That the petiuoner shall pay all costs and expenses for any reconstruction of the Forbes-Smith and Forbes-West Seventh intersecuons including but not limited to costs for new curbs, sidewalks, boulevards, storm drains and street sign removal, that may be necessary to properly eliminate the appearance of a public thoroughfaze, all to the satisfaction of the Department of Public Works. That the petiuoner shall be responsible for the costs and expenses of rerouting the existing catch basin on West Seventh Street just south of the vacated area, as well as any street grade changes that may be necessary to properly drain the intersections of Forbes at West Seventh and Forbes at Smith, all to the satisfacuon of the Department of Public Works. -. � o3-s� 1 5_ The two e�sting catch basins within the vacated azea of Forbes wouid become the responsibility 2 of the propeny owners. 3 4 6. That the City of Saint Paul Department of Public Works wilI retain a permanent 20 foot 5 subterranean easement between the elevations of 50.00 feet and 60.00 feet City datum, centered 6 on the center line of the existing sanitary sewer main. 7 8 7. That the petitioners shall be responsibie for abandoning the two poles that feed City street lights, 9 and shall also install new lighting conduit on the east side of Smith Avenue when new curbing is 10 installed. ll 12 8. That, on behalf of the Board of Water Commissioners of the City of Saint Paul, a permanent 13 utility easement shall be retained on, over, under and across the vacated area to reserve the right 14 of the Boazd to maintain and operate any water facility in, on or upon said easement, and to enter 15 upon said easement or any portion thereof at any time, and from time to time for the purposes of 16 future construction, reconstruction, inspecuon, maintenance or repair of the same or any part 17 thereof. No buildings, structures, trees or any temporary structure, material storage, fixture, or other object that may prohibit normal access to water facilities for maintenance purposes will be permitted within the easement azea. b. With written permission from the Saint Paui Regional Water Services improvements in or upon the above described easement that do not prohibit or limit the full and free exercise by the Saint Paul Regional Water Services of its reserved rights may be allowed, with the understanding that the restoration and costs of such improvements, should the Water Services exercise its easement rights, shall be the sole responsibility of the fee owner, its successors and assigns. a Should it be necessary that the peutioner's works or improvements be removed, or should the said works or improvements be damaged as a result of the Saint Paul Regional Water Services' operations, a11 removal, replacement ar modification costs shall be borne solely by the peutioner. d. No change from the existing grade within the easement shall be permitted without written permission from the Saint Paul Regional Water Services. e.
