PAUL �oE N��� NO. ` OFFICE OF THE CITY CLERK OUNCIL RESOLUTION—GENERAL FORM � PRESENTED BY COMMISSIONE - DATF In the matter of a hazardous building being that single family wood frame dwelling known and described as 1328 Thomas ,�venue in the City of Saint Paul and situated upon those premises legally described as East 30 feet of Lot 13, Block 18, Syndicate No. 5 addition to the City of Saint Paul, according to the plat on file and of record in the office of the Register of Deeds in and for the County of Ramsey, Minnesota. WHEREAS, Pursuant to resolution, C.F. 246386, �ipproved November 21, 1969, a public hearing was duly held on Tuesday, December 2, 1969, before the Council of the City of Saint Paul, said hearing pertaining to the condition of the structure located at 1328 Thomas Avenue, Saint Paul, Minnesota; and WHEREAS, Upon the facts presented at the said hearing, con- sisting of photographs, inspection reports and the recommendation of the C3ty Architect, it is found and determined by the City Cot�n�il that according to the records and files in the office of the Register of Deeds, the last record owneis of t'he above-descr3bed property are Clement E. Ftiiger and Robert D. Fuger; that there ase no other record holders of interest; that it is further determined that the above-described building constitutes a hazardous buildi.ng within the definition of Minnesota Statutes, Section 463.15, for the following reasonsa � a. The interior condition of the building is dila- pidated, the ceiling and walls are deteriorating, electrical wiring is inadequate and vf�l.ates the City Housing Code; d. The buildinq is unfit for human habitation and constitutes a nuisance and a hazard to the public peace, health, safety and weifar� because of its physical damage, dilap3.dation, abandonment and inadequate maintenanee; now, therefore, be it RESOLVED, That in accordance with Minnesota Statutes, Section 463.15 through 463.26, and based upon the foreqoing findings of the City Council, the Council of the City of Saint Paul does hereby make the foliowing ordera ORDER l. The owner of the above-described building shall make the same safe and not detrimental to the public peace, health, safety and welfare by having the said building razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order. 2. In the event that the building is to be razed by the Cit� of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of judqment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4.
