W HEREAS, upon receipt of this grant, the City is obligated to appropriate the grant amount of $225,653.00, and
WHEREAS, the financing and spending plans have not been established for the grant received, and
W HEREAS, the Mayor, pursuant to Sec[ion 10.07.1 of the Charter of the City of Saint Paul, does certify that there are available for
appropriations $272,203.00 in funds in excess of those estimated in the 2003 budget; and in accordance with Section 10.07.1 of the

The State of Minnesota has awazded the City of Saint Paul $272,203 to purchase equipment and provide training to enhance the
weapons of mass destrucuon incident response capability. The grant includes a 75% state match of $225,653 and the City is required to

incident response capability of the Saint Paul Police Department. This equipment

sworn officer; a Ppowered Air Puricication Respirator in each marked squad in
their fleet: and equip the Critical Incident Response Team (CIRT)�officers with

The purchase of a SensIR-Tave11R HCI portable HazMat Chemical Identifier will
greatly enhance the Saint Paul Pol2ce and the Department of Fire and Safety
Se�"viEes in responding to Weapons of Mass Destructioxi (WbID) incidents. This
portable chemical lab will give our fisst sesponders . the ability to:_identify a
chemical agent or substance quickly and accurately. The rapid identification
of a substance or material is critical for a safe and effective operation.
The purchase of a Advanced Portable Detector -ADP2000 by the City of Saint
Paiil. will greatly enhance Saint Paul's first responders in responding to WrID
incidents. This portable hand-heldrdetection and monitoring device will detect
nerve and blister agents, recognize pepper spray, mace, and identify hazardous
compounds and is equipped with an integrated radiation dosimeter.

GRANT CONTRACT
This grant contract is between the State of Minnesota, acting through its Commissioner of Public Safety Division of
Emer�ency Manaeement, 444 Cedar 5treet. Suite 223. St. Paul. Minnesota 55101-6223 ("State") and City of St. Paul. 100
East Eleventh Street. St. Paul_ MN 55101. ("Grantee").
Recitals
1. Under Minn. Stat. §§ 12.22 and 299A.01 Subd 2 f41 the State is empowered to allocate and disburse federal aid made
available through the United States Department of Justice and is empowered to enter into this grant conhact.
2. The State is in need of the distribution of federal funds to eligible grant recipients pertaining to the U.S. Department of
Justice (DO� Fiscal Yeaz 2002 Domestic Preparedness Program for the purchase of specialized response equipment.
3. The Grantee represents that it is duly qualified and agrees to perForm all services described in this grant conhact to the
satisfaction of the State.
Grant Contract
1 Term of Grant Contract
1.1 Effective date: May 29. 2003, or the date the State obtains all required signatures under Minnesota Statutes Section
16C.05, subdivision 2, whichever is later.
The Grantee must not begin work under this grant contract until this contract is fiilly executed and the
Grantee has been notified by the State's Authorized Representative to begin the work.
1.2 Expiration date: December 31. 2003, or until all obligations have been satisfactorily fulfilled, whichever occurs
first.
13 Surviva! of Terms. The following clauses survive the expiration or cancellation of this grant contract: 8. Liability;
9. State Audits; 10. Government Data Practices and Intellectual Property; 12. Publicity and Endorsement; 13.
Goveming Law, Jurisdiction, and Venue; and 15. Data Disclosure.
Grantee's Duties
The Grantee, who is not a state employee, will:
2.1 Purchase equipment specified in the 2002 Authorized Equipment Purchase List, labeled Attachment A, which has
been approved by the State, and is attached and incorporated into this grant contract. Crrantee wffl not use more than
25% of the total grant amount to purchase interoperable communications equipment.
2.2 Comply with all program guidelines specified in the State and Federal Domestic Preparedness Equipment and
Training Grant Application Packet provided to the Grantee by the State, and will comply with the standards and
requirements attached and incorporated into this grant contract. These additional standazds and requirements are the
following:
a. Federal Audit Requirements, labeled Attachment B, which is attached and incorporated into this grant contract.
b. Federal Assurances, labeled Attachment C, which is attached and incorporated into this grant contract.
c. Federal Equal Employment Opportunity Plan (EEOP) requirements, labeled Attachment D, which is attached and
incorporated into this grant contract.
23 Provide all necessary h•aiuing to their employees concerning the use of equipment purchased through this grant
contract, and shall not permit the equipment to be tampered with or operated by individuals who aze not properly
trained.
2.4 Assumes total responsibility of the proper handling, use, and maintenance of the equipment and will bear all costs of
maintenance and/or replacement related to equipment.
2.5 Is responsible for any and all costs of repairing or replacing equipment.
2.6 Equipment purchased through this grant contract is the property of the Grantee.
3 Time
The Grantee must comply with all the time requirements described in this grant contract. In the performance of this grant
contract, time is of the essence.
4 Consideration and Payment
4.1 Consideration. The State will pay for all services performed by the Grantee under this grant contract as follows:

