This is written in response to the appeal of the Housing and Redevelopment
Authority to relax the density requirement to allow two duplexes to be placed
on plots of insufficient area on property located on the south side of Iglehart
Avenue between North Oxford Street and North Lexington Parkway. This property
is further described as:
Lots 9, 10, and the east 1/2 of Lot 11, Block 2, A. B. Wilgus
Addition to the City of St. Paul.
This matter was considered at the July 16, 1970, Board of Zoning meeting.
The staff reported that the proposal consists of dividing the site into two
parcels to receive two existing duplexes from the north side of Iglehart Avenue
where Oxford Playground is being enlarged. Each parcel, however, has only
5,580 square feet of area which is 420 square feet or seven percent short of the
6,000 square-foot requirement. It was noted that the site is presently vacant
and is adjoined on the west by an 11-unit apartment building and on the east by
a single-family residence. The area is generally mixed-density residential and
is within the Summit-University Neighborhood Development Program area. A letter
from the Model Neighborhood Planning Commattee was noted which indicates their
approval and support, although they hope the relaxation will not set a precedent.
Mr. Jim Hart, representing the appellant, noted that moving costs would be
about $1,000 per block, that the appeal is needed to maintain sound housing, and
that if the appeal is not granted, the structure wi11 be destroyed.
Two area residents, Mr. and Mrs. Donald McAdams, 1089 Iglehart Avenue, spoke
in opposition to the appeal noting that a reduction below minimum standards for
these duplex structures would be detrimental to their environment and that the
site could be used for one of the duplexes plus a single-family structure.
After some discussion by the Board, a motion was made to recomanend approval
of the appeal because of the good appearance of the structures and the adequacy
of proposed side-yards. The motion to recommend approval passed by a 3-1 vote.

Pursuant to the provisions of Section 64.03(i) of the Zoning Code, the Housing and
Redevelopment Authority of the City of Saint Paul, Minnesota, requests relaxation
of the density requirements of Section 60.24(b) of the Code respecting minimum lot
area for two family houses at 1074 and 1078 Iglehart Avenue, being a tract of land
owned by the Authority located in Ramsey County, Minnesota, described as follows:
Lots nine (9), ten (10) and the East one-half (E.�) of Lot
Eleven (11), Block Ztao (2), A.B. Wilgus Addition to the
City of Saint Paul, according to the plat thereof on file
and of record in the office of the Register of Deeds with-
in and for said County and State.
This tract has 100 feet of frontage on Iglehart and measures lll.b feet in depth to
a 16 foot alley in said Block Z�,io. The Authority proposes to divide the tract into
two lots with 50 foot frontages and lot areas of 5,575 square feet, and to move a
duplex onto each lot. Such action would require a relaxation of the density require-
ments of 425 square feet per lot.
The two duplexes referred to are now located at 1051-1053 and 1057-1059 Iglehart.
These structures, acquired by the AuthoriCy by reason of the necessity to expand
Oxford Playground, are in excellent condition and should not, if at all possible,
be demolished.
Attached to this Appeal are exhibits showing the existing location in red and the
proposed subject sites in blue; the site plan as to the division, of the tract into
two 50 foot front lots; and a new site plan for each house move. The Authority will
let a contract to effect the move and complete the landscaping and site improvements
as indicated.
The Authority requests relaxation of the density requirements of the Zoning Code to
permit the moving and relocation of these structures.

In response to Mr. Bockelman's letter of April 30, 1970, re:
relocated housing, the Model Neighborhood Planning Council `'
passed the following resolution at their May 11 , 1970 meeting:
" The MNPC gives its approval and support to the proposed
zoning variances by the Housing and Redevelopment Authority
for 1074, 1078 Iqlehart, which would ellow two duplexe�
to be moved on to these lots. It is the understanding of
MNPC that the lots are now 425 square feet too small ac-
cording to the City Zoning Codes. Although we hope this
would not set a precedent we feel that the need for these
four dwelling units is such that an exception should be
made in this situation.
The MNPC requests the Zoning Board. and the City Council af
Saint Paul to act on this proposed variance as soon as
possible.
� MNPC understands there is the possibility that if these �
structures are not moved immediately they may not be abie
to be moved at all due to road construction.
It is understood by �•1NPC that before these houses are put
up for sale or rental to the public they be certified as
having the latest plumbing and electrical. input and output."

Gentlemen:
In approving the Early Land Acquisition and Neighborhood Development Programs for the
Suaanit-University Project, the Council expressed a concern for the preservation of
sound housing wherever possible consistent with community planning requirements. In
undertaking the Project the Housing and Redevelopment Authority of the City of Saint
Paul, Minnesota, has followed this direction from the Council.
As an instance, in the acquisition of property of the expansion of Oxford Playground,
the Authority acquired properties on Iglehart Avenue containing two duplexes in sound
condition capable of being moved across Iglehart to lots acquired by the Authority in
the removal of substandard structures.
The Authority has prepared plans and specifications and is prepared to let a contract.
However, a waiver of the density provision of the Zoning Code will be required to
accomplish this move. In that the improvement of Iglehart Street by the City is
scheduled to commence early this aummer, the Authority requests the Council to instruct
all City Departments and Boards to consfder the enclosed Zoning Appeal as expeditiously
as possible.

