WHEREAS, The City of Saint Paul and the County of Ramsey have
entered into a cooperative agreement, dated April 7, 1966, for the
acquisition of certain property by condemnation which is adjacent
to White Bear Avenue from Idaho Avenue to Larpenteur Avenue; and
WHEREAS, The agreement specified tha.t the City of Saint Paul
would pay the Treasurer of Ramsey County any funds necessary for
the acquisition; and
WHEREAS, The County has proceeded with condemnation pursuant
to the procedure outlined in Minnesota Statutes §� 117.01, et
sequa; Commissioners ha.ve been appointed and ha.ve made an award of
$14,000.00 as to Parcel No. lA which was stated to be owned by
D p Hillcrest Super Food Market, Inc. , Melvin Roth, and Ruth M. Roth,
� and leased, in part, by Dona.ld R. Beaudet, Hillcrest Produce
� Compa.ny, and General Food Market, Inc. , of St. Paul; and

o WHEREAS� Dona.ld R. Beaudet, as a tenant, ha.s no interest in
a the condemned property; Hillcrest Produce Company, as a former
� < < building tenant, has no interest in such; General Food Ma.rket, Inc. ,
� � ha.s no present interest in such; and the Hillcrest Super Food
� Ma.rket, Inc. , is now extinct and previously was solely owned by
� Melvin Roth and Ruth Roth, and said parties as original owners and
successors ha.ve presented a demand for the payment of three-
qua.rters of the award to them under Minnesota Statutes � 117.20�
Subdivision 5, pending their appeal from the award, which payment
has been approved and the request made by the County of Ramsey �or
the City�s payment of it pursua.nt to the Contract between the City
and County;
NOW, THEREFORE, BE IT RESOLVED, That the proper City officers are
authorized and directed to make a prepayment of the award to the
extent of $10,500.00, such prepayment as provided by the City-
County agreement, to be ma.de to the County of Ramsey, Melvin Roth,
and Ruth M. Roth and to be charged to PIR Fund 6000, to be reimbursed
from County Aid Funds . AUG 1 1 1970