(1) Compensation. The Grantee will be paid not more than $86.000.00, in accordance with breakdown of costs
specified in Grantee's Worksheet for 2002 DOJ Equipment Grant, Attachment E, which is attached and
incorporated into tYus grant contract. The Grantee will submit a written change request for any substitution of
equipment in Attachment E or any increase of more than I S% from the approved equipment category amount in
Attachment E. Change requests for substitutions of equipment or increase of more than 15% from the approved
equipment category amount must be given in writing to the State's Authorized Representative and at least 60 days
prior to the Expiration date of this gant contract. Grantees whose requests have been approved will be notified in
writing by the State's Authorized Representative to the Grantee's Authorized Representative_ Requests must be
approved prior to the Grantee's purchase of equipment.
(3) Matching Requiremenu. (If Applicable) Grantee certifies ihat the following matching requirement, for the grant
contract, will be met by the Grantee 0.00.
(4) Tntal Obligation. The total obligation of the State for all compensation and reimbursements to the Grantee under
this grant contract will not exceed 86 000.00.
4.2 Payment
(1) Invnices. The State will promptly pay the Grantee aRer the Grantee presents an itemized invoice for the
services actually performed and the State's Authorized Representative accepts the invoiced services. Invoices
must be submitted timely and according to the following schedule:
a. Grantee will submit itemized invoices for actual costs incurred quarterly, but not more often than monthly
and within 30 days of the period covered by the invoice.
b_ Eacpenditures for each state fiscal year (July through June) of this grant contract must be for equipment
purchased and received within applicable state fiscal yeaz. Final invoice for equipment purchased and
received prior to June 30, 2003 must be received by the State no later than July 31, 2003. Finai invoice for
equipment purchased and received between July 1, 2003 and December 31, 2003 must be received by the
State no later than January 31, 2004.
c. Grantees who are municipalities must comply with municipal bidding laws.
(2) Federal funds. Payments under this grant contract will be made from federal funds obtained by the State
through Title U.S. Office of Justice Programs Fiscal Year 2002 State Domestic Preparedness Equipment
Pr_ograin CFDA number 16.007 of the U.S.A. Patriot Act of 2001, Public Law 107-56. The Grantee is
responsible for compiiance with all federal requirements imposed on these funds and accepts full financial
responsibility for any requirements imposed by the Grantee's failure to comply with federal requirements.
5 CondiHons of Payment
All services provided by the Grantee under this grant contract must be performed to the State's satisfaction, as
detennined at the sole discretion of the State's Authorized Representative and in accordance with all applicable
federal, state, and local laws, ordinances, rules, and regulations. The Grantee will not receive payment for work
found by the State to be unsatisfactory or performed in violation of federal, state, or local law.
6 Authorized Representative
The State's Authorized Representative is Valerie Johnson. Grants S�ecialist. Division of Emereency Mana eg ment
444 Cedaz Street. Suite 223. St. Paui. MN 55101-6623. (6511282-5392, or his/her successor, and has the
responsibility to monitor the Grantee's performance and the authority to accept the senrices provided under this grant
contract. If the services are satisfactory, the State's Authorized Representative will certify acceptance on each
invoice submitted for payment.

7 Assignment, Amendments, Waiver, and Grant Contract Complete
7.1 Assignment The Grantee may neither assign nor transfer any rights or obligations under this grant contract
without the prior consent of the State and a fully executed Assignment Agreement, executed and approved by the
same parties who executed and approved this grant contract, or their successors in office.
7.2 Amendments. Any amendment to this grant contract must be in writing and will not be effective until it has been
executed and approved by the same parties who executed and approved the original grant contract, or their
successors in office.

73 Waiver. If the State fails to enforce any provision of this grant contract, that failure does not waive the provision
or its right to enforce it.
7.4 Grant Contract Complet� This grant contract contains all negotiations and agreements between the State and
the Grantee. No other understanding regazding this grant contract, whether written or oral, may be used to bind
either party.
8 Liability
The Grantee must indemnify, save, and hold the State, its agents, and employees hamiless from any ciaims or causes
of action, including attorney's fees incurred by the State, arising from the performance of this grant contract by the
Grantee or the Grantee's agents or employees. This clause will not be conshved to bar any legal remedies the
Grantee may have for the State's failure to fulfill its obligarions under this grant contract.
9 State Audits
Under Minn. Siat. § 16C.05, subd. 5, the Grantee's books, records, documents, and accounting procedures and
practices relevant to this grant contract aze subject to examination by the State and/or the State Auditor or Legislative
Auditor, as appropriate, for a minimum of six yeazs from the end of this grant contract.
10 Government Data Practices
The Grantee and State must comply with the Minnesota Government Aata Practices Act, Minn. Stat. Ch. 13, as it
applies to all data provided by the State under this grant contract, and as it applies to all data created, collected,
received, stored, used, maintained, or disseminated by the Grantee under this grant contract. The civil remedies of
Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the Grantee or the State.
If the Grantee receives a request to release the data referred to in this Clause, the Grantee must immediately notify
the State. The State will give the Grantee instructions concerning the release of the data to the requesting party
before the data is released.
11 Workers' Compensation
"The Grantee certifies that it is in compliance with Minn. Stat.§ 176.181, subd. 2, pertaining to workers'
compensation insurance coverage. The Grantee's employees and agents will not be considered State employees.
Any claims that may arise under the Minnesota Workers' Compensation Act on behalf of these employees and any
claims made by any third party as a consequence of any act or omission on the part of these employees are in no way
the State's obligation or responsibility.
12 Publicity and Endorsement
12.1 Publicity. Any publicity regazding the subject matter of this grant contract must identify the State as the
sponsoring agency and must not be released without prior written approval from the State's Authorized
Representative. For purposes of this provision, publicity includes notices, informational pamphlets, press
releases, reseazch, reports, signs, and similar public notices prepared by or for the Grantee individually or j ointly
with others, or any subcontractors, with respect to the program, publications, or services provided resulfing from
this grant contract.
12.2 Endorsement. The Grantee must not claim that the State endorses its products or services.
13 Governing Law, Jurisdiction, and Venue
Minnesota law, without regard to its choice-of-law provisions, governs this grant contract. Venue for all legal
proceedings out of this grant contract, or its breach, must be in the appropriate state or federal court with competent
jurisdiction in Ramsey County, Minnesota.
14 Termination
14.1 Termination by the State. The State may cancel this grant contract at any time, with or without cause, upon 30
days' written notice to the Grantee. Upon termination, the ('nantee will be entitled to payment, determined on a
pro rata basis, for services satisfactorily performed.
14.2 Termination for Insufficient Funding. The State may immediately terminate this grant contract if it does not
obtain funding from the Minnesota Legislature, or other funding source; or if funding cannot be continued at a
level sufficient to allow for the payment of the services covered here. Termination must be by written or fax