on Thursday, July 16, 1970, at 2:00 P,M,
PRESENT: Messrs. Amea, Gadler, Maietta, snd Rutzick of the Board, and
Messrs. Brown and Sorenson, Mrs. FranCzen, and Aiiss Sperr of
the staff.
HH�t�WSING AND REDEVELOPMENT AUT'�I08ITY: An anpeal to relax the density reqai�reuaent
to allow two duplexes to be pleced on plota of insufficient area on property
located ou the south side of Iglehart �ivenue between North (}xford Street and
North Lexington Parkway�.
Mr, Sorenson su�narized the staff report, a part of the £ile, noting that the
proposal is to divide the �ite into two equal paxcels and move � duplex onto
each parcel. Each new parcel h�s the requ3red frontage for a duplex, beat not
the required ar.ea. In a "S" ReEidence District a duplex is required to have
a 50-foot frnntage and an area of 6,000 square feet. Ad,joiniug to the west is
an 11-unit apartment; north is Oxfurd Playground which is being enlarged. Two
structures tseing moved onto the site are making iaay for enlsrgement of the
plsyground. `The rest of the area is developed with residential. structures.
In conclusi.on, Mr. Sorenson noted that required density standards are a
reeaon$ble minimum. The subject site would allow one of the duplexes plus
e singLe-family home. The v�riance requested daes not seem to be consisCent
with redevelopment plans. He noted that it is assumed that other sites have
been explored and found unacceptable for the moving of the structures, and
thst the duplexes would be demoli.shed if rhis appeal is not granted. He read
a letter from the Model Cities, which noted thst they give their approval and
support, although they hope this will not set a e�recedent. They feel housing
is needed in this area and, therefore, an excent:�aa sl�oul.�3 be made in this
situation.
Mro GadLer questioned why the duplexes couldn't be moved scross Iglehart Avenue
and why the Housing and Redevelopment Authority is asking to be excused �rom
the law.
Mr. Jim �art, representing the appell.ant, said the cost of moving would be an
additional $1,000 per block; if ehese stxuctur�s �re moved, rehabilitation
wi.11 take place. Ke noted that 1922 standards for a Zonin� Code should�'t
have to be usec3 in all ins�ances. A 2-block r�creat•jon area wi14 be Iocated
across the street. He showed a site plsn for the loca�ioa; park�ng wi11 be
increased from 2 to 3 spaces to meet the standards. The need for this appeal
ia to maintain sound teousing. Oa.ly one alternat� would be possible: to move
the houses across the street; otherwise, they wi11 have to be destroyed.
Market value for esch duplex is estimated at approximately $25,000 for each
duplex.
Mr. Jerry �ockleman, �lso representing the ap�ellant, nc��ed th�t moving �he
houses to an alternate location would involve such a cost th�t it would stot
be practical,

Mr. Do�ald McAdams, 10$9 Iglehart Avenue, lives across the streeC froan the
proposed site. He s$id he is in perfect sgreement with the staff report,
noting that one duplex and one single-family hame should be placed on the
site. He felt that to relax the standards would be a detriment to hia
environment.
Mrso McAdams said an ll�unit apartment building i.s on the other sid� of the
sereet. A houae on the sub3ect land was removed and now the l�nd is vacsnt.
She went on to expLain what houses sze in the imaaediate �rea. 1'heir msin
ob�ectian to the appeal is the fact that they f�el ttiexe won't be enough
room for the two duplexes.
Mr. Hart noted that there would be 18 feet from the line and S fect on the
other side of the duplex. 8conamically, the only feasible ttaing ta do is
to move both duplexes onto the site. Wi.th the expa�sian of the playground,
children from the duplex�s woupd have a pLace to �lay.
In r_onformance wi.th the seaff repart, 2Sre Gac�lpr askerl whet'ner �ne �iuplex
and one single-family home on �he site might be possible.
Mro Maietta moved for approv�l of the appeal, �ince they are nice�-looking
stractures and there wi1L be enaugh room in-betwe�:l. The :no�io�i was
seconded by Mr. Rutzick, anci carried by a 3-1 vote. Mr. �sdler voted in
opposition.
Followiag the vote, Mr, Hart a:;lced that this matter be scheduled for a
Council hearing before the minutes from this meeting are �pproved by the
Zoning Board st t�e August 6, 1970, mee�iizg. Construction of the playground
will start soon,, and they would lilce to move the dupLexes g� soan as possible,
although the construction will go �n around the dupl�xes.
�iro Sorenson explained that Che Board previnusly ruled that minutes should be
approved by thean before matters are scheduled for Council. Mr. SorQnson noted
that the first posaible date for a Council hearing would be Z w��ks fram
today's meeting, which is July 30, 1970, if the Board's rules a�e relaac�d.

Mr, Bockleman aoted that the bid for the cflntr�aetor wiLl be valid for 30 d�ys.
A vote was taken on the matter goxng to Cauncil� in �he shortest poss�ble �ime.
Messrs. 9mes, �Iaietta, and Rutz�.ck voi:�d for the motion, and Mre �adler voted
in oppo�ition.
