the northerly extension of the west line of Lot 15, said E. M. Mackubin's Subdivision.
BE IT FURTHER RESOLVED, that, subject to the herein stated exceptions and with the
accompanying Utility Easement Certificates of Intended Non-Use, filed voluntazily on behalf of Qwest
Communications, Incorporated, Northern States Power Company, d.b.a. Xcel Energy, District Energy St.
Paul, Incorporated, MCI Worldcom, A.T. & T. Broadband, Saint Paul Regional Water Services, and
The Department of Public Works, made a part hereof by this reference and filed in the office of the Cit7
Clerk of Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the
right to the utility easements in the vacated area described above.
18 This vacation sha11 be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
19 Saint Paul Legislarive Code as amended, and to the following conditions:

21 1. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
22 this vacation which is due and payable within 60 days of the effective date of this resolution.

That the petitioners sha11 grant a public alley easement within their property, acceptable to the
Department of Public Works.
That the petitioner shall be responsible for the reconstruction of the public right-of-way at both
ends of the vacated area to properly eliminate the appearance of a public thoroughfare, including,
but not limited to, costs for new curbs, sidewalks, storm drains and signs, all to the satisfaction of
the Department of Public Warks.
That the petitioner shall be required to obtain site plan approval from the Department of Public
Works, within the CiTy site plan approval process, for their pzoposed improvements within the
vacated area.

That the peritioner shall dedicate a new easement and assume all costs of relocating facilities
belonging to Northern States Power Company, d.b.a. Xcel Energy.
That, should it be necessary, the petitioner shall dedicate a new easement and assume a11 costs of
relocating facilities belonging to Qwest Communications, Inc.
That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
properry on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners or
because of any claims or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or empioyees.
20 9. That the petitioners, their successars and assigns shall, within 60 days of the effective date of this
21 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
22 and shall, within the period(s) specified in the terxns and conditions of this resolution, comply in
23 all respects with these terms and conditions.

The portion of the east-west alley in E.M. Mackubin's Subdivision of Block One (1) of Arlington Hills Addirion, Ramsey
County, Minnesota that lies beriveen Lots 1-4 and Lots 15-18.
I(we) request this vacation for the following reason(s). (Indicate whether you will be building on the site.)
Hmong American Partnerslup (HAP) plans to redevelop the propeRy, which wil] include the demolirion of the current building
and the conshuction of a new 37,000 sf facility to be used for program and office space, lease space for other agencies, and a
community multi-purpose room. The new plans ca11 for a building to be built along Arcade Street, with the pazking lot located
behind (to the west o� the building. This bnilding would block the alley, and cause it to be re-routed through the pazking lot to
both Cook and Magnolia Avenues. Please see attached site plans.

1) That the peutioners shall grant a public alley easement within their property, acceptable to the
Department of Public Works.
2) That the petitioner shall be responsible for the reconstruction of the public right-of-way at both
ends of the vacated area, to properly eliminate the appeazance of a public thoroughfare, including
but not limited to, costs for new curbs, sidewalks, storm drains, and signs, a11 to the satisfaction
of the Department of Pubiic Works.
3) That the petitioner shall be required to obtain site plan approval from the Department of Public
Works, within the City site pian approval process, for their proposed improvements within the
vacated area.

affected facilities and will retain its rights within the proposed vacation area as foliows:
The south 10 feet lying east of the northerly extension of
the west line of Lot 15 and west of the northerly extension
of the east line of Lot 16, Bfock 1, Arlington Hills Addition.
I have enclosed a copy of a GIS map showing the current location of our facilities.

Partnership for the vacation of:
that part of the alley in E. M. Mackubin's Subdivision of Block 1, Arlington Hills lying east
of the northerly extension of the west line of Lot 15, said E. M. Mackubin's Subdivision.
The purpose of this vacarion is to facilitate the constrnction of an office building.