notice to the Grantee. The State is not obligated to pay for any services that are provided after notice and
effective date of termination. However, the Grantee will be entitled to payment, determined on a pro rata basis,
for services sarisfactorily performed to the extent that funds aze available. The State will not be assessed any
penalfy ifthe grantcontractisterminated because ofthe decision ofthe Minnesota Legislature,or otherfunding
source, not to appropriate funds. The State must provide the Grantee notice of the lack of funding within a
reasonable time of the State receiving that notice_
143 Termination for Failure to Comply. The State may cancel this grant contract immediately if the State fmds that
there has been a failure to comply with the provisions of ttus grant, that reasonable progress has not been made or
that the purpose for which the funds were granted have not been or will not be fulfilled, the State may take action
to protect the interests of the State of Minnesota, including the refusal to disburse additional funds and requiring
the retum of all or part of the funds already disbursed.
15 Data Disclosure
Under Minn. Stat.§ 270.66, and other appiicable law, the Grantee consents to disclosure of its social securiry number,
federal employer taac identification number, ancUor Minnesota taac idenfification number, already provided to the
State, to federal and state tax agencies and state personnel involved in the payment of state obligations. These
identification numbers may be used in the enforcement of federal and state tax laws which could result in action
requiring the Grantee to file state tax rehuns and pay delinquent state tax liabiliries, if any, or pay other state
liabilities.

2002 Authorized Equipmenf Purchase List
The 2002 State Domestic Preparedness Program authorized equipment purchase list was derived from the Standasdized
Equipment List (SEL). The SEL was developed by the interagency Board (IAB) for Equipment Standardization and
Interoperability. The IAB compiled the SEL to delineate the types of equipment necessary for terrorist incident response.
Because the SEL also contains lists of general use and support equipment, a more narrow list was derived from the SEL fo
idenfify the spec�c types of specialized equipment authorized for purchase under the 2002 State Domestic Preparedness
Program. A cross-section of o�ciais representing the U.S. Department of Justice (OJP and FBI), the Public Heaith Service
(PHS), the Federal Emergency Management Agency (FEMA), the U.S. Department of Energy (DOE), and State and Iocai
WMD response experts assisted in the development of this authorized equipment purchase list and in identifying unaliowable
items.
Authorized equipment purchases may be made in the fo4lowing categories:

1. Personal Protective Equipment - Equipment worn to protect the individual from hazardous materials and
contamination. Levels of protection vary and are divided into three categories based on the degree of protection afforded.
The following constitutes equipment intended for use in a chemical/biological threat environment:
Level A. Fuily encapsulated, liquid and vapor protective ensemble selected when the highest Ievel of skin, respiratory
and eye protection is required. The following constitutes Level A equipment for consideration:
. Fully Encapsulated Liquid and Vapor Protection Ensemble, reusable or disposable (tested and cert�ed against CB
threats)
� Fuliy Encapsulated Training Suits
. Testing Equipment for fully encapsulated suits
• Closed-Circuit Rebreather (minimum 2-hour supply, preferred), or open-circuit SCBA or, when appropriate, Air-Line

Level D. Selected when no respiratory protection and minimal skin protection is required, and the atmosphere contains
no known hazard and work functions preclude splashes, immersion, or the potential for unexpected inhalation of, or
contact with, hazardous Ievels of any chemicals.
• Escape mask for self-rescue
Note: During WMD response operations, the incident commander determines the appropriate level of personal protective
equipment. As a guide, Levels A, B, and C are applicable for chemical/ biological/ radiological contaminated environments.
Personnel entering protective postures must undergo medical monitoring prior to and after entry.
In addition, the National Fire Protection Association (NFPA) recommends that: 1) open-circuit chemical, biological,
radiologicai and nuclear (CBRN) SCBA be certified by NIOSH as positive pressure (pressure demand) and also as compliant
with NFPA 1981, Standard for Open-Circuit Self-Contained Breathing Apparatus for Fire and Emergency Services; 2) regular
open-circuit SCBA be certified by NIOSH as positive pressure (pressure demand) and also as compliant with NFPA 1981,
Standard for Open-Circuit Self-Contained Breathing Apparatus for Fire and Emergency Services; and, 3) closed-circuit SCBA
should be certified by NIOSH as positive pressure (pressure demand) and have a rated service life of longer than 2 hours.
Further, NFPA recommends that grant recipients should purchase: 1) protective ensembles for chemical and biological
terrorism incidents that are certified as compliant with Class 1, Class 2, or Class 3 requirements of NFPA 1994, Protective
Ensembles for ChemicallBiological Terrorism Incidents; 2) protective ensembles for hazardous materials emergencies that
are certified as compliant with NFPA 1991, Standard on Vapor Protective Ensembles for Hazardous Materials Emergencies,
including the chemical and biological terrorism protection; 3) protective ensembles for search and rescue or search and
recovery operations where there is no exposure to chemicai or biological warfare or terrorism agents and where exposure to
flame and heat is unlikely or nonexistent that are certified as compliant with NFPA 1951, Standard on Protective Ensemble

for USAR Operations; and, 4) protective ciothing from biood and body fluid pathogens for persons providing treatment to
victims after decontamination that are certified as compliant with NFPA 1999, Standard on Protective Clothing for Emergency
Medical Operations.

