That a permanent utility easement shall be retained on, over, under and across the vacated area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to maintain and operate any sewer in or upon said easement and to enter upon said easement or any portion thereof at any time and from ume to time, for the purposes of future construcdon, reconstruction, inspecting, maintaining or repairing the same or any part thereo£ Any development or use of the property sha11 be subject to the following conditions: a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any other objects that will prohibit narmal access to uulity facilities for maintenance purposes will be permitted within the easement area. b. Here's what I've gotten back for comments: From Street Engineering - Vacation NOT OK with Streets, due to existing 15" storm main in proposed vacated area. If appiicant desires access to rear of parcel, Pubiic Works can issue a permit for a private driveway in the public R.O.W. - encroachment of any proposed buldings in the R.O.W. would not be allowed. From Sewer Engineering - Shailow storm sewer easement runs through requested parcel. Easement must be retained. Grade cannot be changed without Sewer Department approval. Sewer cannot be built over. Access / Driveway can be constructed over this easement, sewer manholes need to be kept at grade for maintenance. If manhole needs to be raised, a licensed house drain contractor must be hired to do the work.
