BE IT RESOLVED, that, upon the peution of Jake Cadwallader, as documented in Real Estate
Division File Number 2002-12, public properties hereinafter described are hereby vacated and
discontinued as public properry: The property to be vacated is described as:

This vacafion shall be subject to the terms and condiuon of Chapter 130, codified Mazch 1, 1981, of the
Saint Paul I,egislauve Code as amended, and to the foilowing conditions:
1. That the peutioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effecuve date of this resolution.
2. That a permanent utility easement sha11 be retained within the vacated azea to protect the interest
of Xcel Energy Electric for existing distribution lines in the vacated area, any relocation of
these facilities will be at the expense of the developer and contingent upon acquisition of
easements over any new location.
3. That at the direction of the City of St. Paul, Department of Public Works the remaining right of
way will have in place the proper lighting and signals.
4. That the petitioners, their successors and assigns agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees from all suits, actions ar claims of any character
brought as a result of injuries or damages received or sustained by any person, persons or
property on account of this vacation or petitioners' use of this property, including but not limited
to, a claim brought because of any act of omission, neglect, or misconduct of said petitioners ar
because of any clauns or liability arising from any violation of any law or regulation made in
accordance with the law, whether by the petitioners or any of their agents or employees.