FEDERAL AUDIT REQUIREMENTS
For subrecioients that are state or local qovernments non-orofit oraanizations or Indian tribes
If the grantee expends totalfederal assistance of $300,000 or more per year,the grantee agrees to obtain either a
single audit or a program-spec�c audit made for the fiscal year in accordance with the terms of the Single Audit Act
Amendments of 1996.
Audits shall be made annually unless the state or local government has, by January 1, 1987, a constitutional or
statutory requirement for less frequent audits. For those governments, the federal cognizant agency shall permit
biennial audits, covering both years, if the government so requests. It shall aiso honor requests for biennia( audits by
governments that have an administrative policy caliing for audits less frequent than annual, but only audits prior to
1987 or administrative policies in place prior to January 1, 1987.
For subrecioients that are institutions of hiaher education or hospitals
If the grantee expends total direct and indirect federal assistance of $300,000 or more per year, the grantee agrees
to obtain a financial and compliance audit made in accordance with OMB Circular A-110 "Requirements for Grants
and Agreements with Universities, Hospitals and Other Nonprofit Organizations" as applicable. The audit shall cover
either the entire organization or all federai funds of the organization.
The audit must determine whether the subrecipient spent federal assistance funds in accordance with applicable
laws and regulations.
2. The audit shall be made by an independent auditor. An independent auditor is a state or local government auditor or
a public accountant who meets the independence standards specified in the General Accounting O�ce's �Standards
for Audit of Governmental Organizations, Programs, Activities, and Functions."
3. The audit report shall state that the audit was performed in accordance with the provisions of OMB Circular A-133 (or
A-110 as applicable).
The reporting requirements for audit reports shall be in accordance with the American Institute of Certified Public
Accounts' (AICPA) audit guide, "Audits of State and Locai Governmental Units," issued in 1986. The federal
government has approved the use of the audit guide.
In addition to the audit report, the recipient shall provide comments on the findings and recommendations in the
report, including a plan for corrective action taken or planned and comments on the status of corrective actibn taken
on prior findings. If corrective action is not necessary, a statement describing the reason it is not should accompany
the audit report.
4. The grantee agrees that the grantor, the Legislative Auditor, the State Auditor, and any independent auditor
designated by the grantor shall have such access to grantee's records and financial statements as may be necessary
for the grantor to comply with the Single Audit Act Amendments of 1996 and OMB Circular A-133.
5. Grantees of federal financial assistance from subrecipients are aiso required to comply with the Single Audit Act and
OMB Circular A-133.

FEDERAL ASSURANCES

federally assisted programs. These requirements apply to all interests in real property acquired for project
purposes regardiess of federal participation in purchases. For acquisition/relocafion projects funded as a
result of the FEMA-1370-DR presidentiai disaster declazation, the purchase of any real properly under a
qualified buy-out program shall not constitute the making of Federal financial assistance available to pay all
or part of the cost of a program or project resulting in the acquisition of real property or in any owner of real
property being a displaced person (within the meaning of the Uniform Relocation Assistance and Real
Properiy Acquisition Policies Act of 1970).
5. Grantee will comply, as applicable, with the provisions of the Copeland "Anti-Kickback" Act (18 USC

1 Term of Grant Contract

2 Grantee's Duties
The Grantee, who is not a state employee, will:
2.1 Purchase equipment specified in the 2002 Authorized Equipment Purchase List, labeled Attachment A, which has
been approved by the State, and is attached and incorporated into this grant contract. Grantee will not use more
than 25% of the total grant amount to purchase interoperable communications equipment.
22 Comply with all pro�azii guidelines specified in the State and Federal Domestic Preparedness Equipment and
Tranling Grant Application Packet provided to the Grantee by the State, and will comply with the standards and
requirements attached and incorporated into this grant contract.
2.3 Provide all necessary training to their employees conceming the use of equipment purchased through this grant
contract, and shall not permit the equipment to be tampered with or operated by individuals who aze not properly
trained.
2.4 Assumes total responsibility of the proper handling, use, and manitenance of the equipment and will bear all costs
of maintenance and/or replacement related to equipment.
2.5 Is responsi`ble for any and all costs of repairing or replacing equipment.
2.6 Equipment purchased through this grant contract is the property of the Grantee.
3 Time
The Grantee must comply with all the time requirements described in this grant contract. In the performance of this
grant contract, tune is of the essence.
4 Considerafion and Pay�ent
41 Consideration. The State will pay for a11 services performed by the Grantee under this grant contract as follows:
(1) Compensation. The Grantee will be paid not more than $39.038.00, in accordance with breakdown of costs
specified in Grantee's Worksheet for 2002 State Equipment Grant, Attachment B, which is attached and
incorporated into this grant contract. The Grantee will submit a written change request for any substitution

