BE TT RESOLVED, that, upon the petition of Robert McCullough, as documented in Real Estate
Division File Number 2002-09 pubiic properties hereinafter described aze hereby vacated and
discontinued as public property: The property to be vacated is described as:

This vacauon shall be subject to the terms and condiuon of Chapter 130, codified March 1, 1981, of the
Saint Paul L,egislative Code as amended, and to the following conditions:
1. That the petitioner's, their successors and assigns shail pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effecuve date of this resolution.
2. That a permanent utility easement shall be retained within 2he vacated area to protect the interest
of Saint Paul Regional Water Services for existing facilities as described in Exhibit "B" attached
hereto.

That a permanent utility easement shall be retained within the vacated areas to protect the interest
of Xcel Energy (dba NSP) for accessing existing facilities.
That a permanent utility easement sha11 be retained within the vacated areas to protect the interest
of Qwest (fka US West Communicafions) for accessing existing facilities.
5. That a permanent utility easement shall be retained by the City of Saint Paul, Department of
Public Works, within the portion of Bancroft Street located in the intersecUon of Eaton Street
and the petitioner shall dedicate a sewer easement along the westerly edge of the property
known as 300 Eaton Street for future maintenance of an existing 6" force main.

1 6. That the petiuoners, their successors and assigns agree to indemnify, defend and save harmless
2 the City of Saint Paul, its off'icers and employees from all suits, actions or claims of any chazacter

4 property on account of this vacation or petiuoners' use of this property, including but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petiuoners or
6 because of any claims or liabiliry arising from any violauon of any law or regulation made in

18 accompanying approved Utility Easement Certificates of Intended Non-i3se, filed voluntarily on
19 behalf of District Energy St. Paul, Incorporated, Comcast (fka ATT Broadband, fka
20 MediaOne), Saint Paul Regional Water Services and Xcel Energy-Gas Distribution made a
21 part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for
22 itself and on behalf of these corporations and depar[ments, waives the right to the utility

within the easement azea is permitted without written permission
from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements
be removed or damaged as a result of Water Utility operations,
all remova:, replacement or modification costs shall be borne solely by
the petitiorer.
4. That the petitioner, its successors and assigns shall fully indemnify,
defend and save harmless the Board of Water Commissioners, its
afficers, agents, employees, and servants from all suits, actions or claims
which shali arise from any injuries or damages received or sustained by
any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of

After our meeting on June 12, we figured out a way to allow permit approval for your building at
300 Eaton Street while the street vacations are in process. We have agreed to issue an
encroachment permit to cover your two sites affected by the pending vacations. This would be
considered a temporary permit until the vacations are completed, or until December 31, 2002,
whichever comes first. The end of the year deadline shouid allow plenty of time to complete the
vacations, while stiil providing you and City staff the motivation to diligently continue the
process.
The following aze the two conditions that the Deparrment of Public Works will be placing on the
vacations:
1) That a perxnanent utility easement shall be retained within the portion of Bancroft St. where
Eaton Street crosses.
2) That the petitioner shall dedicate a sewer easement along the westerly edge of the property at
300 Eaton Street for the future maintenance of the existing 6" force main.
