That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resoluuon.
That plans for the use of vacated Forbes Avenue shall be submitted to the Office of License,
Inspections and Environmental Protecuon and shall be subject to their Site Plan approval
process.
That the petiuoner shall pay all costs and expenses for any reconstruction of the Forbes-Smith
and Forbes-West Seventh intersecuons including but not limited to costs for new curbs,
sidewalks, boulevards, storm drains and street sign removal, that may be necessary to properly
eliminate the appearance of a public thoroughfaze, all to the satisfaction of the Department of
Public Works.
That the petiuoner shall be responsible for the costs and expenses of rerouting the existing catch
basin on West Seventh Street just south of the vacated area, as well as any street grade changes
that may be necessary to properly drain the intersections of Forbes at West Seventh and Forbes at
Smith, all to the satisfacuon of the Department of Public Works.

4 6. That the City of Saint Paul Department of Public Works wilI retain a permanent 20 foot
5 subterranean easement between the elevations of 50.00 feet and 60.00 feet City datum, centered
6 on the center line of the existing sanitary sewer main.

8 7. That the petitioners shall be responsibie for abandoning the two poles that feed City street lights,
9 and shall also install new lighting conduit on the east side of Smith Avenue when new curbing is
10 installed.

12 8. That, on behalf of the Board of Water Commissioners of the City of Saint Paul, a permanent
13 utility easement shall be retained on, over, under and across the vacated area to reserve the right
14 of the Boazd to maintain and operate any water facility in, on or upon said easement, and to enter
15 upon said easement or any portion thereof at any time, and from time to time for the purposes of
16 future construction, reconstruction, inspecuon, maintenance or repair of the same or any part
17 thereof. The said utility easement shall be subject to the following restrictions:

a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
other object that may prohibit normal access to water facilities for maintenance purposes
will be permitted within the easement azea.
b. With written permission from the Saint Paui Regional Water Services improvements in
or upon the above described easement that do not prohibit or limit the full and free
exercise by the Saint Paul Regional Water Services of its reserved rights may be allowed,
with the understanding that the restoration and costs of such improvements, should the
Water Services exercise its easement rights, shall be the sole responsibility of the fee
owner, its successors and assigns.
a Should it be necessary that the peutioner's works or improvements be removed, or should
the said works or improvements be damaged as a result of the Saint Paul Regional Water
Services' operations, a11 removal, replacement ar modification costs shall be borne solely
by the peutioner.
d. No change from the existing grade within the easement shall be permitted without written
permission from the Saint Paul Regional Water Services.
e. No change in surfacing within the easement azea shall be permitted without written
permission from the Saint Paui Regional Water Services.
f. The petitioner, its successors and assigns shall fully indemnify, defend and save hannless
the Board of Water Commissioners of the City of Saint Paul, its officers, agents,
employees, and servants from ail suits, actions or claims that shall arise from any injuries

of Qwest Communicauon, Inc.

of A. T. & T. Broadband, Inc.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul its officers and employees from ail suits actions or claims of any chazacter
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, negiect, or misconduct of said petitioners or
because of any claims or liability arising from any vio2ation of any law or regulation made in
accordance with the law, whether by the peuuoners or any of their agents or employees.
13. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
resolution, file with the City Cierk an acceptance in writing of the condiuons of this resolution
and shall, within the period(s) specified in the terms and conditions of this resolution, comply in

7he Department of Public Works has no objections to this vacation subject to
the following:
1) Plans for the use of vacated Forbes Avenue shaH be submitted to
LIEP and subject to their Site Plan approvai process.
2} The petitioner shall pay afl costs and expenses for any reconstruction of the
Forbes/Smith and ForbeslW. Seventh intersections which may be necessary to
properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street
sign removal, afl to the satisfaction of the Department of Pubiic Works.
3) The petitioner shall be responsible for the costs and expenses of rerouting
the existing catch basin on West Seventh Street just south of the vacated area
as well as any street grade cfianges which may be necessary to properly drain
the intersections of Forbes at West Seventh, and Forbes at Smith, all to the
satisfaction of the Department of Public Works.
4) The two existing catch basins within the vacated area of Forbes wouid
become the responsibility of the property owners. See attached sewer records.
5) The City of Saint Paul, Department of Public Works wi11 need to retain a
permanent 20 foot subterranean easement between the elevations of 50.0 and
60.0 City datum, centered on the center line of the existing sanitary sewer main.