of equipment in Attachment B or any increase of more than 15% from the approved equipment category
amounts in Attachment B. Change requests for substitutions of equipment or increase of more than 15%
from the approved equipment category amounts must be given in writing to the State's Authorized
Representative and at least 60 days prior to the Expirarion date of this grant contract. Grantees whose
requests have been approved will be notified in writing by the State's Authoriaed Representative to the
Grantee's Authorized Representative. Requests must be approved prior to the Grantee's purchase of
equipment.
Matching Requirement.r. Grantee certifies that the following matching requirement, for the grant contract,
will be met by the Grantee: $13.012.00.
Total Obligation. The total obligation of the State for all compensation and reimbuisements to the Grantee
under this grant contract will not exceed $39.038.00.
4.2 Payment
(1) Invoices. The State will promptly pay the Grantee after the Grantee presents an itemized invoice for the
services actually performed and the State's Authorized Representative accepts the invoiced services.
Invoices must be submitted timely and according to the following schedule:
a. Grantee will submit itemized invoices for actual costs incurred quarterly, but not more often than monthly
and within 30 days of the period covered by the invoice. �
b. Expenditures for each state fiscal year (July through June) of this grant contract must be for equipment
purchased and received within applicable state fiscal year. Final invoice for equipment purchased and
received prior to 7une 30, 2003 must be received by the State no later than July 31, 2003. Final invoice
for equipment purchased and received between July 1, 2003 and December 31, 2003 must be received
by the State no later than January 31, 2004.
c. Grantees who aze municipalities must comply with municipal bidding laws.
(2) Federal funds. (Where applicable, if blank this section does not apply) Payments under this grant contract
wiil be made from federal funds obtained by the State through Title CFDA number of
the Act of . The Grantee is responsible for compliance with all federal requirements
imposed on these funds and accepts full fmancial responsibility for any requirements imposed by the
Grantee's failure to comply with federal requirements.
5 Conditions of Payment
All services provided by the Grantee under this grant contract must be performed to the State's satisfaction, as
detemuned at the sole discretion of the State's Authorized Representative and in accordance with all applicable
federal, state, and local laws, ordinances, rules, and regutations. The Grantee will not receive payment for work
found by the State to be unsatisfactory or performed 'm violafion of federal, state, or local law.

Assignment, Amendments, Waiver, and Grant Contract Complete
7.1 Assignment The Grantee may neither assign nor transfer any rights or obligations under this grant contract
without the prior consent of the State and a fully executed Assignment Agreement, executed and approved by
the same parties who executed and approved this grant contract, or their successors in office.
7.2 Amendments. Any amendment to this grant contract must be in writing and will not be effective until it has
been executed and approved by the same parties who executed and approved the original grant contract, or
their successors in office.

73 Waiver. If the State fails to enforce any provision of this grant contract, that failure does not waive the
provision or its right to enforce it.
7.4 G�ant Contract Complet� This grant contract contains ali negotiations and agreements between the State and
the Grantee_ No other understanding regarding this grant contract, whether written or oral, may be used to
bind either party.
Liability
The Grantee must indemnify, save, and hold the State, its agents, and employees harmless from any claims or
causes of action, uicluding attorney's fees incurred by the State, arising from the perfoimance of this grant contract
by the Grazitee or the Grantee's agents or employees. This clause will not be conshued to bar any legal remedies
the Grantee may have for the State's failure to fulfill its obligations under this grant conhact.
9 State Audits
Under Minn. Stat. § 16C.05, subd. 5, the Grantee's books, records, documents, and accounting procedures and
practices relevant to this grant contract aze subject to exaznination by the State and/or the State Auditor or
Legislafive Auditor, as appropriate, for a m;.,;.,,� of six years from the end of this grant contract.
10 Government Data Practices
The Grantee and State must comply with the Minnesota Govemment Data Practices Act, Minn. Stat. Ch. 13, as it
applies to all data provided by the State under this grant contract, and as it applies to all data created, collected,
received, stored, used, maintained, or disseminated by the Grantee under this grant contract. The civil remedies of
Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the Grantee or the State.
If the Grantee receives a request to release the data referred to in this Clause, the Grantee must immediately notify
the State. The State will give the Grantee instructions concerning the release of the data to the requesting pariy
before the data is released.
11 Workers' Compensation
The Grantee certifies that it is in compliance with Minn. Stat. § 176.181, subd. 2, pertaining to workers'
compensation insurance coverage. The Grantee's employees and agents will not be considered State employees.
Any clauns that may arise under the Minnesota Workers' Compensation Act on behalf of these employees and any
claims made by any third party as a consequence of any act or omission on the part of these employees aze in no
way the State's obligation or responsibility.
12 Publicity and Endorsement
12.1 Publicity. Any publicity regarding the subj ect matter of this grant contract must identify the State as the
sponsoring agency and must not be released without prior written approval from the State's Authorized
Representative. �'or purposes of this provision, publicity includes notices, informational pamphlets, press
releases, research, reports, signs, and similaz public notices prepazed by or for the Grantee individually or
jointly with others, or any subcontractors, with respect to the program, publications, or services provided
resulting from this grant contract.
12.2 Endorsement. The Grantee must not claim that the State endorses its products or services.
13 Governing Law, Jurisdiction, and Venue
Minnesota law, without regard to its choice-of-law provisions, govems this grant contract. Venue for all legal
proceedings out of this grant contract, or its breach, must be in the appropriate state ar federal court with competent
jurisdiction in Ramsey Counry, Minnesota.
14 Terminarion
14.1 Termination by the State. The State may cancel this grant contract at any time, with or without cause, upon
30 days' written notice to the Grantee. Upon temunation, the Grantee will be entitled to payment, determined
on a pro rata basis, for services satisfactorily performed.
14.2 Termination for Insufficient Funding. The State may unmediately terminate this grant contract if it does
not obtain funding from the Minnesota Legislature, or other funding source; or if funding cannot be continued

