RBSOLVED, That the proper officers of the City of Saint Yaul are hereby
authorized to pay to Dunkley Surfacin� Company on �artial Esti�ate No. 3,
mptroller's Contract No. L-7254, City Froject No. 69-5-0971C, for the
r r �construction of the ST. ANTHONY FIILL RELIEF SEWTtiR (Carroll-Grotto), said
esti�ate being paid for the period of July 1, 1970 to July 31, 1970, and
such other partial estiieates on said contract that nay be presea�ted subse-
--� quently bq�_raid Contractor and approved by the City Engineer, it b@ing the
understanding of this Council that such partial pay�ent or payments on partial
estiesate or esti�ates on said Contract in no way are to be construed as an act
by the City or any of its agents, servants or employees extending the time
specified for the cc�mpletion or in any way changing the terms of said Contract,
Flans or Specifications thereof, nor in any way nor by any means shall this
resolution or payment, or paynents made under authority of this resolution be
construed as a waiver of any of the rights of said City under said Contract,
and provided that prior to payment of any of the aforesaid partiel estiffiate
or estimates, said Contractor by its duly authorized agents or corporate
officers, shall file with the Citq Comptroller in a form approved by the
Corporation Counsel an acceptance of the conditions of payment as hereinbefore
set forth, and
Bg IT FURTHER RESULVEDs That in the absence of said acceptance being
f iled with the City Comptroller, no payment or payments as aforesaid shall
be made.
