitted, and applicant has not responded to the Notice Of Intent To Deny
License Application; now, therefore be it
RESOLVED, Yhat the license application submitted by Michael C. Robinson, d/b/a
Robinson's Barbeque & Catering, for the premises at 1001 Payne Avenue is hereby denied for
failing to pay the license fee and submit additional license applications required for licensure.
The licensee did not respond to the Notice Of Intent To Deny License Application.

Dear Mr. Robinson:
The Office of License Inspections and Environmental Protection has recommended denial
of the above-referenced license application. The basis for the recommendation is as follows:
On February 6, 2003, the Office of LIEP was advised that the
check you gave with your application for a license was
returned for non-sufficient funds. You were given until April
16, 2003 to repay the application fee and advised that you
needed to apply for additional licenses based upon advertising
showing that you were also doing catering. As of today's date,
no additional license applications Lave been made, nor have
you paid the license fees.
If you do not dispute the above facts, please send me a letter with a statement to that
effect. The matter will then be scheduled for a hearing before the Saint Paui City Council to
determine what penalty, if any, to impose. You will have an opportunity to appear before the
Council and make a statement on your own behalf. The recommendation from the licensing
office is for the denial of your license application.
On the other hand, if you wish to dispute the above facts, you are entitled to an
evidentiary hearing before an administrative law judge. If you wish to have such a hearin�,
please send a letter stating that you are contesting the facts. You will then be sent a"Notice of
Hearing" with the date, time and place for the hearing, the name of the administrative law judge,
and an explanation of the procedures.

In either case, please let me know in writing no later than Monday, May 19, 2003, how
you would like to proceed. If you have not contacted me by Monday, May 19, 2003, I will
assume that you are not contesting the facts. I will then schedule this matter for the St.
Paul City Council and have it place on the Consent Agenda during which no public
discussion is allowed and the recommended penalty will be imposed.