at a level sufficient to allow for the payment of the services covered here. Tetmination must be by written or
fax notice to the Grantee. The State is not obligated to pay for any services that aze provided after notice and
effective date of temunation. However, the Grantee will be entitled to payment, determined on a pro rata basis,
for services satisfactorily performed to the extent that funds are available. The State will not be assessed any
penalty if the gant contract is terminated because of the decision of the Minnesota Legislature, or other
funding source, not to appropriate funds. The State must provide the Grantee notice of the lack of funding
within a reasonable time of fhe State receiving that notice.
143 Terminakon for Failure to Comply_ The State may cancel this grant contract unmediately if the State finds
that there has been a faIlure to coruply with the provisions of this graui, that reasonable progress has not beeu
made or that the purpose for which the funds were granted have not been or will not be fiilfilled, the State may
take action to protect the interests of the State of Minnesota, including the refusal to disburse additional funds
and requiiiug the rehun of all or part of the funds already disbursed.
15 Data Disclosure
Under Minn. Stat. § 270.66, and other applicable law, the Grantee consents to disclosure of its social security
number, federal employer tax identification number, and/or Minnesota tax identificarion number, already provided
to the State, to federal and state tax agencies and state personnel involved in the payment of state obligations.
These identification numbers may be used in the enforcement of federal and state tas laws which could result in
action requiring the Grantee to file state tas returns and pay delinquent state taac liabilities, if any, or pay other state
liabilities.

2002 Authorized Equipment Purchase List
The 2002 State Domestic Preparedness Program authorized equipment purchase list was derived from the Standardized
Equipment List (SEL). The SEL was developed by the Interagency Board (IAB) for Equipment Standardization and
Interoperability. The IAB compiled the SEL to delineate the types of equipment necessary for terrorisf incident response.
Because the SEL aiso contains lists of general use and support equipment, a more narrow list was derived from the SEL
to identify the spec�c types ofi specialized equipment authorized for purchase under the 2002 State Domestic
Preparedness Program. A cross-section of officiais representing the U.S. Department of Justice (OJP and FBI), the Public
Health Service (PHS), the Federal Emergency Management Agency (FEMA), the U.S. Department of Energy (DOE), and
State and local W MD response experts assisted in the development of this authorized equipment purchase list and in
identifying unallowable items.
Authorized equipment purchases may be made in the following categories:

Level D. Selected when no respiratory protection and minimal skin protection is required, and the atmosphere
contains no known hazard and work functions preciude splashes, immersion, or the potential for unexpected inhalation

Escape mask for self-rescue
Note: During WMD response operations, the incident commander determines the appropriate level of personal protective
equipment. As a guide, Levels A, B, and C are applicable for chemical/ biologicai/ radiological contaminated environments.
Personnel entering protective postures must undergo medical monitoring prior to and after entry.
In addition, the National Fire Protection Association (NFPA) recommends that: 1) open-circuit chemical, biological,
radiological and nuclear (CBRN) SCBA be certified by NIOSH as positive pressure (pressure demand) and also as
compliant with NFPA 1981, Standard for Open-Circuit Self-Contained Breathing Apparatus for Fire and Emergency
Services; 2) regular open-circuit SCBA be certified by NIOSH as positive pressure (pressure demand) and also as
compiiant with NFPA 1981, Standard for Open-Circuit Self-Contained Breathing Apparatus for Fire and Emergency
Services; and, 3) closed-circuit SCBA should be certified by NIOSH as positive pressure (pressure demand) and have a
rated service life of longer than 2 hours.
Further, NFPA recommends that grant recipients should purchase: 1) protective ensembles for chemical and biological
terrorism incidents that are certified as compliant with Class 1, Class 2, or Class 3 requirements of NFPA 1994, Protective
Ensembles for Chemical(Biological Terrorism Incidents; 2) protective ensembles for hazardous materials emergencies that
are certified as compiiant with NFPA 1991, Standard on Vapor Protective Ensembles for Hazardous Materials
Emergencies, including the chemical and biological terrorism protection; 3) protective ensembles for search and rescue or
search and recovery operations where there is no exposure to chemical or biological wartare or terrorism agents and
where exposure to flame and heat is unlikely or nonexistent that are certified as compliant with NFPA 1951, Standard on
Protective Ensemb{e for USAR Operations; and, 4) protective ciothing from blood and body fluid pathogens fior persons
providing treatment to victims after decontamination that are certified as compiiant with NFPA 1999, Standard on

MAJOR OBJECTIVES (Please explain how the equipment request�
enhance your jurisdiction's ability to respond to a WMD incident).
The purchase of a SensIR-Tave11R HCI portable Ha2Mat Chemical Identifier will
greatly enhance the Saint Paul Police and the Department of Fire and Safety
Seivices in responding to Weapons of Mass Destruction (WhID) incidents. This
portable chemical lab will give our first responders the ability to identify a
chemical agent or substance quickly and accurately. The rapid identification
of a substance or material is critical for a safe and effective operation.
The purchase of a Advanced Portable Detector -ADP2000 by the City of Saint
Pa�il will greatly enhance Saint Paul's first responders in responding to WNID
incidents. This portable hand-held�detection and monitoring device will detect
nerve and blister agents, recognize pepper spray, mace, and identify hazardous
compounds and is equipped with an integrated radiation dosimeter.

