RESOLVED, Thet the proper officers of the City of Saint Paul are hereby
authorized to pay to Ashbach Construction Co�pany on Partial Estimate No. 10,
Contract No. L-7086, for the Grading gnd Peving of MISSISSIPPI RIVER BOULEVARD
f mm approximately 699 feet south of Dayton Ave. to approximately 225 feet north
of Pelham Blvd. , DAYT�N AVENUE from Mississippi River Blvd. to approxi�ately 185
feet east, and PELHAM BOULEVAEtD f rom Mississippi River Blvd. to approximately
235 feet north (Project no. 68-P-194AI and construction of a Bridge on MARSHALL
AVENUE at Mississippi River Blvd. (68-M-290}, said estinate being paid for the
period of Noveaber 1, 1969 to December 19, 1969, and such other partial esti�ates
on said contract that �ay be presented subsequently by said contractor and
approved by the City Engineer, it being the understanding of thfs Council that
such partial payaent or payments on partial esti�ate or esti�ates on safd Con-
tract in no way are to be construed as an act by the City or any of its agents,
servants or eaployees extending the ti�e specified for the completion or in any
Way changing the terss of said Contract, Plnns or Specifications thereof, nor in
any way nor by any �eans shall this resolution or payment, or payeente made under
authority of this resolution be construed as a waiver of any of the rights of
said City under ssid Contract, and provided thst prior to payment of any of the
aforesaid partial estimate or esti�ates, said contractor by fts duly suthorized
agents or corporate officers, shall file with the City Co�nptroller in a for�
approved by the Corporation Counsel an ecceptance of the conditions of payment
as hereinbefore set forth, and
BS IT FURTHER RESOLVED, That in the absence of said acceptance being filed
with the City Co�ptroller, no pay�ent or payments as aforesaid shall be �ade.

on said contract that may be presented subsequently by said contractor end
approved by Che City En�ineer, it being the underetanding of this Council that
such partial pay�eent or payments on partial estimate or e�timates on seid Con-
tract in na way are to be construed as an act by the City or any of its agents,
servants or employees exCending the time specified for the completion or in any
way changing the terms of said Contract, Plens or Specifications thereof, nor in
any way nor by any means shall thi� resolution or payment, or pa�ments made under
authority of this resolution be construed as a waiver of any of the righta of
said CiCy under said Cnntract, and provided that prior to payment of any of the
aforesaid partial estimeCe or estimates, said contractor by its duly authorized
egents or corporate officers, shall file with the City Comptroller in a form
approved by the Corporation Counsel an acceptance of the conditions of payment
as hereinbefore set forth, and
BE IT FURTH�R R�SOLVED, That in the absence of said acceptanee being filed
with the City Comptroller, no payment or payments es aforesaid shall be made.
