BE IT RESOLVED,.that, upon the peution of Todd Daddario, as documented in Real Estate Division
File Number 2002-14, public properties hereinafter described are hereby vacated and discontinued as
public property: The propeny to be vacated is described as follows:
The North 'h of Pullman Avenue from the East line of White Bear Avenue to 140 feet East.
7 This vacauon sha11 be subject to the terms and condiUOn of Chapter 130, codified Mazch 1, 1981, of the

That the petitioner's, their successors and assigis shall pay $500.00 as an administrauve fee for
this vacauon which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Qwest Communications, Inc.
That a permanent utility easement shall be retained on, over, under and across the vacated area on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from ume to time, for the purposes of future construcdon,
reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Any
development or use of the property sha11 be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit narmal access to uulity facilities for maintenance purposes
will be permitted within the easement area.
b. Ixnprovements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be aliowed by obtaining written permission from the
Department of Public Warks Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the Ciry exercises its reserved easement rights.

written permission from the Department of Public Works, Sewer Division.
No change in surfacing within the easement azea will be permitted without written
permission from the Department of Public Warks.
e. Existing sewers cannot be built over and sewer manholes must be kept at its current
grade. Any work to change the grade of the existing manhole must be done by a licensed
house drain contractor

8 the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter

11 to, a claim brought because of any act of omission, neglect, or misconduct of said pecitioners or
12 because of any claims or liability azising from any violation of any law or regulation made in
13 accordance with the law, whether by the petitioners or any of their aQents or employees.

Sorry I didn't get this to you sooner - I had to leave early yesterday.....
Here's what I've gotten back for comments:
From Street Engineering -
Vacation NOT OK with Streets, due to existing 15" storm main in proposed
vacated area. If appiicant desires access to rear of parcel, Pubiic Works
can issue a permit for a private driveway in the public R.O.W. -
encroachment of any proposed buldings in the R.O.W. would not be allowed.
From Sewer Engineering -
Shailow storm sewer easement runs through requested parcel. Easement must
be retained. Grade cannot be changed without Sewer Department
approval. Sewer cannot be built over. Access / Driveway can be
constructed over this easement, sewer manholes need to be kept at grade for
maintenance. If manhole needs to be raised, a licensed house drain
contractor must be hired to do the work.
Do you need me to combine these comments and put them on that "Vacation
Inquiry" form?? or is this sufficient?