_ Recitals
1 Under Minn. Stat. § 12.22 and 299A.01 Subd 2(41 the State is empowered to enter into this grant contract.
2 State funds for this grant contract aze provided under the Laws of Minnesota 2002, Chapter 401, Article 2, Section 1,
Subd 3 for tesorism response-re2ated training.
3 The State is in need of the dishibution of State funds to eligible grant recipients for terrorism response-related training.
4 The Grantee represents that it is duly qualified and agrees to perform all services described in this grant contract to the
satisfaction ofthe State.
Grant Contract
1 Term of Grant Contract
1.1 Effective date: Tune 3. 2003, or the date the State obtains all required signatures under Minnesota Statutes Section
16C.05, subdivision 2, whichever is later.
The Grantee must not begin work under this grant contract until this contract is fully executed and the
Grantee has been notified by the State's Authorized RepresentaHve to begin the work.
1.2 F,xpirauon date: December ��31 2003, or un61 all obligations have been satisfactorily fulfilled, whichever occurs

1.3 Survival of Terms. The following clauses survive the expiration or cancellation of tlus grant contract: 8. Liability;

2 Grantee's Duties
The Grantee, who is not a state employee, will:
2.1 Perform the services and tasks for terrorism response-related tranung as submitted and approved by the State in
Cttautee's Worksheet for 2002 State WMD Training Grant, labeled Attachment A, which is attached and
incorpomted into tlus grant contract.
2.2 Comply with all prograzn guidelines specified in the 2002 State and Federal Domestic Prepazedness Equipment and
Trnining Grant Application Packet provided to the Grantee by the State, and will compiy with the standazds and
requirements attached and incoiporated into this grant contract.
3 Time
The Grantee must compiy with all the time requirements described in this grant contract. In the perfonnance of this
grant contract, rime is of the essence.
4 Consideration and Payment
41 Considerarion. The State will pay for all services performed by the Grantee under this grant contract as follows:
(1) Compensa[ion. The Grantee will be paid not more than $134.153.00, in accordance with breakdown of costs
specified in Cnantee's Worksheet for 2002 State WMD Trainiug Grant, Attachment A, which is attached and
incorporated into this grant contract. The Grantee will submit a written change request for any proposed
ct�ange to the approved iraining in Attachment A or any increase of more than 15% from the approved
bud�et category amounts nt Attachment A. Change requests for any proposed change to the approved
training or any increase of more than 15% from the approved budget category amounts must be given in
writing to the State's Authorized Representative and at least 60 days prior to the Expiration date of this grant
contract. Grantees whose requests have been approved will be notified in writing by the State's Authorized
Representative to the Grantee's Aufihorized Representative. Requests must be approved prior to the

Grantee's purchase of services.
(2) Matching Requirements. Grantee certifies that the following matching requirement, for the grant contract
will be met by the Grantee: .00.
(3) Total Obligation. The total obligation of the State for all compensation and reimbursements to the Grantee
under this grant contract will not exceed $134.153.00.
42 Payment
(1) Invoices. The State will promgtly pay the Grantee after the Grantee presents an itemized invoice for the
services actually performed and the State's Authorized Representative accepts the invoiced services.
Invoices must be submitted timely and according to the following schedule:
a. Grantee will submit itemized invoices for actual costs incurred quarterly, but not more often than monthly
and within 30 days of the period covered by the invoice.
b. Expenditures for each state fiscal year (July through June) of this grant contract must be for services
provided within applicable state fiscal year. Finai invoice for services provided prior to June 30, 2003
must be received by the State no later than July 31, 2003. Final invoice for services provided between
July 1, 2003 and December 31, 2003 must be received by the State no later than January 31, 2004.
(2) Federal funds. (Where applicable, if blank this section does not apply) Payments under this grant contract
will be made from federdl funds obtained by the State through Title CFDA number of
the Act of . The Grantee is responsible for compliance with all federal requirements
imposed on these funds and accepts full financial responsibility for any requirements imposed by the
Grantee's failure to comply with federal requirements.
5 Conditions of Payment
All services provided by the ('nantee under this grant contract must be performed to the State's satisfaction, as
deternvned at the sole discretion of the State's Authorized Representative and in accordance witti alI applicable
federal, state, and local laws, ord'mances, rules, and regulations. The Grantee will not receive payment for work
found by the State to be unsatisfactory or performed in violation of federal, state, or local law.
6 Authorized Representative
The State's Authorized Representative is Valerie Johnson. Grants Soecialist Division of Emerpencv Manaeement
444 Cedaz Street. Suite 223. St. Paul MN 55101-6223 (651) 282-5392, or his/her successor, and has the
responsibility to monitor the Grantee's performance and the authoriry to accept the services provided under this
grant contract. If the services aze satisfactory, the State's Authorized Representative will certify acceptance on each
invoice submitted for payment.

