bearings for these pro�ects be held at the same time.

the matter of improving JEFFERSON AVENUE from Snelling Avenue to
Edgcumbe Road (City Project P-0240), and wish to report as follows:
Amount of frontage involved in said improvement - 7,399.82 ft.
Amount signed for on said petition - 4,243.33 ft, or 57.34%
(Amount required by Charter - 50%)
Number of residence owners involved - 214
Number who signed on said petition - 154 or 71.96%

Re : Petitions of Remonstrance
At the June 3, 1970, Council meeting, you requested
an opinion from this office concerning Saint Paul Charter
Section 243. Yo� request presents the following issue :
Whether an affirmative vote of more than a
majority of all the members-elect including
the mayor may be required to override peti-
tions of remonstrance .
OPINION
The powers that may be exercised by the council
must be within the authority delegated to the municipality
by the city charter or other enabling legislation. State
v. Clarke Plumbin� and Heatin�, Inc . , 238 Minn. 192,�—
N.W. 2d 667. The City of Saint Paul operates under home
rule , but since it remains a political subdivision created
as a convenient agency for the exercise of delegated govern-
mental powers, the legislature may withdraw or modify any
powers so entrusted. Hunter v. City of Pittsbur�h, 20'7
U. S. 161, 28 S. Ct. 40, 52 L.Ed. 151 . In Minnesota, the
paramount power of the legislature is specifically pre-
served by Article 4, �36 of the State Constitution. As
a result, when the exercise of municipal power conflicts
with state law or enters into an area that has been pre-
empted by the legislature , such action is null and void.
Power v. Nordstrom, 150 Minn. 228, 184 N.W. 967 .
In MeDonou�h v. Cit.y of Saint Paul, a recent
opinion by the District Court for the County of Ramsey,
the Honorable John W. Graff held that the provisions of
the Saint Paul Legislative Code, Section 64.06, was null
and void to the extent that it required the adoption of
an amendment to the Zoning Ordinance by an affirmative
vote of two-thirds of full membership of the city council .
This opinion was based on the enabling statute which pro-
vided that cities such as Saint Paul could amend a zoning

ordinance by "a majority of the members of the governing
body. " �ee Minn. Stat. 462. 357 (5) ; note also that
the enabling act showed a specific legislative intent
to provide municipalities with a single body of law in
the area of zoning_7 Because the Saint Paul Legislative
Code conflicted with the State law regarding the number
of votes required, it was null and void to that extent .
This is consistent with the well-defined principles of
municipal power set forth above .
The Saint Paul Charter, Section 243, provides as
follows :
"�ETITION OF REMONSTRANCE.7 Sec . 243.
No public improvement , the cost, or any part of
which , shall be paid by an assessment on the
property deemed benefited, shall be made if a
petition of remonstrance as hereinafter pro-
vided is filed with the council at any time
prior to the passage and adoption of the final
order therefor. And no further action shall
be taken therein and all proceedings had
theretofore shall be of no force and effect
and no other or new preliminary order for
such improvement or improvements so peti-
tioned against shall be introduced for a
period of six (6) months from and after the
filing of such petition.
"Such petition shall describe the improve-
ment or improvements and shall be signed by not
less than sixty (60) percent of the resident
owners , or their agents , of such property
aforesaid representing not less than fifty
(50) percent of the lineal frontage on the
line of such improvement , or when such basis
shall be impracticable then sixty (60) percent
aforesaid representing not less than fifty (50)
percent of the parcels of land so assessed.
"Each signer shall write his name and
place of residence, or where an agent shall
sign the name of such owner by his agent and
the place of residence of such owner, give a
description of the property owned or repre-
sented and the lineal feet frontage of the
same when required as aforesaid.
"Such petition may consist of several
papers , but the names on each separate paper
or portion thereof shall be certified to under
oath by one of the signers thereof.

"Provided. however. that no such petition
of remonstrance shall have anv force or effect
whenever the council , bv a resolution adopted
by a five-sevenths vote of all its members-
elect includin the ma or and ado ted within
twenty 20 days f rom and af ter the f i 1 in� of
such petition, shall declare such improvement
or im rovements to be a ublic necessit . "
Emphasis added.
A review of the existing state law concerning
public improvements does not reveal any legislation that
conflicts with the provision in Section 243 of the Charter
requiring a five-sevenths vote of all the members-elect
to override a petition for remonstrance. Furthermore ,
there is no gleanable intention of the legislature to
preempt the field. Thus, the opinion of the Honorable
John W. Graff cited above has no application to Charter
Section 243 or the right of the people to a petition of
remonstrance , and this Section, as presently worded, is
a valid exercise of the council power in that respect .
It is our opinion that in all other aspects , the
five-sevenths requirement is a permissible exercise of
council power. Acts regarded as of more than ordinary
importance may require greater than a majority vote .
Holzhauer v. Ritter, 198 N.W. 852; Savat�y v. Kin�ston,
274 N.Y. S. 2d 852. �ee also Sections 150, 1�8, 217
and 219 of the Saint Paul Charter which impose the same
affirmative vote requirement_7 Overriding a petition
of remonstrance should be considered as being of great
public interest and the voting requirement is reasonable
and proper as a local legislative action. In re 0 enin

Therefore , the issue noted above is answered in
the affirmative .

On June 5, 1970, a pnblic hearing was held on the advisability of
improving Jefferson ,�venue by street wi�ening and constructing certain
stor� sewers. The Council laid the matter over in�efinitely to permit
the Public Works Department to explain more fully the proposed pro,jects.
On the evening of June 30, 1970, I, the Chtef Engineer and staff of the
PubTic Works Aepartment, and representatives frcxn the Vatuation Enginee�ls
office met with the interested property owners at the Edgcumbe playground
and explained the nature of the proposed street work, sewer construction,
and financing.
1 recommend that the Councit schedule a rehearing on these rnatters for
August 1�, 1970, and instruct the Finance Department to send new notices
to the affected property owners.

J�e would like to ask you to reconsider
the proposal to widen Jefferson Avenue and to
construct curb and gutter. . J1e feel that there
are so many improvements at this ti.me, that
the cost will be a hardship, especial_ly for
tl�e families that are on fixecl incomes.
�nTe have jus t had new s idewalks on
Jefferson and we know that some of the
neighbors have not yet finished paying for them.
The storm sewer is another project.
_�dded to this the cost of widening the
street and curb and gutter at this time, we

feel it will be a great hardship.
Perhaps we are overly concerned with
costs. However, we are rememhering .that new
sidewalk is coming in front of our home and
also that we will he receiving an assessment
soon for the paving project done on Edgcu.mbe
several years ago. .