MN 55101. (6511228-6212. If the Grantee's Authorized Representative changes at any time during this grant
contract, the Grantee must immediately notify the State.
7 Assignmenf, Amendmenfs, Waiver, and Grant Contract Complete
7.1 Assignment The Grantee may neither assign nor transfer any rights or obligations under this grant contract
without the prior consent of the.State and a fully executed Assignment Agreement, executed and approved by
the same parties who executed and approved tlus grant contract, or their successors in office.
7.2 Amendments. Any amendment to this grant contract must be in writing and will not be effective until it has
been executed and approved by the same parties who executed and approved the original grant contract, or
their successors in office.
73 Waiver. If the State fails to enforce any provision of this grant contract, that failure does not waive the
provision or its right to enforce it.
7.4 Grant Contract Complete. This grant contract contains all negotiations and agreements between the State and
the Grantee. No other understanding regarding this grant contract, whether written or oral, may be used to
bind either party.

Liability
The Grantee must indemnify, save, and hold the State, its agents, and employees harmless from any claims or
causes of action, including attomey's fees incurred by the State, arising from the performance of trus grant contract
by the Grantee or the Grazitee's agents or employees. This clause will not be construed to bar any legal remedies
the Grantee may have for the State's failure to fulfill its obligations under this grant contract.
9 State Audits
Under Minn. Stat. § 16C.05, subd: 5, the Grantee's books, records, documents, and accounting procedures and
practices relevant to this grant contract aze subject to exainination by the State and/or the State Auditor or
Legisla6ve Auditor, as appropriate, for a ininimum of six years from the end of this grant contract.
10 Government Data Practices
The Grantee and State must comply with the Minnesota Government Data Practices Act, Minn. Stat. Ch. 13, as it
applies to all data provided by the State under this grant contract, and as it applies to all data created, collected,
received, stored, used, maintained, or disseminated by the Grantee under this gant contract. The civil remedies of
Minn. Stat. § 13.08 apply to the release of the data referred to in this clause by either the Cn antee or the State.
If the Grantee receives a request to release the data referred to in this Clause, the Grantee must immediately notify
the State. The State will give the Grantee inshuctions conceming the release of the data to the requesting party
before the data is released.
11 Workers' Compensarion
The Grantee certifies that it is in compliance with Minn. Stat. ,§ 176.181, subd. 2, pertairung to workers'
compensation insurance coverage. The Grantee's employees and agents will not be considered State employees.
Any claims that may arise under the Minnesota Workers' Compensation Act on behatf of these employees and any
clauns made by any third pazty as a consequence of any act or omission on the par[ of these employees aze in no
way the State's obligation or responsibility.
12 Publicity and Endorsement
12.1 Publicity. Any publicity regazding the subj ect matter of this grant contract must identify the State as the
sponsoring agency and must not be released without prior written approval from the State's Authorized
Representative. For purposes of this provision, publicity includes notices, infomiational pamphlets, press
releases, research, reports, sigis, and sittrilar public nofices prepared by or for the Grantee individually or
jointly with others, or any subcontractors, wiih respect to the program, publications, or services provided
resulting from this grant contract.
12.2 Endorsement. The Grantee must not claun that the State endorses its products or services.
13 Governing Law, Jurisdiction, and Venue
Minnesota law, without regard to its choice-of-law provisions, governs this grant contract. Venue for all legal
proceedings out of this grant contract, or its breach, must be in the appropriate state or federal court with competent
jurisdicrion in Ramsey County, Minnesota.
14 Termination
14.1 Termination by the Statz The State may cancel this grant contract at any time, with or without cause, upon
30 days' written no6ce to the Grantee. Upon termination, the Grantee wiil be enfltled to payment, deternuned
on a pro rata basis, for services satisfactorily performed.
142 Terminafron for Insuffzcient Punding. The State may immediately temunate this grant contract if it does
not obtain funding from the Minnesota Legislature, or other funding source; or if funding cannot be continued
at a level sufficient to allow for the payment of the services covered here. Tennniation must be by written or
fax notice to the Grantee. The State is not obligated to pay for any services that are provided after notice and
effective date of ternunation. However, the Grantee will be entitled to payment, detemuned on a pro rata basis,
for services satisfactorily performed to the extent that funds ue available. The State will not be assessed any

penalty if the gant contract is temunated because of the decision of the Minnesota Legislature, or other
funding source, not to appropriate funds. The State must provide the Grantee notice of the lack of funding
within a reasonable time of the State receiving that notice.
143 Terminadon for Failure to Comp[y. The State may cancel this grant contract unmediately if the State finds
that there has been a failure to comply with the provisions of this grant, that reasonable progress has not been
made or tfiat the purpose for which the funds were granced have not been or wilI not be fulfilIed, the State may
take action to protect the interests of the State of Minnesota, including the refusal to disburse additional funds
and requiring the return of all or part of the funds already disbursed.
15 Data Disclosure
Under Minn. Stat. ,§ 270.66, and other applicable law, the Grantee consents to disclosure of its social security
number, federal employer taac identification number, and/or Minnesota tax identification number, already provided
to the State, to federal and state taac agencies and state personnel involved in the payment of state obligations.
These identification numbers may be used in the enforcement of fedeial and state tax laws which could result in
action requiring the Grantee to file state tax retarns and pay delinquent state taac liabilities, if any, or pay other state
liabilities.

Ensure all first responders have a basic working knowiedge of WMD/NBC concepYs, principies, and operations.
Train aIl first responders in the concepts, wearing, care, and use of PPE in appropriate situations.
Train selected law enforcement personnel in the concepts and principles of using Level A equipment to conduct
operations in contaminated areas.
Provide Incident Management and Incident Command training to law enforcement personnel who would find
themselves in a command role during an WMD/NBC incident.
Provide advanced concepts training in WMD/NBC response and operations.
